Beckett - objects because this area has gone down in the 23 years she has lived there; her son got shot there and another guy got killed there recently. There are plenty of stores there already. It's just a bad area now and she thinks nothing should be there due to the shootings occurring. Angela Howard - 8102 W. Hampton Ave. - she has also seen the area degrade and it seems like the more stuff that opens there leads to more traffic and more violence; she worries about the kids who walk back and forth to school. The gas station has everything that they need so no need to open a new food market. Jessica Trapraneer - Colorado - property manager (for Baseline, which has owned the property since 2017). The crime has never occurred on their property, but across the street. They do have cameras and the applicant has been a great tenant at their other properties. The landlord fully supports this tenant. A Walmart in the area just closed. Ald. Chambers knows that crime has occurred in this building and this applicant would not replace a Walmart that has closed. He sees trash all over their parking lot. The applicant is looking for healthier options and accepting WIC payments. Ald. Westmoreland - clarifying this is a small grocery store, no alcohol sales and minimal tobacco sales. The attorney addressed the items contained in the police report; the erratic driver in the parking lot left before MPD arrived; the business was not open during the armed robbery and measures have been put in place so MPD can immediately access any video from their cameras. The establishment does have a uniformed, professional security officer. A woman being assaulted by the security guard was not included as part of the notice. Per the applicant, the video didn't show a woman being assaulted. Ald. Westmoreland saw videos on social media, but the applicant didn't see her being punched; the security guard pushed her out and locked the door. He pushed her out a second time, but wasn't punching or hitting her in the video; the woman was drunk. The security guard no longer works there. It wasn't included as part of the notice due to a License Division deficiency. Atty. Bobot feels it would be unfair to hold this item as it has been a good business for over 20 years. The applicant is now working with a different security company. Ald. Westmoreland - He would like to recommend approval (changed his opinion from hold to have it noticed for the November incident). He would also like the applicant to stay on top of litter at this location. He has received few complaints on this establishment. Marsha Jules - 2230 N Martin Luther King, Jr. Dr. - kitchen/restaurant manager - they have security walking inside, but their capacity is 300. They do permit hookah smoking, but enforce people not smoking marijuana. It seems other establishments also have problems enforcing no smoking of marijuana. No shots have been fired inside the establishment, but it is the job of the police to stop shooting outside of the club. Security tells people they can't park blocking the bus stop, but they can't enforce it as that's the police's job. They do have a parking lot and there is a free parking lot across the street. Ald. Coggs noted that the offenders would not have been drawn to this area who were parking and shooting if that establishment was not present. The establishment does have responsibility for the outside area, not just the inside. Ms. Jules noted that many of the establishment's patrons do live in the neighborhood and would be doing who knows what. Ald. Chambers noted that they are at their establishment, not just in the general area. Ms. Jules didn't think the shooting was happening on their property as there are numerous cameras from many establishments and none of them showed that. They do not intend to be in operation long-term at this location. Their provisional license expired January 4th. They have been operating. Ald. Coggs would support approval, with a warning letter, but she is not signing another provisional license, so they will need to be closed until Feb. 6th. Ald. Pratt moved to amend their plan of operation to note they do have security and the number of guards, responsibilities and their equipment. Brostoff said that he would like to hear from the objection, of a complaint made by a woman who stated that her drink had being spiked at the Bar or Bartender. This was posted in Social media. Mr. Rasmussen responded that they have been in Business since the 1930's and that HE has not heard of anything of this sort. Ald.Brostoff said that he is not convinced that this lady would lie on something of this nature. Ald. Dameon Ellzey - aide to A.D. 15 -- the applicant applied last year, but they were operating without a license. He himself also had a bad experience and feared for his safety at this location. He dealt with Mr. Bonds's grandson. The alderman and Mr. Ellzey both object to this application. They were doing work for which they didn't have licenses for at this time. Mr. Bonds, Sr. said he never received a card and wasn't told last year that Mr. Ellzey had been threatened and feared for his life. Mike Pine - 4617 N. Idlewild, Whitefish Bay - architect - helped him put together his applications. He was here last year and didn't hear anything about anyone being threatened. He was at the BOZA hearing and doesn't remember an objection at that hearing. If this were tabled, they could have customers and former customers come speak in support of their work quality. Mr. Bonds feel that he is being blindsided as his application is being held and he has never gotten a returned phone call from the alderman's office. He also thinks Mr. Ellzey also came in with a bad attitude that day and city employees should be held to a higher standard. He never heard that Mr. Ellzey was feeling threatened (before he testified that he was unhappy with the customer service, which he first heard about at last year's meeting). Neither of the 2 employees knew anything about the incident. They believed they were okay to operate as they had gone through BOZA. They had a letter of compliance from DNS; the License Division never issued a license at any point. They generate more than 25 waste tires a year, which does need a license from the License Division. They do have a permit from BOZA. Eric Braxton - currently the owner of the property Mr. Bonds is trying to buy to operate p 2655 N. Harbor Dr. -- Mr. Bonds has been going through hell with this application and there have been numerous misunderstandings and confusion. He has had that tire shop since 1994 and Ald. Stamper has refused to speak with him for over 2 years. Mr. Bonds is a good citizen and the fact that he cannot operate due to complaints from one customer. He supports Mr. Bond's application. The licensee believes at least one of the shootings was retaliation directed against one of his security guards due to a prior confrontation at another establishment. A noise complaint related to patio music was dealt with by no longer having a speaker on the patio. Atty. Ovbiagele went through each item in the police report with his client and what his client has done to curtail and prevent problems. The licensee sees his establishment as both a restaurant and an alcohol establishment. Individuals also present: Ald. Laressa Taylor - two town halls were held on this establishment. Many residents object, but some are in favor. The first year there were no issues, but the second year there were a number of incidents, many of which involved guns. Ald. Taylor was present during one of the shootings. There are schools directly across the street where many of the patrons park. Her initial thought was to recommend non-renewal, but she now supports a 20-day suspension and the hours will be Sunday-Thursday close at 12:30 A.M. and Friday/Saturday at 1:30 A.M. The applicant amends his hours of operation to close Sunday-Thursday to stop liquor sales at 12:30 A.M. and the rest of the business closes at 1 A.M., and Friday-Saturday everything stops at 1:30 A.M. Ald. Brostoff moved to amend the application as stated. Prevailed. 5-0 Ald. Chambers move to hold to the call of the chair. The committee took a short recess at 2:55 P.M. until 3:00 P.M. Atty. Ovbiagele amended the hours for Friday/Saturday to close at 1:30 A.M. and close Sunday-Thursday at 12:30 A.M. The hours were amended. Since the hours were amended as Ald. Taylor wished, she is amenable to a 15-day suspension. Ald. Brostoff moved approval with a 15 (fifteen) day suspension based upon the preponderance of the evidence in the police report that demonstrates the operation results in a threat to health, safety or welfare of the public and the aldermanic testimony.
