Zamarripa mentioned that the letter in support from the Brady St. Association is on file. Ald. Burgelis asked if it is possible for her to get started with the food license only. The applicant said that she would like to have the business plan altogether but that she would take the food in the meantime. Ald. Burgelis said that this establishment is open at the moment and that he does not see an issue with the committee taking action on the food license application. She added that they received a citation for a second offense. Sgt. Velasquez said that the citation’s arrangement is for March 20, 2025. Ald. Zamarripa said that it is important to highlight that food trucks must have running water during the cold months and that they must invest to make it happen. Ald. Perez asked Ms. Hegarty what is the recommendation from MHD. Ms. Hegarty said that a warning letter file would be fine. There were no neighbors present to testify. Ald. Spiker asked the applicant if the situation has been corrected. The applicant said that the trucks have been repaired. Ald. Spiker asked if MHD is able to confirm what the applicant said. Ms. Hegarty said that it is on file. Ald. Zamarripa asked the applicant why she did not call the police when she was the victim of a robbery. The applicant said that there were three food trucks that were robbed and that other operation made the call. Ald. Zamarripa said that she has to call no matter of what. The applicant said that she has told her staff to call her or to call the police directly in case of an emergency. Ald. Perez said that he recommends renewal with a warning letter. Ald. Individuals also present: Ald. Zamarripa asked why the applicant was operating without a license according to the police report. The applicant said that he was not aware that he needed a license after the DNS inspector told him that he was good to go with the occupancy permit. He added that he came right away to file the application after the police conducted the follow up. Ald. Perez said that the applicant is here because he is buying/selling/loading/uploading and that the occupancy permit is not for that. Individuals in objections: Lauren Cardenas – said that they reside at the house across and that the applicants’ transactions are done outside the one car garage of his premises. She added that the applicant also uses the lot next door, the sidewalk, that there are two trailers parked outside at all times, that there are noises all the time. She pointed out that a fire broke at this garage, that she called the Fire Department and that the applicant did not answered the door to the FD. Ald. Perez asked Ms. Cardenas if she has seen any activity prior yesterday. Ms. Cardenas said that she has seen activity loading/uploading. Ald. Perez said for the record that the applicant told him that he has been closed since the last hearing. Ald. Burgelis asked if she has seen the applicant salvaging vehicles. Ms. Cardenas said that the applicant owns a red truck and that she sees him bringing customers in as well. Ald. Perez said that the house itself has no occupancy and that this operation is conducted from the attached garage that DNS approved for occupancy. The applicant said that he is not operating there, that what happens is that his customers stop by and that he asks them to go to his other vendors. Ald. Perez said that the problem is that he got an occupancy permit and that the activity is causing problems in the neighborhood. Ald. Burgelis said that he does not believe that argument because the application was filed in June, that it is March, and that his clients would have known by now that he is not operating from there. Ald. Perez said that the neighbor’s testimony is vital and recommends denial of this license. The applicant said that he would do anything that he is asked for in order to do things right. Ald. Burgelis moved denial based upon the preponderance of the applicant, aldermanic and neighborhood testimony. There were no objections. (Prevailed 4-1)

Ms. Lopez read the police report regarding the incidences that Ms. Williams mentioned. Ms. Williams said that Ald. Dimitrijevic has no problems with the food license but that she is not in support of the change of hours due the proximity with the neighbors. Ald. Dimitrijevic said that the change of hours is not needed in the neighborhood and asked that the application be amended with the current hours. (Expired 10/15/2024) The applicant was present and said that the first incident on the police report was about an ex-employee who appeared intoxicated claiming that he was owed some money and that the second item was an honest mistake; that he forgot to pull his gun out if his bag while traveling. He added that he has a concealed carry permit. Individuals in objection: Andrea Rodriguez – said that she had a bad experience at this location where she was denied service after she paid and waited patiently for her order. She added that they were treated unfair and were told to never come back. Ald. Spiker asked the witness if she has the name of the manager that she talked to. Ms. Rodriguez said that she did not want to wait, that it was not worth it because she was with her daughter. Ald. Dimitrijevic said that this business is before the committee because Ms. Rodriguez’s objection and that MHD checked the business as well. Ald. Spiker asked the applicant if he was the one who interacted with the witness. The applicant said that it was his general manager and the he still works there. Ald. Westmoreland asked to see