Mr. Williams testified that a Department of Transportation investor told him that the applicant did not have a state dealer license.
Mr. Vandre testified that the applicant was illegally storing cars at the site and that the applicant's occupancy permit allows for auto sales only. He added that DNS issued a revocation order on March 13, 2012 and that the applicant missed their appeal on the revocation order. He said that the occupancy permit issued to the applicant was conditional based on the applicant getting the proper licenses and that the applicant does not hold valid state and city dealer licenses.

Ald. Bauman said that there has been a consistent pattern of problems at the gas station as indicated by the police response reports in the record. He added that the committee recommended nonrenewal of previous licenses and that the license was suspended at least three times in the past. One was a 2006 suspension by the Common Council, which was reduced from a nonrenewal recommendation by the committee.

Officer Lesniewski testified on behalf of the captain in opposition based upon the amount of police resources used for the gas station for all hours of the day, including the hours between midnight and 5 a.m.
Officer Gryzkewicz testified that she does the late shift between the hours of 7 p.m. to 3 a.m. For surveillance shifts and other occasions of the last calendar year, she said that she personally witnessed between the hours of midnight and 3 a.m. loitering, panhandling, and public drinking of alcohol. She said that she observed and issued a citation for public drinking of alcohol on December 6, 2011 at 1:35 a.m. She added that she did observe security or management from the gas station attempt to remove loiterers a few times but not enough. She said that many people walk, congregate, and drink alcohol publicly in the area in general as well during these hours; however, the gas station is the only business remaining open after midnight. During the period of when the license was suspended for twenty days last year, she said that she did not observe any of these issues.
Officer Schultz testified to personally witnessing loitering, panhandling, disorderly behavior, and urination during one surveillance operation that he took part of within the last calendar year between midnight and 5 a.m. He added that loitering took place in the general area as well.
Officer Hopgood testified that he does the late shift between the hours of 9 p.m. and 5 a.m. and has seen the same issues as the other officers who had testified before him. During midnight to 5 a.m., he said that he personally witnessed urination and public drinking of alcohol. During the last three months, he added that he has witnessed known prostitutes frequenting the gas station parking lot and in the general neighborhood area.
Ms. Byrd testified as to personally witnessing the presence of many people at the gas station between 10 p.m. and 3 a.m. during a night that she and her church did evangelizing at the bus stop next to the gas station parking lot.
Ald. Bauman testified that he was opposed based upon consistent crime and disorder at the gas station, PA-33s, the police report, police observations and testimony, and Ms. Byrd's testimony.
Ms. Kaur testified that during her one year and four months tenure as the licensee, the station has no loitering signs in the front and eight security cameras. She said that the station does not sell any alcohol. She added that loiterers return to the station during the extended hours despite her attempts to remove them from the premises.
