The applicant said that the incident on the police report happened on 2016 and that he was at a bar with a friend who fought with somebody else and that he was charged with party of crime when he did nothing. The applicant acknowledged that he was caught driving impaired.
Ald. Zamarripa asked if he has spent time in jail.
The applicant said that he was given a 150 days in a correctional facility and that he was allowed to work.
Mr. Amruddin said that the applicant was given a probation instead.
The applicant said that he owned the same type of business on the south side (Integrity Auto) and that he is trying to do the same here. He added that he has been waiting 2 years for the license, that he has spent money and that he has been issued tickets for a U-haul business that has nothing to do with his.

The applicant said that they have and that the owner is responsible of the building. He added that they have fixed the part that they are occupying.
Ald. Stamper asked if they are in the process of buying the building.
The applicant said that it is contingent upon getting the license.

Mrs. Barnett - 2355 N 17th St – said that they just installed a watermark, that they are trying to beautify the area with plants, trees, orchards, etc., until you get to this building that has cars and cars parked everywhere. She added that there is not enough space for a dealership at this location. She added that she was raising money for a community event and that the applicant lied saying that he was not the owner and that she thinks that he does not want to be part of the community.
The applicant said that the neighbor came without any flyer or proper form to ask for the donation and that he told the witness to come back on Monday.
Mrs. Graham - 2324 N 18th St – said that this building is a junk yard with cars parked everywhere even at the SDC’s lot. She added that they are trying to beautify the area while the applicant is not. She also said that there is a lot of litter between 18th and 19th streets and that they work on the cars everywhere.
Mr. Right – 1903 W Garfield St – said that the applicant has been given a lot of allowance while the business still disrespecting the community with cars on the vacant lot, alley and on the street. He added that no one (from police or committee members) has come to check it out. He also said that there is no need for a business that wants to be part of the community, to be here in front of a committee for a second time. He also said that they are looking to bring serenity instead of junk.
Mrs. Right – 1903 W Garfield St – said that the applicant has been at the location for two years and that he has not advocated for the community with the building owner. She added that it is hard to believe that he will address their requests now.
Mrs. Njoroge - 2115 N 15th St – said that she opposes for all the reasons that her neighbors have mentioned and for safety reasons like traffic, illegal parking, test driving and for environmental concerns that does not align with the work that they have been doing at the neighborhood.
Mrs. Beltran - 2219 N 17th St – said that she is an ambassador of the area, that she reached out to the applicant just to verify where the oil is kept and that there is a container for that. She added that they outlined a program last summer for the business to become part of the community and that the applicant has done few things but not everything that he was asked for. She added that there is a trust issue.
Mrs. Robinson – 2142 N 15th St– said that she wonders how the applicant was approved at state level for a secondhand dealership and all of the sudden there is an issue with the city when the building has been used for oil change/mechanic as well.
Mr. Griffin – 4244 N 14th St – said that he does not like this business.
The applicant said that the cars on the street do not belong to him.
Ald. Stamper said that he supports the neighbors who have lived at the community for decades and that the applicant has not been transparent. He added that he is also concerned for the amount of cars, garbage, and traffic.

The applicant said that at some degree she is responsible because it is her business but that there was no altercation inside that led her to believe that something like would happen outside.
Ald. Spiker asked the applicant if the police report is accurate in regards of the bartender who witnessed a verbal altercation between the security officers and multiple patrons refusing to leave after they were escorted out due the bar closed.
Mrs. Harris said that it is.
Ald. Spiker asked if the firearms were inside the establishment because the police report does not say that they went to get if from their car.
Mrs. Harris answered “absolutely no” because the security guards check and that the surveillance video shows the individuals going into his car to retrieve the firearm.
Ald. Spiker asked the applicant if she asked the security guard involved in the altercation what it was about.
The applicants said that she did but that the security guard does not even know what it was about.
DeAndre Harris was sworn in.
Mr. Harris said that he manages the place and that he is married to the applicant.
Ald. Stamper asked Mr. Harris to repeat to committee what he said to him over the phone that night. He added that Mr. Harris told him that the altercation was about an underage issue.
Mr. Harris said they are 25 and up, that they are more restaurant dominated and that people can go in to pick up food. He added that on that date, the kitchen was already closed, the staff was inside, the security guards were outside asking people to go home to the ones hanging out around but by looking at the camera, he said that they don’t know what occurred between the guard and another patron exchanging words. He also said that the police verified that there was no altercation inside.

