| 1 | 1. | Ordinance | A substitute ordinance relating to the board of zoning appeals.
Minutes note: Chair Osterman commented. The proposed ordinance was required to fulfill the 2024 Proposed Budget in changing the Board of Zoning Appeals (BOZA) from a special purpose account into an independent office under the Department of Administration. The proposed ordinance would be moot due to a Common Council budget amendment to undo the change to keep BOZA a special purpose account as it currently stands. Subsequent mayoral veto and lack of Common Council override of the veto would be required for the proposed ordinance to remain relevant.
Member Richardson said that BOZA's manual of rules and procedures should subsequently be reviewed and updated accordingly to reflect the move of the office if it passes.
Commissioner Roberts said that there were no issues with enforceability from DNS.
Member Richardson moved that the proposed ordinance meets the standards of legality and enforceability, administrative efficiency, and consistency with the format of the zoning code. There was no objection.
Mr. Leichtling said that the City Plan Commission would request Class II notice publishing, barring issues, to schedule the ordinance before the commission's next meeting on December 4, 2023. | | | |
