The police report was read. The applicant said that there are a lot of issues with the location and that for item 2 on the police report, he explained that the server was busy and did not have time to ask for an id. He added that they have been asking for ids prior to serving alcohol. He also explained that the other item on the police report was about him taking bottles of alcohol from one location to the other and that he did not know that he was not allowed to do it. Individuals also present: Ald. Zamarripa asked if the fines have been paid. The applicant said that he has paid the fines. Ald. Burgelis asked how they are checking ids now. The applicant said that there is a security guard starting at 9pm on Fri Sat. Ald. Perez said that he has talked to this applicant several times about this location. He added that they talked about his management practices and that he still sees a pattern of bad practices and that he would like to move for a suspension. The applicant said that he understands what happened but that he disagrees with the actions because he has seen businesses that have done worst with fights and shootings and remain open. The applicant declined to make any further closing remarks. Ald. Zamarripa clarified that Ald. Perez is recommending a suspension, not a denial. Ms. Lopez explained in English and Spanish the impact of the suspension on all of the licenses. The applicant acknowledged the explanation. Ald. Perez moved renewal with a 10 (ten) day suspension based upon the preponderance of the evidence in the police report and applicant testimony that demonstrates the operation results in a threat to the health, safety, or welfare of the public. Burgelis on the motion said that the applicant did not prepare himself for the hearing and did not present a mitigation plan to address the issues to the committee.

Ald. Zamarripa said that this application was scheduled due a MHD objection. Individuals in objection: Lauren Woboril and Carly Hegarty from MHD appeared. Ms. Woboril said that the objection is based upon the change of ownership, not securing the proper license and selling food after the business was asked to cease operations. Individuals also present: Ald. Burgelis asked if the spreadsheet on file is the evidence of the food sales without a license. Ms. Woboril said that there is the spreadsheet and two receipts with date and time stamped. Ms. Lopez said that the receipts were not noticed. Atty. Gresham said that the communications were internal and that there is a proper notice concern. Mr. Cooney explained that the committee has what it was sent by MHD and that the applicant has the same file. Ms. Lopez said that the two receipts are mentioned but not attached to the MHD's email. The applicant said that the business was not open due the cease operations order. She added that she remembers people knocking at the door the same day and that no sales were made. She also said that the person who filed the complaint was an employee who was terminated the same morning that she contacted MHD and also entered the sales. Perez was excused during this hearing. Ald. Jackson joined the meeting. The applicant was present along with Atty. Maistelman. Individuals also present: Ald. Bauman said that this application was rescheduled because he does not support the change of age which was agreed by the applicant when the license was originally granted. The applicant said that for the first incident on the police report, they met with the police and had a great conversation. He added that the employee was advised to cooperate with the police moving forward. He also said that they removed the contaminated bottles and asked the bartender to apply for the license. Individuals in support: Alex Anderson – 2025 E Greenwich #116 – said that he is in support of the change of age and that this business should be given the same opportunity as the neighboring businesses. He added that it seems that this business has been targeted. Ald. Spiker asked the witness if he patronizes the business and what kind of relationship has with the owner. Mr. Anderson said that he is a patron and the applicant’s real state agent. Ald. Spiker asked if there is a gap in the atmosphere because of the age restriction that impacts him as a patron. Mr. Anderson said that there is a gap that does not impact him but impacts the business. Ald. Burgelis asked the witness if he thinks that the change of age will improve the business. Mr. Anderson said that he thinks it will improve. Ald. Perez asked Mr. Anderson's testimony, if he thinks that the age restriction on this establishment is because of the black patrons. Mr. Anderson said that he was here when Allure came to the very first hearing and the license was granted with the condition to serve 25 and up which makes him think that it is a direct reflection of the color of the patrons. Ald. Perez asked the witness if there aren’t any African-American patrons at the other establishments. Mr. Anderson said that the other establishments have a diverse clientele and that Allure serves predominantly people of color and that he does not think that the restriction is linked to the level of maturity of the 21 years old but to the color. Ald. Bauman asked if the applicant is looking to sell the building. Mr. Anderson said that there is no signed agreement to lease or sell the building yet. Ald. Bauman said that the applicant told him that he is looking to sell the business and the real estate. Mr. Anderson