Pastor Martin Childs – 3456 N 38th St – said that they owned the building and that they were told that the purpose was to resale clothes for woman in transition and that the board approved the building sale for a lower price because of the purpose. He added that they were surprised with the notice of this application and that the majority of neighbors showed opposition at the neighborhood meeting.
Robert Tally (building owner) indicated his appearance.
Mr. Tally asked Mr. Childs how long ago he purchased the building.
Mr. Childs said that on 2021 and that the church supported the original purpose, not this application.
Individuals in objection:
Maurice Wince – BID 54 Director – said that health and equity comes first and that they are already saturated with alcohol, tobacco products, greasy foods and that this application does not improve the district and that the applicant did not reach out to the BID.
Teresa Scott – 4535 W Leon Tr – said that the business idea is not for the neighborhood as they are saturated with alcohol and does not fit the location as it is a residential area.
Mabel Lamb – Executive Director - Sherman Park Community Association – said that she also lives in the neighborhood, that they attended the community meeting, that the business is across the street from a church and behind a residential area which will affect the quality of life of the residents. She added that nightclubs do not contribute to residential neighborhoods and that residents are not interested. She also mentioned that people testifying in support do not live in the community and that they will not be affected.
Ald. Chambers mentioned that the applicant lives in the area.
Cremear Mims – said that they have dealt with a good number of incidences from other establishments on Fond Du Lac Av from fights, traffic, parking and even shootings.
Claudia – 3356 N 36th St – said that she is a neighbor and also member of the board that sold the building at discounted price because of the original purpose and that this business has nothing to do with it.

Charles Johnson - 9065 W Bradley Rd., Brown Deer, WI – said that he has known Mr. Tally for 30 years, that he is a good person and that everything what has been said is fabricated.
McArthur Weddle - 3738 N 40th St – said that this is the first time that he disagrees with Pastor Childs and that this type of business is needed in the community for older people and that the applicants are respectable.
Patricia Watson - 4541 N 69th St – said that she is Mr. Tally’s neighbor for 17 years, that he is a good person, that it was the applicant's intention to open the resale shop but things changed and that there is no place for older people to go out without vulgar music or people acting crazy.
Bishop Childs Watkins - 2375 N Vel R Phillips Av – said that his church suffered a water damage years ago and that Mr. Tally spend a lot of time of his own repairing the church.
Lenny Davis – 3101 W McKinley Blvd – said that he knows both partners, that he is looking forward to this place for older people as he is into dancing and good jazz too and that this would be an upscale facility.

Ald. Jackson said that they held a successful neighborhood meeting where there was an overwhelming objection and that he supports the community.
The applicant said that the business plan is a great idea that meets the needs of seniors and that they will keep a safe and respectful environment.

Perez read item 6 for the record and regarding that meeting, he said that he was present as well and it was made very clear to the applicant that he did not have occupancy for assembly at the premises and that he could not held any more events including one that he could not charge. He added that the building owner was present with an attorney and yet, the applicant held another event after the meeting.

Atty. Adamson representing MPD asked Officer Vodicka to testify.
Atty. Adamson said that they will talk about the general layout of the building, the efforts taken to try to stop the after set activity at this location and about the video posted on Facebook by the applicant. He added that there needs to be more description as to the March 16, 2025 incident and the relationship of the party goers to the shooting.
Officer Vodicka said that there were 2 calls, one was a domestic violence issue insides the premises at 1:30 am, that the victim was at the bar later in the morning and the suspect returned to the bar and discharged his firearm into the premises. He also explained that the building is one tax key number, that both addresses are labeled nuisances and chronic after settings, that there is a wall that separates one from the other but bathrooms are on the laundromat side, that the exit on the tavern side is blocked by a table and the laundromat is used as entrance and exit. He also explained that at the scene, he observed party goers coming and going from the laundromat.
As for the video he said that it is in relation of item 4 on 9-13-25, that it was posted on the applicant’s Facebook page after the incident where MPD forced entrance to the premises. He added that the video was translated by a Spanish speaking police officer and shows the applicant at the bar with music being played, beers and liquor bottles displayed on the background with few people still inside the premises.
Officer Vodicka said that the building owner was also cited, that he and his partner designated the premises as a chronic after set activity and that he thinks that the video was in response to MPD visit.
Officer Vodicka read the transcript for the record.
Atty. Maistelman asked Officer Vodicka is he speaks Spanish and if he can verify what was said on the video.
Officer Vodicka said that he does not speak Spanish and that he cannot verify the content.
Ald. Zamarripa said that Atty. Maistelman was trying to imply that there could be some inconsistencies because Officer Vodicka does not speak Spanish but that Yadira Melendez, who is a Spanish speaker watched the video, and says that the transcript is accurate and that Sam Dawson could also testify after watching the video.
Atty. Maistelman said that he trusts what Yadira says and that they will agree then.
Atty. Perez asked that this application be denied based on the items on the police report and the persistent violations even after the meeting.

