She added that the applicant has been issued orders to cease operations a few different times for the same reason, as well as for no refrigeration available in the truck and servicing the truck at a different location. She also said that they have discussed everything with the applicant, that she corrects the problem, but then it happens again.

The applicant said that she recognizes that she should have closed after the first order to cease operations was issued and that she was not present when the rest of the incidents happened.
Ald. Zamarripa asked if the business’ partner Miguel is in the truck all the time.
The applicant said that he is not.
Ald. Zamarripa asked how many food trucks they own.
The applicant answered “just one”.
Ald. Zamarripa said that there is no consistency with this operator, that there are other food trucks willing to take the designated spot at Burnham Park and that she is concerned about the health hazards.
The applicant said that she has been there every day lately making sure that those health hazards do not happen again.
Ald. Zamarripa recognized that the applicant was supportive working on the food truck legislation but that she needs to step up on her own business operation.
Ald. Brower moved renewal with a 10 (ten) day suspension based upon the preponderance of the evidence in the Health Department and aldermanic testimony that demonstrates the operation results in a threat to the health, safety or welfare of the public for the failure to comply with the approved plan of operations. The applicant said that it is a bar where people drink, play and sometimes dance.
Individuals in objection:
Nalyani Gomez – 1980 S 13th St - said that there are ongoing disturbances that affects them and even happened last week. She added that the music is played loud until very late hours, that there are empty bottles on her lot, vehicles parked illegally in driveways, that patrons are aggressive, that they urinate and that she has a lot of recordings about what is going on every Friday, Saturday and Sunday. She also said that patrons do not leave and security does nothing about it. She added that she contacted Ald. Perez’s office and MPD.
Ald. Perez asked if Ms. Gomez if she has a log of the calls made to MPD because they are not in the report.
Ms. Gomez said that she does and that as a matter of fact, she called last Friday at 2:30 am and that the police may not show up.
Ald. Perez said that he wants to understand if it is a matter of enforcement or what. He added that if the police cannot show up immediately, they always could go the following day to check the surveillance system and to file the report.
Sgt. Velasquez asked the neighbor to make sure to use the business premises address when calling.
Ald. Perez said that he wants to get to the bottom of why this business was open after 2:30 am last Friday as the neighbor said, and that he would like to hold the application.
The applicant asked why the neighbor has not talked to her about these issues before.
The neighbor said that she has texted the applicant and that she did not respond to her text messages and that it is the applicant’s responsibility to be a good neighbor. She added that the applicant knocked at her door when she needed support for her business and that she should do the same to address the ongoing issues.
Maria Rivera Gomez – 1980 S 13th St - said that she feels very frustrated because even if she tries fall asleep early, the loud music wakes her up anyways. She added that she cleans empty bottles from her lot and that the bar takes forever to move a car illegally parked. She said that it is not her responsibility to clean what the patrons leave neither deal with them.
Ald. Zamarripa said that we have advanced on this matter and asked Ald. Perez if he wishes to continue.
Ald. Perez agreed and asked for the disciplinary actions granted last year.
Ald. Zamarripa said that the notes say that there was a 72 day suspension held in abeyance on 2024.
The applicant said that the problem is a food truck and that people stay late for that reason.
Ald. Perez asked the applicant if it is a food truck or stall and if she has called the police.
The applicant said that it is a stall, that she does not know the name of the business and that she has not called the police.

In regards to Ald. Chambers question regarding the firearm that was discharged, Mr. Abohadba said that the employee put the fired gun behind the rack and when the police came, they turned in the fired gun and his own gun.

He added that there is people loitering and smoking, that the applicant takes care of the front but not of the back. He also said that things were better with the previous owner. He mentioned that these buildings go away with many issues that other commercial properties do not like marked parking spots for example. He said that properties are not treated equally.

Ald. Bauman said that this is a 60 units development along 4 properties since the 1930’s room and board alike situation for low income residents with physical, mental and emotional disabilities. He added that the lots are deep and that he agrees that there is a problem with the conditions. He also said that it is a DNS problem, that he does not know why there is not a proper follow up from that office. He mentioned that there is no remedy because even if we do not renew the licenses, we have to go to a different court to file evictions because not renewing the license will do it.
He mentioned that the system is broken here and that he can see that the property is in a stable state of repair as he drives everyday by.
Mr. Dieter said that no neighborhood can survive with tens of rooming houses as this one has and added that he came with a recommendation to clean the back of the properties, to monitor the parking lots and to take care of the trees.
Ald. Zamarripa said that the neighbor’s request is reasonable.
The applicant said that there is a person in charge foe cleaning clean up the neighborhood and that the neighborhood association can testify on that. He added that they have dumpsters for garbage and bigger items, that they are watched very close by DNS. He also said that Mr. Dieter feeds street cats on paper plates twice/day and that they even pick up those plates. He also mentioned that they will look into the parking lot as they get the funds to do it. He said that he could reproduce invoices for tree servicing as well.

Mr. Amarjeet said that he is the manager and regarding the first item (12/01/24) on the police report said that he heard from the security guard that someone was shot but that they do not know who did it or how happened and that they assisted the person by calling 911. As for the second item where the security guard shot at somebody, said that no one was shot at, that the situation was about a panhandler coming almost every week, that the guard was handling him right until one day that an old lady asked for help because she was approached by the panhandler at the pump and got scared. He continued explaining that it happened again with another old customer. He added that the guard asked him not to approach people no more, that they argued and when the guard walked away, the panhandler jumped into the guard’s back and the guard pulled out his gun and shot into the air to scare the panhandler away. He also explained that he let the guard go and explained him that he was not supposed to do that.
Sgt. Velasquez said that no one was shot at, that it was a warning shot, that the employee was arrested and waiting to appear before the judge.
Mr. Amarjeet said that since that incident happened, they have a new security guard and that he was told not to shot at the air again.
