080836 02.MotionSubstitute motion denying the new application for a food dealer license of Sara Khan, agent for Najmee Glass Works, LLC for the premises at 2635 W. Kilbourn Avenue, doing business as Judy’s Red Hots.

Minutes note: Motion relating to the new application for a food dealer license of Sara Khan, agent for Najmee Glass Works, LLC for the premises at 2635 W. Kilbourn Avenue, doing business as Judy’s Red Hot’s. Mike Dean, counsel for the applicant, at the table with the applicant. Also at the table: Kevin Hulbert from the Health Department and Ald. Bauman. Family business. Avanix, llc- entity on the original food license. The previous agent was Mohammed H. Khan. Previous entity that had Judy's Red Hots (not Avanix, LLC) was closed due to a health inspection. The legal entity that has the ownership interest in the property where Judy's Red Hots is located is Avanix, LLC. Najmee Glass Works, LLC does not have a lease at the location. A lease must be submitted to the Licenses Committee that proves that the legal entity, Najmee Glass Works, LLC, has a lease. Otherwise the application is not valid. Ald. Puente moves to hold to the call of the chair. Prevailed 4-0. (Ald. Hines, Jr. excused.) Ald. Bauman wants the police report entered into the record. But since the application is not valid, Ald. Bohl says that it should not be entered. Mr. Dean says an oral lease is valid. The previous restaurants that the family owned closed, but not for any health violations or problems, but for lease issues. Because it is not a valid application, neighborhood testimony cannot be heard either.

Prevailed 4-0. (Ald. Hamilton excused) Nicholas Murado, 231 W. Wisconsin Ave., Director of Operations for the establishment. Mr. Murado says that the business is proactive about dealing with problems and works with the police department. Puente says that a lot of police resources are being used to deal with the crowds and problems at the club. He asks the applicant how the business is keeping fights and other altercations from happening. The applicant says that these types of incidents occur at establishments that serve alcohol. Ald. Puente asks Ald. Bauman if the police department regularly reserves police resources to deal with the club. Ald. Bauman says he believes so. Ald. Zielinski says that the applicant is not saying the business will do anything differently to prevent things from happening. The applicant says that situations occur that do not appear on the police report because they are handled professionally and prevented before they become problems. Mr. Manjee says that more people are being hired and have been hired since May and that the business works with the police department by letting them know when the crowd will be let out of the building. Mr. Manjee also says that in the summer they stopped serving alcohol early, about 1:45 a.m. Mr. Murado says that most of the patrons park at the corner of Broadway and Michigan. For underage parties on Friday nights, the closing time is midnight. He says that some underage persons leave the club and loiter in parking lots after closing time. Neighborhood objectors present: Michael Levine, representing MBI Properties, owns property on Broadway and Wisconsin Ave. He says that the area has seen an increase in graffiti, broken windows, loitering, fighting and cruising due to the Ladybug Club. He says that the club needs to get under control. Ald. Puente asks if Mr. Levine has observed problems personally. Mr. Levine says that he has seen patrons leave the establishment and loiter and do donuts in the parking lot. Beth Nichols, executive director of Milwaukee Downtown, 600 E. Wells St. She has not been a direct witness of the issues, but she can say that there has been cruising and violent behavior in the area. Donald Arenson, 608 N. Broadway. He says that the club is directly at fault for the problems in the area. He also says that he has witnessed fights, public urination involving the clubs patrons every night that the club is open. He says that teen nights are also total chaos. Mary Jungers, 608 N. Broadway. Is showing a compilation of video from 6/23, 9/27, 10/18 and 10/31 of 2008. The footage is shot from the window of Ms. Jungers. She says she has witnessed cruising, public urination, fight and loud music from patrons leaving the Ladybug Club. Ald Puente moves to make the compilation DVD of footage part of the record. Prevailed 4-0. (Ald. Hamilton excused) Mr. Murado says that e-mails were exchanged between the business and Mr. Arenson, but Mr. Arenson did not meet with them to discuss problems. Mr. Arenson says he has personally seen patrons leave the bar and come over to the area and cause problems. Ald Puente moves to make the second DVD of footage part of the record. Prevailed 4-0. (Ald. Hamilton excused) Ms. Jungers says that all the incidents only happen when the club is open. She says that she spent time at her current address before the establishment opened in 2004, and she says that the incidents did not happen before the club opened. Mr. Murado says that armed security guards are outside and are not allowed inside the club. He also says that what the video shows is atypical. He also says that a dog is used on occasion for security. Ms. Jungers says that most of the problems occur on teen nights. Ald. Bauman says that problems have been shown to occur in the area of Broadway and Michigan, which is where Mr. Murado says that patrons park. He recommends non-renewal. Ald. Zielinski moves for a 45 day suspension based on items on the police report and neighborhood objections. Prevailed 3-1. (Ald. Bohl voting "no" and Ald. Hamilton excused) Ald. Puente says he is supporting the motion because of seeing the video of all the noise and disorder and because of all the police resources that the club is using.