said that Mr. Bates is looking for opportunities to a solution with the unfairness that he has experienced on Jefferson St. Atty. Maistelman said that he submitted a newspaper article for everyone to read about this issue. Ald. Bauman objected to the article on the basis that is not a proper evidence to be submitted with anonymous statements. Ald. Zamarripa noted the objection and acknowledged that the article was added to record. Ald. Perez asked the applicant why did he agree to the age restriction when the license was first granted. The applicant said that it was something that the alderman asked during the meeting after he said that he was looking to target the 25 and up market. He added that he took a chance in getting the license. Ald. Perez asked if he didn’t want to but that he agreed to it. The applicant said that it is correct. Atty. Maistelman said that the applicant and Ald. Bauman agreed on the age group and that there haven’t been any problems and that is the reason why his client is asking to remove the condition. Germaine Jacobs - 5835 N 79th St – said that he is a patron since the beginning and that he can see the difference of treatment given at this business comparing to Sophie’s and Taylor’s. He added that the agent has worked to make his business better and to represent his community in the best way. He asked the committee to give this applicant the opportunity to be successful. James Taylor – W279 N8265 – said that he has listened the testimonies and that this condition has nothing to do with the race. He said that he is concerned about lowering the age because in front of Allure, there have been people with a cooler selling beer and shots on the street and that he has not seen anything like this in 30 years. He added that he has been at Allure and that he saw one customer being kicked out of Allure who walked out to his bar and knocked two individuals down with his fist and left them on the sidewalk knocked out. He added that it was horrible and that he has witnessed people carrying guns and running down Jefferson St. twice. He also said that this is not about Tino’s business but that this behavior is happening and lowering the age would be a worse problem. Ald. Burgelis asked Mr. Taylor if he called the police when he saw the people running with guns and selling alcohol in front of Allure. Mr. Taylor said that he did not. Ald. Burgelis asked Mr. Taylor if he informed Mr. Bates about the alcohol being sold in front of his location. Mr. Taylor said that he did it. Atty. Maistelman asked Mr. Taylor if he took a picture of the person selling alcohol outside. Mr. Taylor said that he did not. Mr. Bates said that some photos were submitted last year of a person with a cooler and that it is not in front of his business. Colin Phillips – 795 N. Jefferson St. – General Manager at Taylor’s – said that he sees a lot of marijuana smoking, loitering and that he is opposed to lowering the age limit as he fears will lead to havoc on the street. He added that no other businesses in the area knew Allure wanted to lower the age; that the licensee never spoke around about and he feels that it is an issue because Mr. Bates is an absentee owner. He added that the bars on the street are trying to cater for an older crowd and lowering the age will bring noise, different motor vehicles that will compromise the current business model. He also said that this is not personal and that Mr. Bates is a great guy. Ald. Pratt asked for the age limit at Taylor’s. Mr. Phillips said that it is 21 but that the age group they serve is between 27 and 70 years old. Ald. Bauman said that the solely issue is the age limit. He read the third paragraph of the PA33 which still agrees to the 25 year age group like 5 years ago. The applicant said that Ald. Bauman is referring to a conversation about other location. Ald. Bauman said that the police report clearly stated the applicant is talking about Allure. Ald. Spiker said that changes might bring another challenges and that the owner needs to take precautions. The applicant said that they have been doing very well the last three years which makes him think that he is ready for the change. Atty. Maistelman said that he would advise his client to hire an additional security officer to watch the younger crowd with zero tolerance for people under 25 and that they would notify the other businesses in order to ban disruptive people. Ald. Spiker asked Ald. Bauman if there is an specific reason why the restriction for 25 and up is needed. Ald. Bauman said that his office and Red Code were aware that the “Truth Lounge” on MLK Drive had issues with crime, fear and disorder and that they also knew that Mr. Bates was the owner. He added that when Mr. Bates talked about opening this establishment, the concerns at the other location were raised and discussed and that as compromise, Mr. Bates agreed to lock the 25 age limit. He also said that this testimony agrees with what Mr. Bates said on the PA-33. Ald. Spiker said that the applicant must have to make sure that he is running things clear and tight and not to allow mistakes like the unlicensed bartender on the police report. Atty. Maistelman asked why there are no objections with the renewal but there are with the change of age. Ald. Spiker moved to separate the motions. There were no objections. Ald. Maistelman. The applicant said that there is a misunderstanding with the item on the police report, that what he wanted to say is that no