Ofc. Stephen Witkowski of District 3's Community Prosecution Unit at the table.
Police documents for the period from January 2004 to March 2006 were submitted prior to the applicant. Another packet of police records spanning the time between April 2006 and September 2007 was sent to the applicant, but not within the notice period.
Mr. Dean objects to the testimony of the police on items contained in the police reports that were not provided in a timely manner to the applicant.
Mr. Witkowski is allowed to testify about the time period with regards to details of which he has first-hand knowledge.
Between April 2006 to September 2007, the police were called to the location numerous times.
The location was known as a hot spot for drug dealing, basic disorder and crime. The location was the focus of a police roll call meeting at least once.

Ofc. Witkowski reads numerous details from the premise police record for the location. Some incidents that occurred did not become part of the CAD reports because they were handled by parts of the police department like the Vice Squad or were witnessed by police officers, not called in to the police. These reports included drug offenses.
The applicant says that there is no connection between her and the previous operator. However, the property owner is the same as before and the property owner was the previous operator.
Ofc. Witkowski says that a meeting was held with Mr. Khan at District 3 on July 23, 2008 to discuss police concerns and to find out what Mr. Khan's plans were for the establishment. The menu, the signage and previous problems were discussed. The police had been notified by neighbors that Judy's Red Hots was re-opening. The police had numerous communications with the property owner asking the owner to add security cameras and other security measures, but this was not done. Mr. Khan said that the Judy's name and menu would stay the same, but that he would add cameras and would be cooperative with the police.
Mr. Schrimpf asks if there were any calls for service at the location after Judy's closed. Ofc. Witkowski says no and the location was no longer a focus of the District's concern.
Ald. Bohl asks Ofc. Witkowski if the police report is unusual for a fast food restaurant or is it normal for these kinds of establishments in the area. Ofc. Witkowski says that Judy's was considered to be a unique challenge for the police department. Ofc. Witkowski also says that an employee of the current incarnation of the establishment was also dealing drugs at the location.
Mr. Dean says that there is no relationship between the current applicant and the owner besides a landlord tenant relationship.
A police premise check was done in September of this year at the location.
Mr. Dean asks if the police have a systematic review of crime trends in different locations. Ofc. Witkowski says yes.
Mr. Dean asks about the Nuisance Ordinance. Ofc. Witkowski says that establishments are closed with the help of the ordinance, but that closing establishments is not the goal of the police department. The police department's goal is compliance, not closing. Ofc. Witkowski says that there had not been any action by the police department to try to close Judy's as a result of the Nuisance Ordinance.
Ald. Bauman points out that ordinance 68-4-11 mentions the history of an establishment being an issue that can be considered when dealing with a new food license. Mr. Dean says that the ordinance may violate due process and he says that the previous location problems deal with how the location was operated, not the location itself.
Ron Roberts, Manager of the Commercial Enforcement Division of the Department of Neighborhood Services. Mr. Roberts says that orders are pending on the property and it is poorly maintained. Some improvements have been attempted by the owner. The current applicant attempted to make repairs but there were still violations that needed to be corrected. An order was issued October 3, 2008 and was discussed with the current owner at a meeting.
The occupancy permit had been issued as a zoning certificate in error. However, any business that has been closed for six months needs an occupancy permit with inspection. The zoning certificate does not require an inspection. The occupancy permit was revoked after an inspection and a letter was sent to the applicant telling her that the permit was being rescinded.
Ald. Hamilton moves to make a letter from Suzanne Hanson, Operations Manager of the City of Milwaukee Development Center to the applicant dated September 26, 2008 part of the record. Prevailed 4-0. Ald. Coggs excused.
Mr. Roberts says that the poor maintenance of the property is not typical of the area and is very poor. The Wendy's across the street is well-maintained and has landscaping.
Mr. Roberts says that an extension to complete the work has been granted to the applicant until December 22nd.
Mr. Dean says that all improvements have been paid for by the Khan family and that almost 70,000 has been paid by the family out of pocket. Ald. Bohl asks if building improvements are part of the lease agreement. Mr. Dean says that the lease does not say that improvements must be done by the tenant. Mr. Khan says there was an oral agreement between the property owner and him allowing him to make improvements to the building. According to Mr. Khan, the property owner does not want to put any money into building improvements.
A certificate of occupancy has been issued by the Department of Neighborhood Services as a result of an inspection.
There was no business at the location for about 11 months after it was closed by the Health Department until a new application was filed.
Ald. Bauman points out that the majority of the improvements recorded by Neighborhood Services was done to the kitchen and not to the exterior of the building.
Kevin Hulbert of the Health Department at the table. He says that food license was issued in error on the 23rd of September to Avanix Group, LLC, but was pulled on the 25th. Mr. Hulbert says it is department policy to notify the alderman of a new food dealer license application, but it is not required in the ordinance. The notification occurs ten days after the application is filed.
Avanix, LLC applied for a license on September 12th. The current application of Najmee Glass Works, LLC was applied for September 25th. Mr. Dean says that the applicants are not aware of the time frame for notification of an alderman and are not responsible for the alderman not being notified in a timely manner. Avanix Group, LLC and Najmee Glass Works, LLC are both now under the same ownership, that of Sara Khan.
Ald. Bohl says that the responsibility of the Licenses Committee is to deal with the objections to the application, not legal issues such as due process.
On September 17th, Ald. Bauman's office did file an objection based on the police report to the license application of Avanix, LLC that was issued on September 23rd in error.
Mr. Dean says that the ordinance dealing with the food licenses dictates that the application be treated the same way as a revocation. Ald. Zielinski points out that ordinance deals with the denial or non-renewal of applications as well. The Licensee Committee can deal with the application under the ordinance as a denial because an objection was filed.
Ald. Bauman believes that the location will continue to be a source of crime and disorder detailed under Chapter 64-4-11-g.

