Title
Resolution relating to application, acceptance and funding of a Green Solutions grant from the Milwaukee Metropolitan Sewerage District for the installation of five green alleys to be constructed as part of the City’s 2024 alley reconstruction program in the 1st, 3rd, 5th, 7th and 10th Aldermanic Districts.
Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division, to apply for and accept Milwaukee Metropolitan Sewerage District Green Solutions grant funding for the construction of green alleys in the City of Milwaukee in the amount of $601,000 to install five green alleys that will be constructed as part of the City’s 2024 alley reconstruction program. The resolution also authorizes the Commissioner of Public Works to execute a post installation Maintenance Covenant with the MMSD.
Body
Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) is responsible for collecting and treating wastewater from local sewerage systems; and
Whereas, Green infrastructure, such as green alleys, reduces the volume of stormwater in the sewer system and the amount of pollutants discharged to surface waters; and
Whereas, Green alleys consist of permeable pavers constructed in the center 4-foot of newly reconstructed alleys; and
Whereas, MMSD desires to promote the installation of Best Management Practices such as green alleys and is willing to provide the City funding as part of its Green Solutions Program; and
Whereas, The Common Council has adopted File Numbers 230866 and 231567 authorizing the construction of said alley projects at locations bounded by the areas:
• West Galena Street, West Vliet Street, North 51st Street, North 52nd Street
• West Rohr Avenue, North Sherman Boulevard, West Villard Avenue, North 44th Street
• West Burleigh Street, West Chambers Street, North 88th Street, North 89th Street
• North Bremen Street, East Center Street, East Clarke Street, North Weil Street
• West Capitol Drive, West Melvina Street, North 53rd Street, North 52nd Street; and
Whereas, The cost of the green alley portion of the alley reconstruction projects is approximately $601,000; and
Whereas, A template Maintenance Covenant to be used post-installation is submitted to this file; now, therefore, be it
Resolved, That the Commissioner of Public Works is authorized to apply for and accept MMSD Green Solutions Funding in accordance with Milwaukee Code of Ordinances 304-81; and, be it
Further Resolved, That the Green Solutions funding agreement (G98005P144) and the template maintenance covenant submitted to this file are hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter those documents in the same form, or in substantially the same form and substance, as have been submitted to this file; and (ii) to take such further acts as may be contemplated or required to be taken by the City thereunder so as to carry out the intent and purpose of this resolution and those documents; and, be it
Further Resolved, That upon approval of this Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for these project, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
