Mr. Neil said that they have been serving the community for 30 years now and that they have seen an increase of the need to carry spirits for customers of the new apartment complexes in the area. He added that they have renovated the store just to make sure that they are serving the community and to show the support of the community, they gathered 1,200 signatures from local residents and neighborhood businesses. He also said that they are very vigilant with customers (to avoid immediate consumption) and keeping the grounds clean. He said that he understands the concentration fact but that the only other liquor store around is around half mile radio, which does not mean a direct competition with the neighborhood stores. Mr. Neil added that they are looking to have a small section for hard liquor just to address the neighbor’s needs better.

Mr. Neil said that they are basically reducing the wine display and replacing it with hard alcohol.

Mr. Neil said that when the license was granted three years ago, they just made the clarification that the licenses was for wine only.

He added that three years ago, they also testified and that the applicant stated at the neighborhood meeting that they had no wish to sell hard liquor.
Amarjit Virk – 2632 S KK Av – said that his opposition is based on concentration.
Richard Frenn - 2523 E Oklahoma – Owner of Bert’s Liquor - said that the applicant made an agreement not to come back for liquor and that he thinks that they are going to cut down groceries to sell beer and liquor only. He added that the committee cannot grant a license to a person who hardly speaks English and that there is a lot of crime in the area.

Marco Bonaquisto - 306 E Lincoln Av – said that he goes a lot there to get from potatoes to champagne and orange juice. He added that they care about the community and that they know everyone by name.
Juan Irrizarri -2652 S 31st St - said that he has been a customer for so many years, that he cashes his checks there and that they have become very good friends.
James - 2271 S Howell Av – said that the applicants are extremely responsible skateholders in the community and that they are always taking care around the premises including the bus stop.
Douglas Gear - 2370 S Howell Av – said that he has known them for 15 years and that they are responsible business owners and an asset to the community. He added that service is needed in the area.
John Petri - 1825 S KK Av – Tender Car Coalition – said that the applicants are the hardest working family that he knows and that they run the store beautifully. He added that this store has not have had incidences for 30 years and that they deserve the chance.
John Andrice - 2215 S KK – said that they are great in the neighborhood.
Shelby - 2325 S Howell – said that the applicant is the first person that he met when he moved in back in 2013. He added that they have done a lot for him and for the community.
Laurie Deninger - 2325 S Howell Av – said that she is disabled and that it would be nice to have everything what she needs in one place.
Pashtel Singh - 2305 S Howell Av – said that he has been there since 1990 and that he along with the applicant gave a shot to the Bay View area when it was in a bad shape and that they have struggled a lot too.
Kevin Kuschel - 322 E Lincoln Av – said that this store makes his life incredible easier and that walk to the other liquor store is a struggle under this weather. He added that the applicant is a staple to the neighborhood. He added that demographics changed and will continue to change and that this service is needed.

Ald. Dimitrijevic said that there is no question that this family is well known, supported, that they run a very successful business, and that the leap from beer to wine was successful. She also explained that there have been other businesses in front of us that she has objected too like Target on S. Chase Av 2017 and 2022, Serenity 402 at 2483 S KK Av in 2022, Best Liquor at Becher St, Aldi on Cleveland Av., and B&G on S 6th St. She added that the concentration map must be looked at in a different perspective, that there have been people here to talk in support but that there are also 3 verified objections within 250 feet that are part of the file in addition to more objections. She said that this is the process that she uses and that it is what this committee uses because those neighbors are the most impacted.
Ald. Dimitrijevic said that she met with the applicants few months ago and let them know that she does not support the transition, that they already had one from beer to wine and beer and that for her is a matter of balance.
Ald. Spiker said that it seems that the request to expand the license comes from people from new developments and that the committee must consider the people who has lived there for a long term too.
Ald. Burgelis said that he is thorn on this application with the alder's opposition and the applicant not willing to amend the application to eliminate the single serving size.

Atty. Nathaniel Adamson appeared on behalf of MPD and said that MPD continues to object to the renewal of the licenses for El Inferno and that Officer Boyd will start to testify beginning where the cocaine was stored, where some of the money recovered from the business was located and that Mr. Martinez was interviewed by Law Enforcement (not included in the report) on May 17, 2024 and that at this point, MPD will be presenting evidence of the entire investigation.
Police Officer Boyd – said that she works on The Milwaukee Safe Streets Task Force with the FBI regarding drug dealing investigations. She continued saying that on May 2, 2024, she was in charge of the El Inferno warrant and recovered 2.9 grams of cocaine at the backroom/storage and ice machine area and $31,000 cash scattered in places ($14,000 was found in bags inside the freezer), and one pill bottle (where the cocaine came from) on one shelf. She added that they did a lot of surveillance during the investigation, saw lots of hand to hand drug dealing, that their targets of the investigation were always supplying customers with narcotics and that they did controlled purchases with their confidential informants. She added that they were able to buy a half kilo of cocaine which resulted in 10 arrests and more money and guns were recovered.
Atty. Adamson asked Officer Boyd if the hand to hand transaction happened inside or outside this bar.
Officer Boyd said that deals happened inside and outside.
Atty. Adamson asked if the half kilo of cocaine purchased was at a meeting that happened at “El Inferno”.
Officer Boyd said that it is correct.
Atty. Adamson asked if on the interview made to Mr. Martinez on May 17, 2024 he talked about how he got involved with this business.
Officer Boyd said that Mr. Martinez stated that his friend Rafa (Mr. Martinez does not know his last name), asked him to put his name on the license because the wife was no longer interested in running the bar. That technically, he is a bartender and cleans up the bar, that he agreed to be the licensee and that he does not receive any money for being the licensee.
Atty. Adamson asked if Mr. Martinez made any comments about selling controlled substances.
Officer Boyd said that Mr. Martinez acknowledged seeing several patrons selling drugs and that he asked patrons not to use drugs inside the bar. That here and there he has found drugs on the floor while cleaning. She continued saying that Mr. Martinez said that sometimes, he would hold 3 bowls of drugs to be picked up by other people. She added that it is obvious that Mr. Martinez was aware of the drug dealing.
Atty. Adamson asked if Mr. Martinez purchased any illegal drugs for his personal use at the bar.
Officer Boyd said that Mr. Martinez admitted it.
Ald. Zamarripa asked Officer Boyd if the applicant mentioned something about receiving money for being the agent of the bar.
Officer Boyd said that Mr. Martinez stated that he receives $750 per week as a bartender and to clean up the bar, but that he does not receive any of the profits for being the licensee. She added that he does not pay the bills nor is he in charge of the paperwork and that he does not know how much the bar makes. She also mentioned that Mr. Martinez said that he did not know what was in the freezer the day of the warrant.
Ald. Zamarripa asked Officer Boyd if Mr. Martinez who is present here, admitted to selling drugs in the bar.
Officer Boyd said that the applicant admitted to holding the drugs and handed them out at pick up.
Ald. Burgelis asked the applicant if he has any reaction about MPD’s testimony.
The applicant said that he would like to continue working.
Ald. Zamarripa said that she is dismayed by the MPD testimony and is very disappointed of the applicant’s refusal to talk.

