Title
Substitute resolution relating to the posting of signs prohibiting carrying, possession or control of firearms onto licensed alcohol beverage premises.
Analysis
This resolution urges Class B alcohol beverage licensees to post appropriate signs prohibiting members of the public from carrying firearms onto licensed premises.
 
The resolution also directs the License Division-Office of the City Clerk to provide notice of this resolution to all applicants for new or renewal Class B licenses.
Body
Whereas, Firearm violence in the City of Milwaukee continues to cause great pain, suffering and anguish to individuals, families and neighborhoods; and
 
Whereas, Section 941.237(2), Wis. Stats., provides that whoever intentionally goes armed with a handgun on any premises for which a Class "B" or "Class B" alcohol beverage license or permit has been issued under ch. 125 <https://docs.legis.wisconsin.gov/document?&cite=statutes/ch.%20125> is guilty of a Class A misdemeanor; and
 
Whereas, 2011 Wisconsin Act 35, creates an exception to s. 941.237(2), Wis. Stats., permitting any person licensed to carry a concealed weapon, including out-of-state licensees, to go armed with a handgun on Class B premises without penalty if the licensee is not consuming alcohol on the premises; and
 
Whereas, The owner or occupant of a nonresidential building and the owner or occupant of the grounds of a nonresidential building may notify persons coming into the building or onto the grounds of the building that firearms are not permitted; and
 
Whereas, Persons carrying firearms into nonresidential buildings or onto the grounds of nonresidential buildings after notice that firearms are not permitted may be subject to a Class B forfeiture penalty of up to $1,000 under Wisconsin trespass statutes; and
 
Whereas, Permitting persons licensed to carry concealed weapons to carrying handguns onto the premises of Class B licensed alcohol beverage establishments poses significant enforcement challenges including:
 
1.      Screening for lawful carrying of handguns on the premises.
2.      Responding to and preventing unlawful carrying of handguns on the premises.
3.      Refusing service to persons carrying handguns on the premises.
4.      Responding to persons who consume alcohol prior to carrying handguns onto the premises.

Whereas, Consumption of alcohol is associated with increased risks of violence and violent injury requiring careful and responsible management of premises upon which alcohol beverages are sold and consumed; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Common Council urges all persons and parties owning or controlling premises licensed as Class B alcohol beverage establishments where alcohol beverages may be sold to the public and consumed to post signs of at least 5 inches by 7 inches prohibiting persons from entering upon licensed premises while carrying firearms; and, be it
 
Further Resolved, That the License Division-Office of the City Clerk provide written notice of this resolution to applicants for new or renewal Class B alcohol beverage licenses.
