Title
Resolution authorizing conveyance of a portion of the City property at 2401 South Lincoln Memorial Drive to the Wisconsin Department of Transportation for dedication as public right-of-way and reconstruction of the I-794 on-ramp and authorizing relocation of the utility easement from the right-of-way, in the 14th Aldermanic District.
Analysis
This resolution permits the City of Milwaukee to execute a quit claim deed to dedicate land for public right-of-way and to amend an existing easement to relocate it from the right-of-way.
Body
Whereas, Common Council File No. 091263, adopted on February 9, 2010, authorized the Commissioner of Public Works to execute a Project Agreement with the Wisconsin Department of Transportation (“WISDOT”) for the reconstruction of the northbound on-ramp to I-794 at South Carferry Drive and authorized City of Milwaukee (“City”) expenditures for the City’s share of the improvements; and
Whereas, WISDOT has requested that the City dedicate approximately 5,548 square feet of the City property at 2401 South Lincoln Memorial Drive to accommodate reconstruction of the on-ramp; and
Whereas, The legal description of the property to be acquired and dedicated is as follows and is illustrated in Exhibit A, a copy of which is attached to this Common Council File:
That part of the Northeast 1/4 of Section 9, Township 6 North, Range 22 East, described as follows: Commencing at the northwest corner of said 1/4 Section; thence North 88°06’59” East, along the north line of said 1/4 Section, 2072.96 feet to a point; thence South 03°06’07” West 36.95 feet to a point in the present easterly line of the Lake Freeway, Interstate 794; thence South 05°18’15” East, along said easterly line, 87.72 feet to a point; thence South 01°14’19” West, continuing along said easterly line, 127.66 feet to the point of beginning of the land to be described; thence South 01°14’19” West, continuing along said easterly line, 43.91 feet to a point; thence South 58°05’49” East, continuing along said easterly line, 123.56 feet to a point in the northerly line of South Carferry Drive; thence North 64°32’25” East, along said northerly line, 44.86 feet to a point; thence North 58°05’49” West 170.15 feet to a point in the point of beginning; and
Whereas, The document dedicating the right-of-way shall provide that no access rights shall accrue between the highways herein designated as I-794 and South Carferry Drive and all of the abutting remaining real property of the owner; and
Whereas, Reconstruction of the on-ramp will require relocation of an existing easement with WE Energies and AT&T from the new right-of-way to the City’s property at 2401 South Lincoln Memorial Drive; and
Whereas, The City property is under the jurisdiction of the Port of Milwaukee and the Board of Harbor Commissioners has approved the dedication of such land and relocation of the easement; and
Whereas, The City Plan Commission has approved conveyance and dedication of land for this public right-of-way; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of the Department of City Development (“DCD”), or designee, is authorized to execute a quit claim deed on behalf of the City to WISDOT to dedicate a portion of 2401 South Lincoln Memorial Drive as public right-of-way; and, be it
Further Resolved, That the Commissioner of DCD, or designee, is authorized to execute the appropriate easement amendment to revise the location of the easement area.