The applicant said that he does not know because he has posted many things and that he respects MPD.

The applicant said that one item was about an employee who left the door open and a group came in and ordered food to go. He also said that other incident was that they were waiting for the customers to finish their meals but that they were closed when the police arrived.
Ald. Zamarripa said that after reviewing her own notes and Atty. Arena’s notes from last year, the applicant agreed to close at midnight after his Extended Hours license was revoked in July 2024 after MPD conducted an investigation with 10 years of reports about the applicant selling alcohol after hours. She added that after the revocation, his attorney (Atty. Arena) contacted her because the applicant sold alcohol to a minor and agreed to close at midnight in good faith and that there is a communication email to support this statement. She continued saying that here we are again with the applicant operating after the original hours (1:30 am) because the police arrived at 2:20 am on April and 4:10 am and 3:00 am on July, which are hours way past his licensed hours and almost a year after he lost his Extended Hours license.
Ald. Zamarripa said that the applicant has a lack of respect for the City of Milwaukee and the Clark Square neighborhood where she was born and raised. She also said that she has given this business an opportunity over an over because it is a long-standing one but it is also the reason why this neighborhood is struggling the most with public safety in her district and that she made a mistake because this business is contributing to some of the negative issues in her neighborhood.
Ald. Zamarripa said to the committee members that she is torn between a 90 day suspension and nonrenewal.
The applicant asked why he received the license with the closing hours of 1:30 am and 2:30 am.
Mr. Cooney said that there is an exemption for extended hours requirement for a restaurant that holds a Class B Tavern, that this establishment was open for food service after 2:30 am and after the revocation of the Extended Hours license, the hours were shortened at 1:30 am and 2:30 am.
Ald. Chambers asked the applicant if he understands that his Extended Hours license was revoked last year.
The applicant answered “yes”.
Ald. Chambers asked the applicant why he still operating after the allowed hours knowing that his extended hours license was revoked and that he knew he needed to close at 12:00 am.

The applicant regarding the incident on 12/2024 said that the video was not available when he tried to retrieve it because it was damaged by his employee who also was the injured person and also tied to the July 3, 2024 raid. He added that he was the store manager.

The applicant said that he has but not everyone has access to the cameras and that he and the store manager are the ones with access to them.
Regarding the stolen beer, the applicant said that the store manager was trying to act on his behalf, that the stolen merchandise was put on the back and that he did not know anything about it until DOR came to check in.
Ald. Stamper asked the applicant how often he is at the store.
The applicant said that he is there once/wk and that he has a manager there.
Ald. Stamper asked what about the pending footage that was supposed to submit to MPD.
Sgt. Velasquez said that one officer said that no videos were received and that other officer said that they received the videos but were not time stamped and they do not believe are related to the incidents.
Ald. Stamper said that there are many inconsistencies and lack of transparency.
The applicant said that he is transparent with what he has and that the previous manager took things along including the DVR and damaged his and his business reputation.
Ald. Stamper asked the applicant if he knew about the shooting.
The applicant said that he did not know until he saw the police report.
Ald. Stamper asked when he bought the new surveillance system.
The applicant said that on September 2025.
Ald. Stamper said that the store is an eye sore, that the applicant is not present and that there are many issues concerning him.

The applicant said that he would have some patrolling to avoid incidences.
