Analysis

This resolution permits the Wisconsin Department of Transportation (WISDOT) to construct and maintain cameras and appurtenant facilities on city-owned property located at 841 North James Lovell Street, also known as the MacArthur Square.

Body

Whereas, The Wisconsin Department of Transportation (WISDOT) wants to install cameras and appurtenant facilities in the tunnels under MacArthur Square in order to monitor traffic exiting and entering I-43 both for security and safety purposes; and

Whereas, The WISDOT will maintain the aforementioned cameras and appurtenant facilities; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Wisconsin Department of Transportation is granted permission to construct and maintain cameras, conduit, electrical and communications wiring, and other equipment required for the operation of said cameras in the north and south tunnels under MacArthur Square and in the land between North 6^th Street and North James Lovell Street, known as 841 North James Lovell Street; and, be it

Further Resolved, That the WISDOT shall obtain all necessary permits for work performed in the public right-of-way and on city-owned property; and, be it

Further Resolved, That the WISDOT shall keep and maintain the cameras and appurtenant facilities to the satisfaction of the Commissioner of Public Works; and, be it

Further Resolved, That whenever permission for the cameras and appurtenant facilities is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, the Wisconsin Department of Transportation shall not only remove all construction work executed pursuant to this permissory resolution, but shall also restore to its former condition and to the approval of the Commissioner of Public Works the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said cameras and appurtenant facilities. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
