The applicant said that the building has been empty for 4 years and they want to open a small restaurant bar with different snacks.
Ald. Perez said that he is not support of this application due the proximity with the daycare. He added that there is no police report but MPD talked to the applicant when the CPTED was conducted regarding the parties held there (a Quinceanera and New Year’s Eve) which have been a direct violation of the use of the building without the proper permits.
The applicant said that the Quinceanera event was not held there and that the New Year’s Eve event was a family event.
Ald. Perez asked the applicant if she promotes events with bands, live music.
The applicant said that she receives requests for promoting events for people from Oaxaca at the Buddhist Temple and that she only shares the publication on Facebook.
Individuals in objection:
Travis Hope – (Safe & Sound and Muskego Way) said that he lives there, that he is a community organizer and talked to the church. He added that the church confirmed that allows this business to use the parking lot and did not know that the applicant was hosting parties at night. He added that there are cars at night and that neighbors are concerned about the activity in the area.
Ald. Perez asked the committee to deny this license based on the violation of the 300 feet rule and the violations on file for not having the proper licenses.
Ald. Burgelis said that he is looking the applicant’s Facebook page and asked her if she provided food and/or alcohol for the January 9th event.
The applicant said that she only shared the publication and that she sold food in front of the location like at any other street.
Ald. Burgelis said that the post says that tickets are sold at her establishments.
The applicant said that they were asked to sell tickets.
Ald. Zamarripa asked the applicant why she did not request the proper permits.
The applicant said that she did not think about it because it was a family event.
Ald. Perez said that he spoke to the applicant prior she moved forward with the building, and let her know very clearly that he was not in support due neighborhood objection. He added that immediately after, the applicant held events there and the neighbors complained.
Ald. Burgelis said that he can see that the applicant could be a good operator but that she has an issue with following rules and procedures.
Ald. Perez said that the applicant wanted all or nothing and that the hours filed are not for a restaurant. He recommended the applicant to file another application for food and talk to the church and neighbors.
Ald. Zamarripa said that she tried to be empathetic with the applicant but that she keeps contradicting herself and that she should know better because she is a successful business owner.

Connie Bolle - 3140 S Illinois – said that it is a short street with 19 homes and 4 multifamily homes. She added that a 30 ft loading zone is a lot for that street, that the applicant has a fully accessible garage on the back, that they use the loading zone to delivery their own groceries and never medical supplies. She added that the applicant drives himself and parks his car in the garage every night.
Ursala Neuwirth - 3137 S Illinois – said that the applicant has called parking enforcement on numerous times on many neighbors including herself when her bumper reached 4 inches of the loading zone when she was 8 month pregnant and unable to shovel herself. She added that they have lived next door for 8 years, that the applicant has their phone numbers and know their cars and that the applicant decided to call parking enforcement instead.
Mr. Neuwirth - 3137 S Illinois – said that it is an issue for them with loading/unloading his own children and the lack of parking when the applicant has a full slab and an accessible two car garage.
Ald. Zamarripa asked the witness if he would agree to have a time set for the use of the loading zone.
The witness said that it would be a good start but that the loading zone is not needed.
Roxanne Ciatti – 3146 S Illinois – said that the street is one way street with only one side for parking, two driveways and the loading zone. She added that she assumed that the LZ was issued for medical reasons but that it has been weaponized. She also said that her husband receives health care services and those providers have received citations as well. She explained that the applicant call parking enforcement as soon as someone parks there.

Cheryl Luedke - 3135 S Illinois – said that she does not have a problem and that neighbors use the loading zone all the time.

Justin Hampton said that it has been great working along with neighbors, that he has done his best to rectify any issues and that there is an opportunity to do things better. He added that it seems that litter is being drop overnight according to photos sent by another neighbor before open hours.
Atty. Wroblewski said that there have been great improvements with the store but they still waiting for the property owner to move forward with the landscaping plan.
Ald. Dimitrijevic said that there is a great improvement, that closing the store got the corporation’s attention and requested a warning letter for the landscaping portion of it. She added that she would like to have a written landscaping plan with a timeline before the Common Council meeting.

Atty. Randall said that he will give a three parts presentation regarding the items in the police report and noted that the staff was always cooperative or the surveillance footage was provided to MPD.
1st category – fake ids – said that he knows a number of establishments having the same problems with underage patrons at their establishments, that fake ids have gotten that good, that they have surpassed the technology. He added that they have the 2026 updates for the scanners, that they use two-factor authentication: the scanners and black light for holograms. He also explained that staff use the typical state id book for those out of state. He said that they confiscate those ids and names are flagged in the system, that they do periodical reviews, trainings and best practices. He also said that all those allegations for underage drinking have been dismissed at court thanks to litigation.
2nd category – fights – said that they had some early of 2025 and that MOJO met with MPD District 1 and started some operational changes like an internal incident log, revised the dress code, started to collect a cover charge at the door after midnight and do a rolling close out when patrons leave. He added that MOJO has attended the Water St Businesses meeting because they want to be part of the solution. He also said that those changes were implemented in June, that there is nothing in the police report after because the changes are clearly effective along with having staff members employed for years and hiring a female security guard has been a valuable addition.
3rd category - locked front door – said that staff was instructed not to do it again and explained that a bar fight broke inside and the security guard locked the door to assist with the fight. He added that they learned from that incident.
Atty. Randall said that the hookah service was requested by the customers and that it is limited to three tables at the patio.

She added that the applicant has attended only 2 or 3 meetings in a 12 month period.
Gail Crockett – 1826 N 26th St – said that she lives the next street over from the gas station and that there was turmoil with everything what was happening last year, that the applicant does not respect the community at all because he did not fulfill his obligations. She added that she cannot get over the idea of this business selling tobacco to minors and that there is no security at the store.
Ald. Burgelis asked this witness how this applicant did not honor the neighborhood agreement.
Ms. Crockett said by not addressing the loitering and not attending the meetings among other things.
Haynie Smith – The Alliance Mke said that cleaning and maintenance is done only when they are recorded. He also said that he does not know why there are cars parked at the gas station after closing time and that the applicant has not attended any of the meetings of Midtown Neighborhood. He added that 14 calls on the police report violates the neighborhood agreement.
Ald. Stamper said that he does not support the extended hours license application and that the items on the police report are not minor issues. He added that the applicant is not at the store and still receiving complaints even after the Extended Hours license was not renewed.
