Title

Resolution authorizing dedication of the City-owned vacant lot at 2041-43 West Fond du Lac Avenue as public right-of-way for a pedestrian plaza as part of the Fond du Lac Avenue Streetscape Project, in the 15th Aldermanic District.

Analysis

This resolution permits the City of Milwaukee to dedicate land for public right-of-way for use as a pedestrian plaza.

Body

Whereas, By adoption of Common Council File No. 001171, the Commissioner of Public Works (“DPW”) was authorized to execute an agreement with the Wisconsin Department of Transportation (“WISDOT”) for the programming and construction of the Fond du Lac Avenue Streetscape Project as part of the STH 145 reconstruction, ID 1360-01-07; and

 

Whereas, WISDOT’s State Enhancement Grant and City of Milwaukee (“City”) matching funds provided by the Department of City Development, the Capital Budget and the Neighborhood Commercial District Street Improvement Fund will fund the beautification and addition of special pedestrian amenities in and around the high-intensity nodes at West Burleigh Street, West Center Street and West North Avenue; and

 

Whereas, The City-owned property at 2041-43 West Fond du Lac Avenue at the southwest corner of West North Avenue and West Fond du Lac Avenue is a suitable location for streetscape and public plaza improvements for the West North Avenue and West Fond du Lac Avenue node; and

 

Whereas, The project identifies additional amenities that may include, among others, information kiosks, planters, trash receptacles, benches and hardscape surface for purposes of blending highway improvements of the corridor into the existing neighborhood and historic aesthetics to add economic vitality to the corridor; and

 

Whereas, By installing such amenities, a significant enhancement will occur that will turn the area into a tremendous asset for the City and a highly visual enhancement project for WISDOT; and

 

Whereas, DPW has requested that the City property at 2041-43 West Fond du Lac Avenue be dedicated as public right-of-way for a pedestrian plaza to fulfill the requirements established by WISDOT for the Fond du Lac Avenue Streetscape Project in conjunction with STH 145 reconstruction, ID 1360-01-07; and

 

Whereas, The area to be dedicated as a pedestrian plaza is approximately 2,447 square feet, is legally described below and is illustrated in Exhibit A, a copy of which is attached to this Common Council File:

 

All of Lot 1, as originally platted, in Block 228 of Continuation of Brown’s Addition, a recorded subdivision, in the Northwest 1/4 of Section 19, Township 7 North, Range 22 East, described as follows: Commencing at the east corner of Lot 1, also being the north corner of Lot 2 in said Block 228; thence Northwesterly, along the southwesterly line of West Fond du Lac Avenue, 68.44 feet to its point of intersection with the east line of North 21st Street, said point being the north corner of Lot 1; thence Southerly, along said east line, 98.98 feet to a point in the northwesterly line of Lot 2, said point being the south corner of Lot 1; thence Northeasterly, along the southerly line of Lot 1 aforesaid, 71.53 feet to the point of beginning; and

 

Whereas, The City Plan Commission has approved the dedication of the property at 2041-43 West Fond du Lac Avenue as public right-of-way for use as a pedestrian plaza; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that dedication of the tax deed vacant lot at 2041-43 West Fond du Lac Avenue as public right-of-way for a pedestrian plaza for the Fond du Lac Avenue Streetscape Project is approved; and, be it

 

Further Resolved, That the Commissioner of the Department of City Development, or designee, is authorized to execute a deed or other documents to dedicate the land as public right-of-way for pedestrian and plaza use.
