Analysis
This ordinance adopts the Citywide Policy Plan and the13 Area Comprehensive Plans that have been prepared by the Department of City Development as the Comprehensive Plan for the City of Milwaukee.
Body
Whereas, Section 66.1001(3) of the Wisconsin Statutes stipulates that, beginning on January 1, 2010, if a local governmental unit engages in any of various specified actions (e.g., subdivision regulation and zoning ordinances), those actions shall be consistent with that local governmental unit’s comprehensive plan; and
Whereas, Over the past decade, the Department of City Development has prepared 13 Area Comprehensive Plans that together encompass the entire geographic extent of the City of Milwaukee and that each contain all of the comprehensive plan elements required by s. 66.1001(2), Wis. Stats.; and
Whereas, Copies of each of these Area Comprehensive Plans are attached to and made a part of this Common Council file; and
Whereas, Each of the Area Comprehensive Plans have been approved by both the City Plan Commission and the Common Council; and
Whereas, The Department of City Development has also prepared a Citywide Policy Plan that is to be part of the City’s Comprehensive Plan and has been approved by both the City Plan Commission and Common Council; and
Whereas, A copy of the Citywide Policy Plan is also attached to and made a part of this file; and
Whereas, Section 66.1001(4), Wis. Stats., provides that no comprehensive plan may take effect until the political subdivision enacts an ordinance that adopts the plan; and
Whereas, The Common Council finds that the City’s Comprehensive Plan, consisting of the 13 Area Comprehensive Plans and the Citywide Policy Plan, contains all of the elements specified in s. 66.1001(2), Wis. Stats., and
Whereas, The Common Council’s Zoning, Neighborhoods and Development Committee has held a duly-noticed public hearing on the Comprehensive Plan, in accordance with s. 66.1001(4)(d) and (e), Wis. Stats.; now, therefore
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 295-106 of the code is created to read:
295-106. Comprehensive Plan. 1. PLAN ADOPTION. The city’s comprehensive plan shall be the 13 area comprehensive plans and the citywide policy plan that are contained in common council file no. 100247, passed [city clerk to insert date], as well as any amendments or updates to those plans that are adopted by common council resolution. Copies of the plan, including any amendments or updates, shall be maintained and made available for public inspection by the department of city development and the city clerk.
2. ZONING CODE CONSISTENCY WITH PLAN. All provisions of this chapter shall be consistent with the adopted comprehensive plan, as required by s. 66.1001(3), Wis. Stats.