Assistant D.A. Carah Helwig, Community Prosecutor for District 3 at the table. Was present at District 3 in July for a meeting with Mr. Khan discussing plans for security, including installing cameras and No Loitering signs on the premises.
Objectors present:
Richard Lucas, 544 E. Ogden, #164. Has done security in the area and saw criminal activity around the restaurant when it was open. Mr. Lucas says he saw drug dealing, prostitution, public drinking and public urination. He also says he was present during a gunfight that occurred at the location when it was previously open, which involved 52 shots fired and a woman being shot.
Lawrence Mathias, 1138 N. 21st St., has operated a business at 2415 W. Kilbourn Ave. since 1989. Mr. Mathias says he has seen criminal activity including prostitution and theft at Judy's and points out that the Penfield Children's Center is in close proximity to Judy's Red Hots. He thinks that re-opening Judy's would be a move backwards for the neighborhood.
Keith Stanley, 4203 W. Fond du Lac Ave., Mainstreet Manager for the So-Hi District. His main concern is the way the establishment looks and says that it does not fit with the plans for development in the So-Hi district. He says that the previous owner never acted upon plans that were made with the So-Hi district and the Department of City Development.

Mr. Stanley says that many property owners have promised to make changes in their businesses and have not followed through after opening. He says that he has seen no effort by the previous licensee or the current applicant to improve the facade. He mentions that Judy's Red Hots' presence has made recruiting more businesses to the area difficult.
Brian Scotty, 3107 W. Kilbourn Ave., Chairperson of the Design Committee for So-Hi. He says that he would like to see something different at the location, particularly due to the design of the building.
Mr. Dean asks Mr. Scotty if he has received any interest from other businesses in doing something different with the building. Mr. Scotty says no.
Richard Wiegand, 2308 W. Wisconsin Ave., has owned several properties in the area going back to 1992. Because of the problems at Judy's Red Hots, he had to sell property that he owned in the neighborhood and lost money. He bought apartment buildings because he thought the neighborhood was going to turn around. He does not believe that the licensee is going to be able to turn the property around.
Mr. Dean asks if Mr. Wiegand has tried to buy the Judy's Red Hots location, but Mr. Wiegand says he hears that Mr. Tufail, the property owner's, asking price is unreasonable.
June Moberly, Executive Director of the Avenues West Association, whose office is located at 624 N. 24th St. She says that the association is concerned about the previous activities at the location. Ms. Moberly says that Mr. Khan attended an association meeting on July 20th and that Mr. Khan said that he was planning on opening the restaurant in a similar fashion as previously.
Donald Raffaelli, 5615 Grandview Dr., Greendale, WI, owns property in the neighborhood and has 25 years of business experience. Mr. Raffaelli says that he has done zipcode analysis and believes that the location will have problems succeeding regardless of who runs the business due to the lack of a drive-thru, limited seating and the requirement that patrons put their garbage in outside receptacles.
Georgy Kapustin, 958 N. 27th, St. owns 958 and 964 N. 27th St. Mr. Kapustin says that the appearance of the location contributes to the "Broken Window Effect" in the neighborhood. He believes that the opening of Judy's Red Hots will throw the progress of the neighborhood backwards. Mr. Kapustin says that he talked to his banker who had heard that Judy's Red Hots was opening and said that the banker heard that it was going to be business as usual at the location.
