Title

Substitute resolution granting the Friends of the Hank Aaron State Trail permission to construct and maintain a car stop shelter within a permanent limited easement for public enhancement at 2500 West Canal Street in the 8th Aldermanic District.

Analysis

This resolution permits the Friends of the Hank Aaron State Trail to construct and maintain a car stop shelter within a permanent limited easement for public enhancement at 2500 West Canal Street subject to review and approval of the Commissioner of Public Works.

Body

Whereas, The Friends of the Hank Aaron State Trail is a non-profit organization working to improve and promote the trail; and

 

Whereas, The Friends of the Hank Aaron State Trail desires to construct a car stop shelter within a Canal Street right of way for public enhancement adjacent to West Canal Street; and

 

Whereas, The Common Council of the City of Milwaukee must pass a permissory resolution to allow the Friends of the Hank Aaron State Trail to construct and maintain a car stop shelter within said Canal Street right of way; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Friends of the Hank Aaron State Trail is granted permission to construct and maintain a car stop shelter in a Canal Street right of way for public enhancement at 2500 West Canal Street;

 

;and, be it

 

Further Resolved, That the method of construction of the car stop shelter shall be subject to the approval of the Commissioner of Public Works; and, be it

 

Further Resolved, That the Friends of the Hank Aaron State Trail shall obtain all necessary permits for the car stop shelter; and, be it

 

Further Resolved, That the Friends of the Hank Aaron State Trail shall keep and maintain the car stop shelter to the satisfaction of the Commissioner of Public Works; and, be it

Further Resolved, That whenever permission for the car stop shelter is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, the Friends of the Hank Aaron State Trail shall not only remove the shelter, but shall also restore to its former condition and to the approval of the Commissioner of Public Works, the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said shelter. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
