Title

Resolution removing a deed restriction from a former tax-deed vacant lot at 1009-1011 East Kane Place, in the 3rd Aldermanic District.

Analysis

This resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits division of the property and construction of any principal buildings on the property.

Body

Whereas, The City of Milwaukee conveyed to Richard L. LaFountain a tax-deed vacant lot at 1009-1011 East Kane Place (“City Lot”) that adjoined his property at 1013 East Kane Place by a Quit Claim Deed dated July 2, 1998 (“Deed”); and

 

Whereas, The Deed contained restrictions that the City Lot be used as open space, that no principal buildings may be erected thereon and that the City Lot be joined with the buyer's adjoining property to create a single parcel to be used as a unit; and

 

Whereas, The Deed also provided that these restrictions could not be released except upon approval of the Common Council of the City of Milwaukee; and

 

Whereas, The City Lot is now part of a larger property identified as 1910 North Water Street that is the site for the proposed Metro Place development for which a Detailed Planned Development was approved by the Common Council via passage of File No. 090807 on February 9, 2010; and

 

Whereas, Release of the deed restrictions is required for the Metro Place development to proceed; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that restrictions contained in the Deed dated July 31, 1998 are released to allow for development of Metro Place; and, be it

 

Further Resolved, That the Commissioner of the Department of City Development, or designee, is authorized to execute the necessary legal document to release the restrictions.