the videos that were noticed. Ald. Westmoreland asked what was the outcome of the MHD’s visit. Ald. Dimitrijevic said that the result was that the raw meet was handled properly. The applicant said that the he has 18 years in the business and that he has been at this location for 18 months and that he trains his staff to be respectful to all customers. He added that this is not a race issue, that he is dark skin as well, that he employees a diverse staff and that it is not fair that his business and reputation be damaged by the witness like she did on Facebook. (Expires 3/22/2025) Atty. Wroblewski appeared on behalf of the applicant and indicated that Justin Hampton (District Manager) is here as well. Atty. Wroblewski said that it is unfortunate to have one item on the police report when the goal is to not have anything. Neighbors in objection: Colin Gazinski 3555 S Howell Av – said that he is a resident, taxpayer and business owner in Milwaukee and that this store has been neglected with ongoing building violations and safety hazards for customers and neighbors. He added that it is unacceptable the way this business continues operating and that the corporation does not care about the community. He said that he is tired of seeing all the garbage from his window, that he has had the manager’s phone number on speed dial for the same reason. Mr. Gazinski said that he would like to see the store and the building owner working together on issues that affect the community and the property values. Ald. Westmoreland asked the witness what is the response that he gets when he complains about the garbage. Mr. Gazinski said that employees say that they are not being paid enough to do that and that he understands the employees but that the store/corporation makes millions. Ald. Burgelis asked the witness how long it took the store to remove the graffiti that he mentioned. The witness said that it took 6 weeks despite the calls he made to DNS and the alderwoman’s office. Atty. Wroblewski asked the witness if he is willing to have direct communication with Mr. Hampton. The witness said that he would love to because it is needed. Linda Villa 3560 S Howell Av – said that she has been a resident for 30 years – she mentioned all the dates (over the last three years) when she sent emails to Ald. Dimitrijevic’s office regarding the garbage and poor maintenance. She added that she lives across the street as well and that she does not patronize the store due to the issues that she experiences as a neighbor. She mentioned that the photo on the website looks beautiful with trees at the front and is clearly a different location and that she would like to see it for real. Ald. Dimitrijevic said that this license has been issued with warning letters and that the corporation has failed to comply with the plan of operations presented to committee year after year. She added that she struggles with the managers because they keep on changing at the point that she does not have a contact any more. She added that this store is improperly staffed, that she has asked for the manager’s checklist in order to see how the store addresses the neighborhood complaints and that she has gotten nothing. Atty. Wroblewski said that there was a conversation yesterday with Ald. Dimitrijevic's office and that there is a four point agreement that has been added to file. He added that the company is willing to work with the neighbors and alderwoman. Ald. Dimitrijevic said that the store has a management problem and that the attorney has no idea of how many hours her office uses to “manage” a business that she is not responsible for and that none of the plans presented in the previous years have worked. Mr. Hampton said that he is the new district manager, that he is at the location once/wk and that he really wants to get things in order after apologizing for the previous situations. Ald. Burgelis asked if there is a plan for beautification to match the store featured on the website. Mr. Hampton said that the conversation has started for this and other stores in the area. Ald. Westmoreland said that we have spent a lot of time listening to the same promises over and over and that he is tired of it. Ald. Spiker moved renewal with a 15 day suspension based upon the preponderance of the neighborhood, aldermanic and applicant testimony that demonstrates the operation results in a threat to the health, safety or welfare of the public for failure to comply with the approved plan of operations. Mr. Ray says that they cooperate with the police every time that they come and that the decibels have been checked over the years. Ald. Burgelis asked the applicant if the calls comes from the same neighbor. The applicant said that it is one neighbor who openly dislikes him. Sgt. Velasquez confirmed that the calls come from the same neighbor and she has been offered mediation and that she does not want it. Individuals in objection: Roshunda Cleveland – said that there are people sitting in the cars loitering and that when the police comes after she calls the nonemergency number, the establishment turns the volume down. She added that she has been dealing with the issues from this business for 10 years with people urinating outside, doing fireworks jeopardizing other’s properties, with loud patrons, trash everywhere, people having sex outside and that this business disrespects the neighborhood with closing at 4am in a residential area. Ald. Burgelis asked the witness how she knows that the people in the cars outside are patrons. The witness