The applicant was present along with Atty. Maistelman.
Atty. Maistelman said that the police report is extensive and that his client was issued a nuisance letter. He added they put a meeting together to address the nuisance and that MPD approved the plan the very same day. He added that the plan and letter of acceptance is part of the record now and that there were only 3 incidences after the meeting, which shows that the plan is working. He also mentioned that they are following the plan of operations and that they will be filing a RO against one individual who keeps coming back causing trouble.

Ald. Pratt asked if there has been some training regarding calling the report for those 4 incidents that they were not cooperative.
Atty. Maistelman said that there has been training on the matter and that they have hired a new security company as well.
Individuals in objection:
Gerald Coon – 1731 N 32nd St – said that he has lived there for 36 years, that he picks up garbage on his reflective orange vest the entire week. He added that this gas station affects severely the neighborhood and that this area is the perfect ecosystem for drugs, prostitution and the garbage that never ends. He said that he is looking for the committee to reduce the hours.
Ald. Burgelis said that the shooting incidences did not happen after hours.
The applicant said that he is aware but that this measure will improve other aspects.
Adrian Spencer – said that she works for the Midtown Neighborhood Alliance and what that she hears the most, is that people do not feel safe there and that she experiences the same.
Megan Shepard Smith – 1935 N 25th St – said that she works for the Midtown Neighborhood Alliance and that the objection is based on the drug dealing, garbage and prostitution around. She added that this business is permitting a lot of what is happening around and that there was no proactive measures to address the neighbors’ concerns. She added that neighbors want to be heard and that their suggestions must be taken in consideration.
Ald. Burgelis asked the applicant if she has noticed a change since October.
Ms. Shepard Smith admitted that there has been a slight change.
William Smith – Midtown Neighborhood Alliance – said that he wants to reiterate the need to work with the applicant.
Mr. Ellzey thanked the witnesses for being here and said that they want to hold the application in order to make sure that the plan includes what the community needs.
Atty. Maistelman agreed.

The applicant was present and regarding the items in the police report he said that, item 42 was a about a stolen vehicle while bumping gas and that no one was hurt. For the following item he said that it was an attempt to high jack the car but that the owner ran into the store, the store was locked and the vehicle was unable to be moved so the thieves ran away. He added that he talked to Ald. Stamper immediately after and they came up with doubling up employees and to set up a microphone and speaker to ask people to leave the premises if they look suspicious. He explained that the idea is to monitor better the parking lot and the pumping area. He said that item 49 was medical related and that they called for help, that item 50 was about a customer who let the car open with the keys inside; that item 51 happened at the curb but that his address was used because he was the one who called too. He mentioned that items 52-55 are about the same person with mental issues and heavy drug use who caused a lot of damage to the store. He added that he was able to get a RO.
He also said that the location is kept clean inside and outside, that is well lit and that they do the best they can do to run it and that they have complied with Ald. Stamper’s suggestions.
Individuals in objection:
Megan Sheperd Smith – said that she has no remarks.
Adrian Spencer – said that this location causes a great amount of concern among residents and herself. She added that visible trafficking happens a lot between vehicles and they have seen a guy wearing a mask and carrying a long gun. She added that they need safe places for the children to shop for candy and that she has not seen any improvement at this location. She also said that neighbors prefer to go further to buy gasoline because they feel unsafe there.
Gerald Coon – said that sex trafficking is evident at this location and that the extended hours promotes that. He also said that he challenges the owner because the store is not clean and that he has pictures from Saturday morning to share.
Ald. Burgelis asked how many calls for service MPD has received after October.
Sgt. Velasquez said that 14 calls have been received.
Ms. Lopez said that we need to add on file all the updates to the plan mentioned by Mr. Ellzey.
Ald. Westmoreland moved to amend the plan of operations with cleaning the premises 5x/day, to hire a Security Company from April thru September from 9pm to 9am and to double up staff 24hr/day.
Mr. Ellzey said that Ald. Stamper has no objections.
Ald. Burgelis moved approval as amended with a warning letter. There were no objections. (Prevailed 5-0
