Meeting recessed at 11:10 a.m. Meeting reconvened at 11:18 a.m. Individuals appearing in opposition: Jarely Ruiz, Assistant City Attorney, on behalf of the Milwaukee Police Department (MPD) Captain Chad Wagner, Milwaukee Police Department Central Investigations Division Officer Jeffrey Thiele, Milwaukee Police Department District 2 Officer Christopher Geere, Milwaukee Police Department District 2 Atty. Ruiz testified that as part of a city wide task force, MPD conducted a site inspection and gave warnings of minor violations at Mill Valley Recycling on November 15, 2011. On December 12, 2011, Captain Wagner sent out an informational letter about the task force and its initiative to all scrap yard businesses. On December 8, 2011, an undercover officer was able to sell and receive money for scrap metal that he brought in by using another person's ID at Mill Valley Recycling. On December 21, 2011, the same undercover officer was able to sell a water meter with an obliterated serial number to Mill Valley Recycling with another person's ID. Both transactions were not recorded in NEWPRS. Captain Wagner testified that theft of precious metals on homes and automobiles is rapidly growing. As a result a team of detectives, officers, and Department of Neighborhood Services personnel went to recycling centers to educate and give copies of the ordinance to them. A certified letter was mailed to the salvage owners on December 5, 2012. Owners of Mill Valley Recycling received and signed the letters on December 10, 2011. He said that he was not present at the December 8 and 21 undercover operations. Officer Thiele testified that he was on duty and present at Mill Valley Recycling on November 15, 2011. He added that although present at the December 8 and 21 undercover operations, he did not personally see firsthand the sale and receipt of payouts between the undercover cop and Mill Valley Recycling personnel. Officer Geere testified as being the undercover officer who sold metal and received payouts without his own personal ID on December 8 and 21, 2011 at Mill Valley Recycling. He added he was able to have a video device record the undercover operations. Atty. Ruiz showed a partial video footage of the undercover operation at Mill Valley Recycling on Dec. 8, 2011. Tony Teich, Mill Valley Recycling, LLC, 1006 S. Barclay St., Milwaukee, WI 53204, appeared to testify that a seller would drop off his or her materials at the dock and goes to a separate office to show an ID to get his or her payout. Ald. Witkowiak appeared in opposition based upon the police report, video footage, and MPD testimony. Atty. Maistelman showed video footage of December 21, 2011 MPD undercover operation at Mill Valley Recycling. Ald. Kovac moved approval of with a warning letter based upon item #4 in the police report relating to December 8, 2011 and hold all other items on the police report not related to December 8, 2012 open.
