She also mentioned that the operator has another truck that was recently caught doing the same and that it is very concerning for MHD. Individuals also present: Ald. Perez said that he sees a pattern in here and asked if the violations/citations are being translated for the food operators. He added that beyond this point, we should ramp up a campaign for food operators about the safety concerns for not having running water. Ms. Hegarty said that they use live interpreters on the field and that the City Clerk’s office helped them with the translation of a flyer regarding running water in food trucks that it was mailed out to all food operators. She also mentioned that the booklet of rules and regulations is available in English and Spanish. The applicant said that both instances happened because his employees did not follow directives. Ald. Perez said that this is the second time with another food truck coming up with the same type of violation and that the applicant will receive a suspension if the problem persists. (Expired 1/16/2026) The applicant was present along with her husband Mr. Perrin. Mr. Perrin explained that the first item on the police report, was about an intoxicated patron who was put out and called MPD saying that shots were fired but the call was baseless. For the second item he explained that they had a bunch of guys on Mill Rd. that stopped at the parking lot and, that police showed up because of the noise when they were asked to leave. For the third item he said that it was about another intoxicated customer who did not want to leave and hit the manager and the security guard. Individuals also present: Ald. Taylor said that she has discussed the items on the police report with them. Neighbors in opposition: Catherine Sanders - 4802 W Mill Rd – said that it is very loud when people leave, that last Monday was very crowded and three woman came out, two blocked the one lady who squatted down to use the street as a bathroom. She added that there is a lot of traffic, that people buy food to eat it at their cars and toss the containers on the ground. She also said that people park in front of the fire hydrant also blocking hers and the neighbor’s driveway and that when they asked customers not to park illegally, they are told that it is going to take few minutes and go inside anyways. She said that summer is coming up and it gets worse with those three wheelers with loud music day and night. Ald. Taylor asked the witness if she has any footage. The witness said that she has pictures on her phone about the garbage. Ald. Taylor asked if she has been in contact with the BID and or MPD Community Liaison. The witness answered that she does not know to whom talk to. Ald. Taylor asked her to give her office a call to continue the conversation. Mr. Sanders - 4802 W Mill Rd – said that the problem is that people get food there and go back to their cars and eat it from the containers and throw them away. He added that they also have their music so loud and that there is no consideration about the neighbors. Ald. Taylor asked the applicant for how long they have been there. The applicant answered that this would be its fifth year. Ald. Taylor asked the applicant what they have done to curve the garbage and other complaints that neighbors believe is coming from this business. Mr. Perrin said that they are in constant communication with MPD to do corrections and improvements, that they have the garbage containers that she requested and that they will document it as well. He added that Mill Rd is a busy street and that it is not illegal to park there. He said that they have a security guard that roams from 46th St to 49th St and to curve on regular basis the noise and parking. Ald. Taylor said she appreciates the efforts to curve some of the problems but that trash has been an issue, that she has received a lot of complaints and that asked if it would be possible not to allow carry outs. She added that maybe not to go containers and maybe a security guard at the door to monitor when people leave. Mr. Perrin said that his business is not a sit down restaurant and that this request would kill his business. He added that there are cars that drive up and down throwing stuff on the street and that he cleans all around on a regular basis. He added that it is a big ask from her. Ald. Taylor said that she has seen business that do not allow food to take out and that this is big ask to mitigate the trash problem. Ald. Burgelis said that it is highly unusual to ask a food establishment not to sell food to carry out and that he suggests to use a sticker or stamp to identify his containers. Ald. Zamarripa asked the applicant if she is willing to add that she will mark to go containers and bags to the plan of operations. The applicant agreed. Ald. The police report was read. Mr. Singh said that one item was about a call they made to the mother of a child who was not allowed in the store for stealing before and the police arrested the child. He said that the gambling machines are inside the store but they are not operating. Ald. Zamarripa said that he was advised to remove them. Mr. Singh said that he will do it at the end of the day, tomorrow, anyday. Ald. Zamarripa clarified that there were two infractions last year: one for selling alcohol to a minor and one for selling tobacco products to a minor. The applicant said that the incidents happened with an employee they hired when his wife had medical problems. Ald. Burgelis asked the applicant why he locked the door on the people inside the store (item 8). The applicant said that the people were making a mess and stealing, that he asked them to take everything they wanted and leave without hurting others and that then, he unlocked the door. Ald. Burgelis asked what happened to the employee who sold alcohol to a minor (item 9). The applicant said that he was fired. Ald. Burgelis asked why he had the gambling machines without a license (item 10). The applicant said that he was told that he did not need a license and removed the machines the day after the July incident. Ald. Burgelis said that the machines were still there per the December incident in the police report (item 13). The applicant said that they moved the machines to the back and that they are unplugged. Ald. Burgelis asked why the employees were not cooperative with MPD when a guy is running with a gun inside the store (item 12). The applicant said that they always provide passwords to MPD. Individuals in opposition: Greg St. Arnold – 2654 N Palmer St – said that he wrote a long letter that was added to the file, that he regularly witnesses other safety issues besides the ones in the police report like instances of drug trafficking, use of drugs, loitering and that he does not know if the business is involved with the Crime and Safety meetings. He added that he is surprised that the applicant states that 70% of sales comes from food, when the food items are not marked and that the deli is not in use. He also said that the gambling machines were in use last October and that there is an employee who smokes regularly inside the store. Brian Egger – 2749 N Holton St said that he agrees with the previous testimony and that