one on the block was aware of the ordinance. He added that he received a letter from MPD the next day giving him the proper notice and that he has followed it ever since. Individuals also present: Ald. Bauman said that the PA33 is very clear with the loud music coming from the rooftop after midnight. He added that this is the first renewal and that he remembers the conversation that he had with the applicant at the beginning. He explained that it is a very narrow new construction, 3 stories tall with a wide open bar at the rooftop and that he specifically remembers discussing the issue about the noise and music been played after midnight because it’s been a frequent problem on Water St. He also explained that these circumstances have led to suspensions to licenses on the same street and that it is his concern because this is about where he get complaints from residents who live right across the street. Ald. Bauman said that we are encouraging people to live in downtown and that we must have residential sensitivity to loud music. He also mentioned that there is an ordinance that was discussed with the applicant and that the applicant assured him that he was not going to have noise complaints from his business. Maistelman said that his client can explain in detail what happened but that employee involved was terminated. Mr. Singh said that they did not buy toys because they do not sell toys and don’t have children at home. He added that police came, they were given permission to search the store for the missing toy which it was not found and that when they give access to surveillance system, they found out that the hard drive was out. He also said that they placed an order for a new surveillance system with 10 cameras before this incident and that it has been installed. Individuals in objection: Savannah Brooks – Near West Side Partners – said that they have been monitoring this store, that it has been cooperating and recently removed from the Landlord Compact List. She added that they have been working on the loitering issues which they continued to occur, like the panhandling issues, that she has witnessed drug deals and public drinking in front of this establishment. She also explained that their objection is to the Class A Fermented license. Ald. Bauman asked Ms. Brooks if she has personally witnessed the drug deals, pan handling and alcohol consumption in front of this premises. Ms. Brooks said that she has. Ald. Bauman asked Ms. Brooks if she also stated that the business has improved greatly but not at the point to reduce the incidences of the behavior that she has testified today. Ms. Brooks said that it is correct. Ms. Lopez clarified that MHD withdrew the objection and that there is no police report answering Ald. Chambers’ question. Atty. Maistelman asked Ms. Brooks if the store has improved from 8 months ago. Ms. Brooks said that the store has improved the exterior and interior of the store. Atty. Maistelman asked Ms. Brooks why they are objecting to the Class A license. Ms. Brooks said that they do not need more alcohol in the neighborhood because they are trying to revitalize the area. Atty. Maistelman asked Ms. Brooks if she objected to this license when it was first granted for his client. Ms. Brooks said that the objection came from another member of the organization. Atty. Maistelman asked Ms Brooks if she was working at this same store when the license was first granted. Ms. Brooks said that she was working at the store with a different ownership. Catherine Ivory – 1227 N 28th St – Cold Spring Park Historic Neighborhood - said that she agrees with Ms. Brook’s testimony, that they observed similar issues at the Concordia neighborhood, that it is true that they don’t want food deserts but that there is no need for alcohol. She added that she did not object the first time because she was not aware of the hearing. Ald. Spiker asked if the information shared was observed personally. Ms. Ivory said that this information is shared as board member from people voicing their concerns about the area and that she can only testify for the litter. Ald. Bauman asked if the person who filed the objection was notified. Ms. Melendez confirmed that the objector was notified by email. Laura – 3209 W Wells St – Schuster Bed and Breakfast – said that her business has been there for 17 years and admitted that the applicant has changed the building, that he has made an effort but that the location that he picked and the customers coming in are the problem because when they buy from him, they come down 32nd St throwing wrappers and bottles as they eat and drink. She added that they clean extensively because of this problem and that when the customers drink, their behavior and attitudes change too. She said the actions of his customers are affecting her at the point that she gets bad customers reviews for those reasons. Ald. Chambers asked what is the clean up schedule. The applicant said that he does it once/day around his business. He added that he is cooperating with the neighborhood association and MPD and that they need more time to prove themselves. Ald. Bauman said that there is a direct testimony and that this is the only alcohol store in the area which is the cause of the nuisance and asked the committee not to renew the Class A license. Atty. Maistelman said that they are willing to hire a professional (licensed and bonded) security guard, do power sweeps within a two block ratio 2x/day and pest control. Ald.