Minutes note: 14 SINGH, Parshotam, Class “A” Malt application for “AK Food Mart” at 2305 S. Howell Avenue. New Location Special Letter Applicant at the table. Michael Maistelman, counsel for the applicant, also at the table, as is Ald. Zielinski. Mr. Maistelman says that the objections are not substantiated by any materials in the license file. The applicant says that the license is for selling beer only. Neighborhood objectors present: Kelly Durian, 2211 S. Robinson Ave., has personally witnessed excessive littering and has consistently seen groups of people loitering outside the establishment. Charles Stamschorr, 2571 S. Brisbane Ave., has personally witnessed an individual around the premises who was picking up used cigarette butts, another individual was mumbling and individuals that are often loitering in front of the premises. He does not shop there, as he is not comfortable with the environment around the business. Vera Pawlak, 902 E. Homer St., four blocks away, says passes the location everyday. She says that she sees loitering when she is coming home from work and sees cars parked to the end of the intersection, which makes it hard to see. Ms. Pawlak says she sees loud men loitering around the establishment and that the store is dirty and unkempt. She says that the neighborhood does not need another alcohol outlet. Ms. Pawlak says she sees less loitering when she passes the location in the morning around 8:45 a.m. Meeting recess at 3:33 p.m. Meeting reconvened at 3:48 p.m. Waldek Duinerman, owns 2379 S. Howell Ave, within the block of the establishment. He used to live in the area and also works in the area. He has traveled the block twice or more times a day, five to seven days a week for seven years. He says he sees a noticeable amount of loitering in front of the store spilling out to an empty lot and cars being double-parked so people can go into the store. He sees about two to four people at a time hanging out in front of the business. He also does his banking at the Maritime Bank next door. Mr. Duinerman says there used to be what he believed to be a drug dealer who used to hang around the location and around his property, which he reported to the police. He says that there is already a store that sells beer twenty feet away. Chris Allen, 2525 S. Brisbane Ave., four blocks away from the business, Safety Chair of the Bayview Neighborhood Association. Formed a block watch program. He says that he has seen public intoxication and loitering and he admits that the problems are coming from three different convenience stores, not just the business in question. He says he sees problems in front of AK Food Mart everyday. Mr. Allen says that the proprietors of all three convenience stores in the area were invited to a block watch meeting and no one from any of the establishments attended. Neighborhood supporters: Joseph Koch, 2325 S. Howell Ave. #1204, president of the Lincoln Court Resident Organization. He says that Mr. Singh has been cooperative in dealing with parking problems that are brought to his attention and that he is a good businessperson. Mr. Koch also says that what he sees out in front of the store he wouldn't describe as loitering. He also says that he helped clean up a vacant lot in the area and put up a fence. Mr. Koch says that Mr. Singh is a good neighbor and should not be denied a business opportunity. He also says that for convenience items, he shops at Mr. Singh's store. He also says that he has not witnessed any of the problems listed in the neighborhood notice and that crime, including vandalism, is going down. Valerie Keiller, 2149 S. Woodward, three blocks from the store, says she can make a healthy meal from things bought at the store. She says that she is there everyday at 6 a.m. to catch the bus to work. Ms. Keiller says a convenience store is needed and that she would like to be able to get her beer at the same location while she is buying groceries. She says she sees none of the issues that are listed on the notice (littering, loitering, prostitution, etc.). Julio Mayorca, 4736 Harbor Dr., IL, former manager at Maritime Bank. He believes that Mr. Singh is not a bad businessperson. He also says that loitering is in various areas of the neighborhood and it is unfair for blame to be put on one person, Mr. Singh.
