Analysis
This resolution authorizes the Commissioner of Public Works and Comptroller to execute a revised State/Municipal Agreement with the Wisconsin Department of Transportation for geometric and traffic signal improvements at the intersection of West Kilbourn Avenue and North 6th Street and to fund an increase in preliminary engineering for the project in the 4th Aldermanic District at an estimated increase in preliminary engineering of $27,000, with an estimated increase in the grantor share of $24,300, and an estimated increase in the City share of $2,700. The current total estimated cost of the project is $177,000, with a current estimated grantor share of $159,300, and a current estimated City share of $17,700.

Whereas, The Common Council has previously approved the execution of a State/Municipal Agreement for the project under Common Council File Number 090888; and                                                                                                
 
Whereas, The City of Milwaukee has requested an increase in preliminary engineering design funds of $27,000; and
 
Whereas, The increase in preliminary engineering design funding is necessary to satisfy revised Federal reporting and documentation requirements associated with the project; and
 
Whereas, Ten percent of the participating cost increase, or $2,700, is not reimbursable and is included in the Division's 2011 Capital Purpose Project/Grant Number ST320110000; and
 
Whereas, Ninety percent of the participating project cost increase, or $24,300, is reimbursable from the Wisconsin Department of Transportation (WISDOT), and should be earmarked for this project in the 2011 Capital Grand and Aid Project Fund Project/Grant Number SP032110100; and
 
Whereas, WISDOT has submitted a revised State/Municipal Agreement for execution by the City of Milwaukee for the design and construction of:

Whereas, The State cannot proceed with any project cost overruns and/or changes in scope of more than 5% without prior Department of Public Works approval; and
 
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and/or changes in scope as approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works and the Comptroller are authorized to execute a revised State/Municipal Agreement for the programming and the design/construction of aforementioned project with Highway Safety Improvement Program funds, copies of which are attached to and incorporated in this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to transfer the additional funds for the revised State/Municipal Agreement as required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the Grantor's share and local share or $5,000, whichever is greater as follows:
