Title
Substitute resolution permitting a minor modification to a Detailed Planned Development known as the John C. Cudahy YMCA Youth & Family Center, for an accessible baseball field, on land located generally south and east of the intersection of North 91st Street and West Fairy Chasm Drive, in the 9th Aldermanic District.
Analysis
This substitute resolution will allow for the installation of a fully accessible baseball field for youth and adults, with adaptive needs, in lieu of the grass baseball field proposed in the original Detailed Planned Development.
Body
Whereas, Section 295-907-2(i) of the Milwaukee Code of Ordinances permits minor modifications to planned developments after approval of the Common Council; and

Whereas, The detailed plan for a planned development known as the John C. Cudahy YMCA, located generally south and east of the intersection of North 91st Street and West Fairy Chasm Drive, was approved by the Common Council of the City of Milwaukee on June 2, 1999, under File No. 981711; and

Whereas, The installation of a fully accessible baseball field, which will be paved with asphalt, instead of traditional materials, to create a fully accessible field, is consistent with the spirit and intent of the approved plan and will not adversely affect surrounding development and a copy of which is attached to this Common Council File as Exhibit A which is on file in the office of the City Clerk and made a part as though fully set forth herein; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the modification:

1. Is consistent with the spirit and intent of the previously approved Detailed Planned Development (“DPD”).

2. Will not change the general character of the DPD.

3. Will not cause a substantial relocation of principal or accessory structures.