said that she sees them coming in or out from the business. Ald. Burgelis asked if the videos submitted are from the front of the bar. The witness said that the videos are from her surveillance camera that faces the back of the establishment. Mr. Ray asked the witness if he has reached out to her to share his contact information. Ms. Cleveland said that he did. Mr. Ray asked the witness if she has called him when there is an issue. Ms. Cleveland did not provide a straight answer. Ald. Pratt asked if Mr. Ray if he has security guards. Mr. Ray said that he has security guards since he opens and that he checks ids for everyone. Ald. Pratt said that after having a conversation with Ms. Cleveland, she and her husband went to check the location during business hours and found no issues. Ald. Pratt asked Mr. Ray if he has been in communication with the neighbors. Mr. Ray said that he is. Ald. Zamarripa said that she had a chance to review some of the many videos submitted by the witness and that she did not see anything wrong. Ald. Pratt said that she reviews the videos as she receives them and that she has not seen anything wrong. Ald. Pratt asked Mr. Ray if he has information available about sex trafficking. She mentioned that she has a shop in Bay View, that she is involved with the community and working against the bad connotations for tattoos. Individuals also present: Ald. Burgelis asked the applicant if she is a tattoo artist. The applicant said that she is not but that she got a body-piercing license at the end of last year. Ald. Zamarripa asked the applicant what is the connection with the previous owner. The applicant said that Mr. Flores is currently employed at her Bay View location and that she took the body piercing apprenticeship with him. Ald. Spiker asked Atty. Gresham what would be the outcome if the previous licensee wins the pending court case. Atty. Gresham said that this license would be revoked if approved by the committee. He added that there will be a conflict after the court makes the determination. Ald. Spiker said that the applicant’s experience dates from last October and that there were management issues at this location and that she hired Mr. Flores knowing that situation. The applicant said that she looked at the case online and that she did not find any further details, that she is at her business everyday and manages the finances as well. She added that the reason why she hired Mr. Flores and some of his employees is due their combined experience and that she thinks that she has educated herself enough to make the business work. Ald. Spiker asked what is the reason behind keeping the same DBA. The applicant said that it is to save money with keeping the current sign. Ald. Spiker asked the applicant if she is going to have access to the upper level where the search warrant happened. The applicant said that she won’t have access to the upper level, that she has a perfect visual control of the shop and that she could see if anything else is stored inside the shop. Ald. Zamarripa said that she is concerned about the fact that the applicant employs the previous owner and is keeping the same DBA just to keep the sign. The applicant said that there are no formal charges made yet, that it is her understating that Mr. Flores did not file the renewal on time and that she values his experience. Ms. Lopez confirmed that the license was not renewed. Ald. Pratt asked the applicant if she has a no weapons policy. The applicant said that she does not have one. The applicant said that she understands that she does not have an extensive experience but that her business has gotten very good google reviews and thinks that this would be good opportunity for her. Ald. Spiker said that having two licenses at the same location would be a potential lawsuit and moved to hold the application to the call of the chair. Ald. (Expired 1/31/2025) The applicant appeared in person and Atty. Maistelman appeared virtually. Atty. Maistelman said that most of the calls on the police report were generated by the store, which shows that his client is cooperative. He added that the police report is extensive but that there was a neighborhood meeting last night with Ald. Stamper where an agreement was made and that his client signed it. Individuals also present: Ald. Stamper thanked the residents who attended the lengthy meeting and said that the building owner, the applicant and MPD were present as well. He explained that the agreement is based only on the community needs and that it is a sort of a probationary period for the operator. He also thanked the applicant for understanding the struggle that the community has been through, he read the agreement and asked to make it part of the record. Ald. Burgelis moved to withdraw the Extended Hours Establishment license application based on the Good Neighbor Agreement between the operator, Washington Park & Midtown Alliance Neighborhoods and Ald. Stamper. There were no objections. Ms. Lopez stated that the new hours of operation for the gas station are 5am to 12am. The applicant acknowledged the new hours of operation. Individuals in objection: Megan Shepard Smith 1935 N 25th St – said that she wants to reiterate that this is the last chance for this business to get it right and that the possibility of getting support from neighbors on getting back the extended hours license could happen only after many years of a clean record. Adrian Spencer – 2014 W McKinley Av – said that the intention is to hold this applicant accountable for