John Connelly, North Avenue Community Development, believes that if Judy's Red Hots opens again, the nuisance abatement that was accomplished would have to start again.
John Hennessy, neighborhood developer in the near west side. Chose to buy a building at 27th and Wells because he wanted to be involved in the redevelopment of the area. He says that 27th street has a lot of potential for development. Mr. Hennessy says that the applicant is not planning on changing enough about Judy's and he does not see the kind of commitment needed to change the establishment. He thinks that development of the area will be impeded by a return of Judy's Red Hots.
Phil Vincent, 1324 N. 31st., has lived in the area for 19 years. He says that things are a lot calmer since Judy's Red Hots has been closed and problems have disappeared. He believes that a bad impression is a difficult thing to overcome.
Jim Dieter, 2432 W. Kilbourn Ave., used to live on the east side and has lived at the current address for four years. He says that the only way to change the neighborhood is to the change the businesses in the location. He points out that the Common Council passed a resolution supporting the development in the neighborhood and giving Judy's a license would be moving backwards.

Pastor David King, CEO and Founder of Milwaukee God Squad at 1125 W. National Ave. He managed restaurants for twenty-five years. He says that when management is changed an image of a restaurant can change. His organization has offered to bring in extra security to Judy's Red Hots.
Muhammed Khan, 738 Grand Avenue, Thiensville, WI, son of Nasir Khan, says that the solution to reducing crime is hiring more police officers. He says that they are improving the location from the inside out. He says that the outside can be improved later after money has started coming in.
Fatima Khan, 738 Grand Avenue, Thiensville, daughter of Nasir Khan, says that during her time at the location she only encountered community members that were in favor of Judy's reopening.

Sara Khan says that her family has been involved in operating restaurants in the area in the past 15 years. All the previous businesses were closed by the family or forced to close by the closing of Northridge Mall. The businesses were in Grand Avenue Mall, Southridge Mall, and Northridge Mall.
Ald. Bauman asks how long it has been since the family has operated a restaurant. Ms. Khan says that the family has not operated a restaurant since 2004.

Muhammad Nasir Khan, father of Sara Khan, 738 Grand Avenue, Thiensville, WI. Mr. Khan knew the previous licensee and property owner before applying for the new license, but the previous licensee said that the only problems he had with the establishment were with the Health Department. Mr. Khan says that he called the Health Department to talk about what he would have to do to bring the establishment up to opening standards.

Glenn Frankovis, 7008 W. Crawford Ave, Milwaukee, Retired Police Captain, was the commanding officer of District Three from 2001 to 2003. He believes that an applicant that says that he will cooperate with the police is all a police officer can ask for. He says that he would have been comfortable with the midnight closing time of the establishment. Mr. Frankovis also disagrees with the opinion that management cannot change an establishment's success. Mr. Frankovis says that he has no direct knowledge of the problems in the area since retiring in 2003.
Ald. Bauman says that the establishment was not operating as an extended hour establishment when it was closed down because the extended hours renewal application was previously denied due to neighborhood testimony.
Mr. Khan read from his plan of operation regarding security improvements and outside improvements. He says he just wants a chance to open the business.

Mr. Khan says that he previously operated a gas station for about four years ending in 2007. It was closed because business slowed down.
