Analysis

Current code provisions require that any maintenance or repairs on tax deed property that exceed the sum of $1,000 shall be submitted to the common council for its approval.  This ordinance repeals that provision.   Furthermore, this ordinance places the operation, maintenance and repair of tax deed property under the functions, powers and duties of the department of city development.  This function was previously included in ch. 304, relating to city finances.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1.  Section 304-59 of the code is repealed.

Part 2.  Section 304- 61 of the code is repealed.

Part 3.  Section 308-1-2-m is created to read:

308-1. Department of City Development.

2. FUNCTIONS, POWERS AND DUTIES.

m.  To attend to the operation, maintenance and repair of improvements upon land acquired by tax deed by the city in order that the premises may be rented and kept rented until sold, otherwise disposed of or appropriated.
