He added that the hookah was only for display purposes and that no one was smoking hookah. Individuals also present: Ald. Pratt asked the applicant if he stopped operations after he was advised by MPD. The applicant said that he did. Ald. Pratt said that they met and told him not to do anything else until he applied for a license but that she has seen many fliers and has gotten several reports of the many events held there after that conversation and asked what his intention was. The applicant said that his intention was to let people see the venue for feedback purposes, that he was not operating it at all and that those fliers have nothing to do with him or him posting them. Ald. Zamarripa said that the applicant is contradicting himself with everything what the police report says and read it for the record. The applicant said that it was a private event. Individuals in opposition: Gary Flowers - 8689 N 34th St – said that he is part of the block watch and that the application has all the checks for a nightclub even if the applicant says that it is not one. He added that the business was operating before getting the proper licenses which is not a good sign of being a community partner and that no one involved in the operation, has a real experience in this type of business. Individuals in support: Samantha Langsharp – 4949 N 28th St – said that she takes accountability for the social media posts, that she created the social media page because they were very excited with the project for the many things that the neighborhood lacks. She added that the purpose of those posts was to generate reactions and to be part of the conversation. She added that the Juneteenth event did not happen because they were closed. Ald. Zamarripa read for the record the post for the Juneteenth event (also on file). Ald. Brower read for the record an Instagram post from 5 days ago for a Halloween event. Ald. Pratt said that the applicant did not go in the direction that it was discussed when they met, that he did not reach out to neighbors and moved denial based on the 300 foot rule. She added that she knows that there is a plan for this plaza to go into a Christian based entity for the entire building. Atty. Gresham asked what the consequence after a denial is based on the 300-foot rule. Ms. Lopez said that it disqualifies the applicant to reapply for a 3-year period. The applicant said he has worked a lot on this location and that his main plan was the gym, that he shelters homeless, that he opens gyms in the community and even prepares natural energy drinks for the community. He added that he did not want this massive perception of a night club. Ald. Pratt moved denial based on the 300 feet rule. There were no objections. (Prevailed 5-0)
