Atty. Wisco said the following about the police report: the date on paragraph 1 is incorrect (11/18/2024) and that the date of his client’s conviction was May 5, 2022, which is before he applied for the original license.
Atty. Wisco said that she has evidence that the video was filmed at Lush Lounge instead and that the alcohol bottles were empty. She added that the rapper was at his client’s location for 30 minutes to make a promotional tik tok video and that she has the copy as well. She mentioned that only the rapper, his manager, 2-3 friends were at the store at the moment when the promotional was filmed, that the store was not open to the public and that is why they did not have a surveillance footage available. She added that the security cameras were upgraded and installed on 2023 and that they can be managed from the applicant’s telephone.

The applicant said that the smell was from the rapper’s presence at the store.
Atty. Wisco mentioned that secondhand marijuana smell are common at the store and that is why they keep spraying the store.
Ald. Perez asked the applicant if he knows the rules and regulations about his license and occupancy.
Atty. Wisco said that his client saw this as a promotional opportunity and that he has learned his lesson.
Ald. Perez asked if fired the employees.
The applicant said that he fired two.
Ald. Perez said that there was a shooting, the police came, his employees (who are representing the owner) were uncooperative, that his surveillance system was not functioning, etc. He added that we are dealing with a licensee that he is not being responsible.

The applicant said that he is there 3 days/week from 12pm to 8pm and some hours over the weekend.

The witness said that it is against the lease agreement and that the applicant has grown after those events. She added that the lease states the type of activity that he is allowed to have.

Lindsay St. Arnold Bell - Near West Side Partners – said that she recognizes that the applicant has been working with them, keeping the store clean and that he is engaged with his customers but that they object to the alcohol for the history at this location and the problem that they have to overcome as a neighborhood. She added that she told the applicant that they were not going to support an alcohol license when he applied for the food license because they do not want to see any detriment as a result of the alcohol sales. She said that there are 5 liquor stores within a mile. She also mentioned that they have been consistent about not supporting alcohol licenses.
Celia Wiberg - 946 N 31st St – said that she has seen the ups and downs for 39 years, the effects of the liquor stores and that she feels safe walking around because she is not hearing silly comments any more and/or seeing public urination and littering as she walks.
Schsuter Bed & Breakfast - 3209 W Wells St – said that she acknowledges everything what the applicant has done in order to keep the store clean and customers under control. She added that her concern is that alcohol will bring problems to the neighborhood like parking and traffic. She added that they have fought for 16 years to have a decent neighborhood and that they want to continue that way. She also said that they don’t need more alcohol in the area when there is a liquor store from the applicant.
Savanah Brooks – Near West Side Partners – recognized that the applicant has made changes to improve the area and the business itself but that they are against any liquor license.
Individuals in support:
Latasha Darnell - 2722 N 45th St – said that she has known the applicant for 24 years, that he is like a godfather to her kids and some others in the community. She added that she has seen Steve standing all day long outside the store taking care of the store.
Ald. Spiker asked the witness if there is need for beer at this location.
The witness said that it is what the applicant is pursuing.
Michelle Casey - no address provided – said that he has been in the area for many years, that the applicant treats everybody with respect as a good human being and that he is one of the reasons why Wells St is clean. She added that having a beer license would give the applicant more money to invest in other business for the community.
Mr. Douglas - 1321 S 57th St - Said that the applicant comes to everyone’s way everyday, that he has seen a lot of improvement, and that he has not seen Ald. Bauman over there.
Allan Hooper – 3712 W. Melvina – said that the applicant has done a wonderful job at the store and with the community and that the store across the street does not have the flavored beer that he likes.
Elvin Rodgers – 9239 W Morgan Av – said that the applicant gave him his first job, that he was a looting guy and that he ended up getting his life around thanks to the applicant. He added that the applicant would be a responsible licensee.
Julia Washington - 2437 W Kilbourn Av – said that the applicant has a ramp and that they should be able to decide where to spend their money.
Individuals also present:
Ald. Bauman said that he has represented the area for 20 years and being a resident for 27 years. He added that the alcohol stores have been a problem at the Concordia neighborhood; that he and the neighborhood associations have been working very hard to get rid of the problems related to alcohol sales. He also said that there is more than enough supply in the neighborhood and that this is a matter of over concentration by definition. He also said that no new alcohol license has been granted in the area on the 20 years that he has been in the office. He asked the committee to deny this license.
Sally Abulawi said that they are looking to supply the demand from their loyal customers.
Ald. Perez said that the food store seem to be an asset in the neighborhood, that more food and fresh products are needed rather than beer and that he agrees that not having beer/alcohol stores define a neighborhood. He added that he does not see the need for another liquor store when there is one right across the street.