what they have done to the community, that the applicant heard emotional testimonies last night and that it was clear that there is no negotiation with the extended hours application. She added that they want to bring businesses back in the area and that they need to get this plan right in order to bring more investments. Mr. Smith 1935 N 25th St – said that the police report has more crimes than Mequon, WI and that the applicant signed the agreement at 11:59 pm after the neighbors almost walked out. He added that he would like to have this business closed down after looking at the police report but that he is willing to give the applicant a chance but he still thinks that the applicant does not care about the harm caused to the community. He also asked the applicant to call 911 at all times. Ald. Stamper said that this business will continue operating only if the neighbors are on board and that is why there is a signed agreement. He recommended approval with a warning letter. Ald. Burgelis moved approval with a warning letter of the Filling Station, Food Dealer and Weights & Measures licenses as amended. (Expires 3/18/2025) The applicant was present along with Atty. Halbrooks, Mr. Walia (shareholder) and Ms Bennett (Security Guard Wisconsin Public Safety). Atty. Halbrooks said that three incidents from the police report involve people coming back to the store and that is noted that they were cooperative and that they handled the situations the best they could. He added that two items involved security guards. He added that the actual PA33 for item 2 indicates that the security guard was not the person who pointed out the gun to the patron. He explained that what happened was that the customer realized that he had a gun on him, went to put it back in his car and returned to the store to buy cigarettes and that when he went back to his car, he was pointed with the gun but that it was not his client’s security guard. As for item 4, Atty. Halbrooks said that there was a suspicious person on the parking lot, that the security guard went to check on him, that they exchanged words and started the altercation. He said that this security guard is the same cited on the other item and that he is no longer employed. Atty. Halbrooks said that this business takes +500 customers daily, that he is aware of the objection on file with photographs and that he will be providing photographs taken this morning as well. He added that the objection was added after the previous hearing and that he does not think that the items on the police report and the objection are sufficient to take away their property rights for the extended hours license. The pictures were passed on. Individuals in objection: Gary Krasniansky – (Facilities Manager - Prairie Apartments 1218 W Highland Av) - said that there is an unusual activity at the gas station with people gathering at the gas station and that they have problems with people trying to get into the apartment building. He added that all the appliances from a Home Depot truck were stolen while doing a delivery there (parked in front of the building) and that no one from the gas station, neither the security saw anything neither were helpful with the investigation. Ald, Bauman asked Mr. Krasniansky if he has observed this loitering behavior himself. Mr. Krasniansky said that he has in many occasions since 2019. Ald. Bauman asked him about how many times he has seen that behavior in the last year. Mr. Krasniansky said that more than 5 times. He added that they have vendors refusing to service this building because of the gathering at the gas station. Atty. Halbrooks asked Mr. Krasniansky to give a definition of “we”and loitering. Mr. Krasniansky said that when he says “we” he is talking about the management team at the apartment building next door, that with loitering he means people gathering at the gas station parking lot surface, that there is an unusual pedestrian traffic from the gas station to the apartment’s building front door and vice versa. Individuals in support: Kenisse Minifield – Case Manager at the GUEST House and works at 1218 W Highland Av – said that he has no objection with the gas station and that he had a meeting with the applicant and other people to come up with a plan to communicate better. Individuals in objection: Amy Turim – 233 N 74th St - said that her comments do not represent any organization but that there is an objection on file from her when she was working for the City on mitigation strategies for the failure of Hartland Housing (previous use of the next door building) and the Guest House to support residents in the building. She added that she was aware of the Home Depot truck incident and other incidents that took investors away from taking over the apartment building because of the difficulties with the gas station. She added that things got at the point that bullets from the gas station came thru one window of the apartment building. She also explained that she talked twice to the Guest Executive Director over the last two days asking him to be present at this hearing, that he was here but that he had to leave due a family situation. She added hat he is texting her right now saying that he is concerned about the safety of his staff at this building and that he is concerned about Mr. Minifield’s testimony. Ald. Bauman asked Ms. Turim if she is testifying that Mr. Minifield’s testimony does not represent the position of the Guest House. Ms. Turim said that it is correct. Ms. Turim clarified that she is testifying