Lily – 2230 N 40th St - said that her house has been shot in three different times. One in the living room, the second one at her baby’s room and the third one almost hit his kid. She added that the insurance has fixed her house but not her family. She added that the music is loud and that there is very bright projector that does not let them sleep and that she has it in a video.
Ald. Spiker asked if the shots fired came from issues at the bar.
Ms. Lily answered yes.
The applicant asked if she filed a police report.
Ms. Lily said that she did it and also called the insurance.
Ald. Pratt asked the applicant if he has talked to neighbors.
Mr. Harris said that he talks to neighbors and that everyone knows him, that he cleans up, that goes to community meetings, etc.
Ald. Pratt said that he is not addressing any of the issues that his neighbor is talking about.
Paw Yai – 2236 N 40ht St – (Ms. Lily acted as interpreter) said that she is scared and that she cannot leave home when there is people from the bar around because there are many fights.
Aie Ci – 2228 N 40th St – said that she cannot sleep at night because it is too loud.
Ald. Stamper said that he has had concerns on the previous years and that the police checks are meant to monitor businesses, that he will talk to the applicant regarding the projector and that the applicant has a plan in order to move forward.
Mr. Harris said that they have 8 new cameras, hired a security company and that the projector can be removed permanently and that the patio will be closed at 11pm.
Ald. Stamper suggested to have the patio only for special events.
Mr. Harris said that if he gets rid of the patio the people would be hanging out at the front for smoking breaks.
Ald. Stamper suggested to keep it just for smoking.
Mrs. Lopez said that it must have been removed from the floor plan and to make a note that it is only a smoking designated area.
Ald. Zamarripa asked the applicant if she amenable to change the floor plan as described by Mrs. Lopez and to apply for a Temporary Change of Plan for special events.

Ald. Spiker said that there are 8 items on the police report with 4 happening before the meeting and 4 after. He said that there are folks that probably did not make it to the meeting and that he would need to reach out to those neighbors in order to have them to call him/manager instead of MPD.

The applicant said that it is open until 1:30am and that the establishment closes at 12AM on Sundays to be more conscious of the neighbors.
Ald. Moore said that this business is in a commercial corridor but that there are residences right behind and in front and that this is the only business that stays open late. She explained that at the meeting between 20-25 neighbors showed up, that the applicant listened to them while others remained anonymous. She added that after the meeting, her office received numerous emails and calls saying that he is not cooperating while the applicant has told her that has done things in order to keep her business operational.

Taylor Duval - 2343 N 56th St – said that nothing has been addressed since that meeting, that a patron was killed on May 5th and that it has not been mentioned. She added that there is violence, people fighting, illegal parking, sex acts on the alley, people drinking on the street and that she tried to talk to Ald. Moore before but that it has not happened. She added that this is a serious matter because it is the only business open at late hours. She also mentioned that the hours have not been cut yet.
There were people on the board who did not want to speak.
Ald. Moore said that there is a fear of retaliation and that she does not know what is going on.
Jacob Duval – 2343 N 56th St – said that this is a nightclub operating in residential area and that if food sales are what supposed to be like the plan of operations states, the applicant would not have any issue closing earlier in order to avoid many of the issues that neighbors have been experiencing. He added that the applicant agreed to cut back hours at 10pm at the meeting.
Ald. Moore said that it was a discussion about cutting hours but that it was not offered to be at 10pm and that she would like to have him to close at 12am Sun-Wed and at 1am Thu-Sat not to hurt his business.
Ald. Zamarripa asked the applicant if he is amenable to amend the hours as suggested by Ald. Moore.
The applicant agreed.
Ald. Westmoreland moved to amend the hours of operations to close at 12am Sun-Wed and at 1am Thu-Sat. There were no objections.
Ald. Westmoreland asked the applicant if he is willing to get rid of the Disc Jockey to get restarted somehow because it seems that there is patron with the nights with Disc Jockey and the calls for service. He also explained the applicant that he could work with temporary permits instead to also track down if there are any issues on those dates.
The applicant said that he does not want to get rid of the Disc Jockey but that he will turn the volume down.
Mrs. Enke - 2338 N 56th St – said that she has witnessed patrons that can barely walk, urinating on the street and multiple scenarios where people is visibly very intoxicated and that she is concerned about the way they are served alcohol.

Ald. Zamarripa said that this applicant was brought before the committee for a revocation of the extended hours license and that for years, they received complaints about this establishment serving after hours and that they could not prove it until MPD conducted the undercover cooperation. She also mentioned that after the revocation, the applicant served an underage person. She said that she is very disappointed because her wife was complaining about safety issues in the neighborhood, that she was able to feel his wife’s pain when the applicant has been part of the problem in the community. She said that she recognizes that closing early is the right direction but that she is very disappointed still.
Ald. Spiker asked what is being done in order to stop serving people after hours.
The applicant said that they will close at 12am now.
Ald. Spiker asked how is he going to prevent that no drinks are served after 12am.
The applicant said that he will have rules and that he will fire any employees breaking the rules and that there has not been any issues after the revocation hearing.