The applicant was present along with Atty. Vincent Bobot.
Atty. Bobot said that the police report overwrote that the business has been cooperative with MPD, that there are cameras outside and inside the tavern and that surveillance videos have been provided when incidences are investigated. He added that the item from July 30, 2024 was an educational visit from the Department of Alcohol and Tobacco where bottles of alcohol were confiscated and they had subsequent violations from there. He also said that the rest of the calls are for loud music except for the incident on October 18, 2024. Atty. Bobot also said that he spoke to his client’s defense attorney and that no charges have been filed against his client, that he maintains his innocence and that he is not the one who fired the shots and is not the owner of the recovered cocaine.

Ald. Burgelis asked Atty. Bobot if he has something additional to say about the DOR raid that happened on July 30, 2024.
Atty. Bobot said that he does not know if there are any actions taken against his client from the Department of Alcohol and Tobacco because they were told that it was an educational visit but by looking at the violations cited on the police report, now he knows that they exist. He added that the contaminated bottles refers to bottles with fruit flies and that he has no reason to dispute the violations and neither does his client.
Ald. Zamarripa asked the applicant if he had a permit to have the chickens in the basement.
The applicant said that he did not have a permit and that he buys chickens over the weekend, that he puts them in the basement and that they are gone by Monday.
Atty. Bobot asked the applicant how many chickens were there because it is not mentioned on the police report.
The applicant said that there were 2 chickens.
Ald. Zamarripa asked what he does with the chickens.
The applicant said that he buys the chickens to eat them.
P.O. Tracy – said that during the search warrant done at the applicant’s residence, they found a bowl with cocaine that was easily linked to Mr. Albanil because his vehicle's insurance card was right on the middle of the bowl. He added that the chickens were found in the basement next to where beer and bar stuff is stored. He also said that the chickens were in an enclosed area separated by a small door.
Ald. Spiker asked if MPD contacts the MHD in situations like this.
P.O. Tracy said that they took the chickens to MADACC and that they do referrals to MHD and DNS.
Ald. Spiker asked where exactly the cocaine was found.
P.O. Tracy said that it was in the applicant’s room (same room where the shots were fired from), that it was in a bowl with his car’s insurance card right in the middle. He added that in the same area, they also found small measuring spoons which looked to have small cocaine residue on them and next to small portions divided out in units to be sold.
Ald. Zamarripa said that regarding Atty. Bobot’s statement about his client not being the one who fired the shots into the air; she asked P.O. Tracy if he witnessed and retrieved the video where the applicant fired shots into the air.
P.O. Tracy said that it is correct, that they recovered 3 spent 9mm casings in front of the address and that on the search warrant they found boxes of the same ammunition at the applicant’s house. He added that the video was from a residence across the street. He also explained that the video is too far away to make out facial descriptions but that the applicant admitted that he was alone at the residence at the time when the shots were fired. He also said that his description was compared with the footage of the body camera as well and it was determined that it was the applicant in the video.
Ald. Burgelis asked if they recovered the weapon during the search warrant.
P.O. Tracy said that they did not.
Ald. Spiker asked the applicant if he fired the shots out of the window of his residence.
The applicant said that he did not.
Atty. Bobot said that his defense attorney asked the applicant not to disclose any information until the investigation is closed.
Ald. Burgelis asked the applicant if he owns a 9mm gun.
The applicant said that he does not.
Ald. Burgelis asked the applicant if he uses cocaine.
The applicant said that he uses cocaine sometimes.
There were no neighbors present to testify.
Ald. Zamarripa said that this is a very concerning police report, that she understands the message that Atty. Bobot and the applicant are trying to convey but that they also have the testimony of P.O. Tracy who was on the scene and that she cannot support this application.
Ald. Perez said that there is a history of disciplinary actions that speak for itself and that it is hard to support this application as this business was part of his district in the past and that the applicant knows better than to get himself into the trouble he has gotten into.
Atty. Bobot said that he is aware of the 10 day suspension only, that the committee must follow progressive discipline since there was no disciplinary action for the last two years. He thinks that a revocation does not fall in place. He added that the bar is profitable, that the applicant is probably going to sell it as a result of this but that he cannot guarantee it.
Ald. Perez said that this is a small business (capacity of 54) where no money needs to be spent on security to keep the crowd in order, that Atty. Bobot has mentioned that it is profitable. He added that he told the applicant that he did not want any problem with the police department and with the neighbors and that he has violated both requests including the suspension. He also said that in 2 years, the applicant has had noise complaints, the outdoor patio has been shut down, that there have been accusations in the past about him doing stuff upstairs including afterhours gatherings. He continued saying that with the recent interaction with the police, it makes it very hard to believe that the applicant will change his ways with any progressive discipline.
Atty. Bobot said that we are talking about a 10 day suspension in 2021, that we are in 2024, and that the committee can go to a 90 day suspension since no one was killed/shot.
Ald. Spiker asked the applicant if he has a security guard in regards to why people were pepper sprayed at the bar.
The applicant said that he has a security guard on Thursday, Friday and Saturday and that he pepper sprayed the guy because he was punched in the face after throwing him out of the bar twice and that the security was not there that day because the incident happened on a Monday.