about the chaos at the gas station which took investors away from the project that she was working on at 1218 W Highland Av. Susan Kissinger – (1218 W Highland Blvd/Property Owner) said that she also managed the building while it was on receivership. She said that they have had nothing but trouble from the gas station with loitering, garbage, and suspicious people coming in/out not buying anything. She added that the gas station is not working with them and the community, that they do not provide footage for investigations, etc. She added that employees have told her that they are offered marijuana from employees that work at the gas station. She also said that the applicant turns a blind eye with any request that they make to him. Savannah Brooks (801 N 27th St – Safety Outreach Manager Near Westside Partners) – said that they have worked with Mr. Walia before but that the relationship is struggling right now because Mr. Walia is not cooperating with any of the invitations (by phone, text and email) that she has made to him about the work needed on the exterior, interior and other issues. She added that they get to hear from Mr. Walia a week or two prior the hearings, that he has shared some photos about the exterior of the building but that it is only one part of the problem. She added that the loitering is an ongoing issue that herself and her staff have observed at any given time She explained that the mobile drug dealing is something that she and her ambassadors have witnessed and that they oppose to this license until Mr. Walia works with the community. Ald. Bauman asked Ms. Brooks if she has seen the illegal drugs transactions. Ms. Brooks said that she has. Atty. Halbrooks asked Ms. Brooks how she has observed the illegal drug activity. Ms. Brooks said that she comes at the location in a vehicle with two or three co-workers, that they park the vehicle and before they make it to the front door, they are greeted with people offering them drugs. Ald. Bauman said that this has been a problem since the gas station was built, with the original owner(Mr. Walia) and this new agent and there is no progress. He added that the testimony is basis for nonrenewal but that we have direct eyewitness testimony about the illegal drug activity and that with items 3 and 5 on the police report taking place during the extended hours license, are enough reasons not to renew the extended hours license. Mr. Walia said that he never seen the people who testified here today, that he met with different people that work next door and with Mr. Minifield and that he was told that there were no issues with his business. He added that he is very surprised with the drug activity. He also said that he has asked Ms. Brooks to send the invites to him and his manager because the manager is there all the time. He added that his property is not part of the Near Westside Partners Association but that he takes its feedback because he likes to do better. He asked for some time to work with Ald. Bauman and the community. Ald. Zamarripa noted that the applicant/agent is Mr. Singh and asked him if he has something to say. Mr. Walia said that Mr. Singh’s English is not good. Ald. Burgelis asked Mr. Walia if he would give MPD remote access to the surveillance system. The applicant said that he would and that he would upgrade the system if necessary. Ald. Burgelis asked how many daily clean-ups are conducted around the premises. Mr. Walia said that after the meeting with the Near Westside Partners on February 27, he is doing better with the clean ups, that are done twice/day and that he is willing to amend the application. Ald. Burgelis asked the security guard if she is a law enforcement police officer. Ms. Bennett said that she is not. Ald. Burgelis asked why she has police badge on the front and side of the jacket. Miguel Diaz – Owner of the Police Wisconsin Public Safety LLC – said that it is just a logo but that if he is asked to change it, he will change it. Mr. Singh (agent’s son) said that they try to clean up twice (am and pm) and that they have seen people throwing bags from their vehicles and that people talk back when they are asked to throw the garbage inside the cans. He added that they try their best with moving people away but that sometimes people take their time to leave or told that they will call police on them. Ald. Zamarripa said that she understands the frustration but that is why they have security guards and that the loitering issue must be addressed no matter what. She added that they must call the police even if they do not show up immediately. She added that they have attorneys available to file restriction orders for those who loiter constantly over there. Atty. Halbrooks said that the given the amount of people who patronizes this business, two incidents are not enough to take Ald. Bauman’s recommendations into consideration and that the police report shows cooperation from his client and that the photos taken this morning support his client’s commitment. Ald. Zamarripa passed the gable in order to make a motion. Ald. Burgelis moved to amend the application to conduct clean-ups twice/day and to grant fusion access to MPD. There were no objections. Ald. Zamarripa moved nonrenewal of the Extended Hours Establishments license upon the preponderance of the evidence on the police report, neighborhood, aldermanic and applicant testimony that demonstrates the operation results in a threat to health, safety, or welfare of the public for the excessive loitering and illegal drug activity.