he has reported drug trafficking, drug use, and guns left in the south part of his alley which is right outside of this business and that it happens all day, every day. He added that there is public drinking and loitering outside the store and the business does nothing about it, that it is bad business and not community oriented. He also said that he has photos of the gambling machines. Ald. Brower said that his district borders this location and that he receives complaints on a regular basis about the illegal activity happening outside this store. Ald. Ald. Burgelis asked the applicant if he read the police report in full. The applicant said that he did and talked to his brother who helps him when he is traveling. Ald. Burgelis said that the police report says that there were 16 shell casings outside the store and that the employees did not cooperate. He asked the applicant if his brother still employed at the store. The applicant said that his nephew works there and his brother helps him when he is out of town. Individuals also present: Ald. Zamarripa said that this is a very egregious police report, that she thinks that he is not around when the store is located in one of the greater areas with many public safety issues and that they need someone who is committed to the neighborhood. She asked the applicant how often he is at this business. The applicant said that he lives in town and that it depends because he has rental properties in Arkansas that he needs to check in. He added that his brother is at the store when he travels. The applicant could not provide a direct answer for Ald. Zamarripa and Ald. Burgelis question about how many days/hours he is at the store. Ald. Zamarripa read for the record that during that incident, the employees initially denied being present and also denied having a firearm in the premises. She asked who those employees are. The applicant said that they were his nephews and that one of them still works for him. Neighbors in opposition: Brisa Van Galen – VIA Economic Development Director– said that VIA has been working improving the quality of life of the neighbors and business owners and that they will be breaking ground for townhomes on Greenfield Av., as part of affordable housing plan. She also said that the organization is fully invested in this neighborhood and that based on the comments heard today, and the conversations with neighbors, they are requesting that this license not to be renewed. She added that an alcohol license is a privilege and that this applicant is not a responsible operator. The applicant said that he is sorry for what happened and that he has done his best to keep the store in good standing for 23 years. He added that he is willing to do his best to correct any issues and that he did not know that his nephews did not cooperate with the police. Ald. She added that they held a meeting with 28 people in opposition and no one in favor. She explained that the extension of hours will affect the quality of life of the residents that have been working hard on cleaning it up. Tonja Hemphill -3141 N Sherman Blvd – said that she has lived there for 39 years and that she opposes to the extended hours because right now there is no people hanging out at late hours because it is not open and that they will feel unsafe. She added that she would like to sleep at night since her taxes are high. Kianti Shields– Sherman Park Neighborhood Improvement District 4 – said that she agrees with Mabel Lamb but also thanked the applicant with making connections with the community as it should be. Belinda Northern – 3143 N Sherman Blvd – said that she opposes too because it will attract the wrong kind of crowd like before and that she does not want to be under a unsafe situation due gun violence. Ald. Brower asked Ms. Shields if adding security during the extended hours will help to change her mind. Ms. Shields said that security will not stop the gun violence and that they will be in danger too. Valencia Beverly – 3118 N 42nd Pl - she has lived at this place for 6 years and that the gas station wasn’t there when she bought this property. She added that her peace was completely disturbed since it opened. She explained that there is always trash on her alley from people who walks eating stuff bought there and it blows into their yards. She also said that the applicant never came to talk to the neighbors prior filing the application. She said that she met him at last week’s meeting. Lois Redic – 3373 N Sherman Bl – said that there are other 3 filling stations in the area and they do not need one more and thanked the applicant for what has done for the community but that he does not need more hours. Neighbors in support: Sedan Smith – 2271 N Sherman Bl - said that the applicant has been a tremendous help in the neighborhood, that he has contributed to clean up the community and that he deserves to have the extended hours. Corey Brown – 3402 N 55th St – said that he recently moved and has been working with the applicant at the store for 2 years, that the applicant has done a lot for the neighborhood and that they cannot expect that a gas station will change everything. Brandon - 4200 W Burleigh – said that the gas station has made a tremendous turn around. Vaun Mayes – 2209 N 47th St – said that he is a long term stakeholder in the area, that there is an opportunity for each other to improve and that businesses doing well should be rewarded. The applicant said that everything what he said is based on facts. He added that is something is going at any hours. He would close the store because he is an upfront man foremost. Ald. Barb Scottie – Near West Side Partners – said that they have been working on activate the lot next door with flat beds and swing sets and that the idea is to make it a safe place for neighbors. She added that she has someone lined up to activate the lot this summer. She also said that she has been a neighbor for 20 years, that it is much better now and that a coffee place would be ideal. Celia Weiberg – 946 N 33rd St – said that she has been a neighbor for 40 years and her experience with previous businesses is that they do not have a plan b and do something else. She also asked the applicant if she plans to have neighbors as customers, that the plans for the garden with swing sets next door is really happening and that she does not know how opening at 6 am would work. Individuals in support: DeAngelo Pernell – owner of multiple properties on 27th St - said that he is also the reason why the neighborhood changed since he purchased all those buildings because he cares about his tenants. He added that he allowed surveillance cameras to be put on and that he does not see why coffee and cocktails would be a problem. He added that he wants to buy the lot that they are talking about. The applicant said that she is very compassionate about everything she does, that she is a quick learner and that she understands and is willing to collaborate with MPD and that the door will be open by a buzzer. She added that the neighbors have a different perception from what she plans to do. Ald. Zamarripa asked the applicant if she amended the hours of operation from 6am to 10pm everyday.