Ann Knoedler – 2460 N 47th St – said that she lives 2 blocks from this location and that they have sufficient corner stores in the area.
Ald. Spiker asked the witness what is her objection to the food license.
The witness said that there is a corner store every 2 blocks and that she would like to see something else.
Bobby McQuay Jr – 2362 N 46rd St – said that there is a lot of traffic in there, that he was the one who organized the street to get a speed hump in there, that there is no parking around the store, and that there is no need for another store. He added that there is loitering happening already around the area.
Ald. Spiker asked if his concern is about the traffic, loitering and garbage in the area.
The witness agreed.
Thaddeus Moore Jr - 4403 W North Av – said that this corner location has been an issue with drugs before and that they want to keep it clean as it is now.
Maurice Nicholson - 2341 N 46th St – said that he has seen a difference in the neighborhood and that parking and traffic in the area is bad at the point that this morning his car was hit because the street is too narrow. He added that he would like to see more businesses coming in and investing in the community as well.
Chris Nielson – 2351 N 48th St - said that he is concerned about the trash and traffic in the neighborhood.
Cathy Blair Koch – 2478 N 47th St – said that her objection is based on concentration and echoes everything what has been said.
Ald. Stamper said that this location is also close from his home and that he supports the residents as well.
Mr. Adams said that he understands what they committee have said and that it is fair to say that he has not being given a fair chance. He added that the store has been there for years with no police report, and all of the sudden there are objections when he is applying to keep it. He added that there are 3-4 daycares and gas stations in front each other and they are operating without any objections.
Ald. Perez said that they have said many times not to spend money before having the permits in hand. He added that he does not know what happened at the previous hearings and why the neighbors did not show up at the last hearing, but that they are here and that they have spoken loud and clear.
