Resolution authorizing City entry into a Limited Term Conservation Easement Agreement with Milwaukee Metropolitan Sewerage District (MMSD) and Milwaukee Public Schools (MPS) for River Trail School at 12021 West Florist Avenue, in the 5th Aldermanic District.
Analysis
This resolution authorizes the City of Milwaukee to enter into a Limited Term Conservation Easement Agreement with Milwaukee Metropolitan Sewerage District (MMSD) and Milwaukee Public Schools (MPS) for the maintenance of Green Infrastructure at 12021 West Florist Avenue.
Body
Whereas, The City of Milwaukee is the owner of record of the River Trail School at 12021 West Florist Avenue concerning which the MPS Board has the duty of care, control and management under Wis. Stat. 119.16 (1m) and (3)(b) and Wis. Stat. 119.60 (2); and
Whereas, Green Infrastructure improvements will help divert stormwater from local sewerage systems; and
Whereas, MPS was awarded Green Infrastructure funding from the Milwaukee Metropolitan Sewerage District (MMSD) for said improvements; and
Whereas, The agreement for said funding stipulated that the City and MPS shall enter into a conservation easement in favor of MMSD; and
Whereas, MMSD has drafted said easement which shall be in effect for a period of eleven years; now therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officials, including the Commissioner of Public Works, are hereby authorized: (i) to sign Limited Term Conservation Easement in the form and substance submitted to this file, or in substantially the same form and substance, as have been submitted to this file, and to effectuate the intent of this resolution; and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
