Individuals also present: Ald. Murphy thanked Mr. Crawford for reaching out to the neighbors and addressing the noise and other issues. He asked if the establishment is open on Sundays. The applicant said that they are not open on Mon, Tue and Wed. Ald. Minutes note: 13 COOK, Thomas M, Agent for "Pacific Bells LLC", Extended Hours Establishments and Food Dealer License Renewal Applications for "Taco Bell #31507" at 6268 S 27th St. (Expires 11/1/2023) Atty. Richard Donner appeared on behalf of the applicant. Atty. Donner said that the police filed no charges, that the employee was terminated two months after the incident after an internal investigation. Individuals also present: Ald. Coggs asked if this Taco Bell have minors working after the curfew hours. Jerry Zehr (employee) said that they do not have minors working after the curfew hours. Ald. Brostoff asked about details of the internal investigation. Atty. Donner said that the child and his father retracted from their accusations. Ald. Brostoff asked why the manager was fired if the child and his father retracted from thier accusations. Atty. Donner said that there were other factors that led to the employee’s termination. Ald. Brostoff asked what about the text messages that the police officers observed. Sgt. Velasquez said that there are pictures of the text messages that the police observed on the file. Atty. Donner said that he does not have those pictures on the file. Atty. Farris said that we must adhere to what was provided on the notice. Ald. Brostoff asked if the minor still works at the store. Atty. Donner said that the minor no longer works at the store and that he has no reason to doubt the accuracy of the police report but that the story changed after Pacific Bells conducted its own investigation. Ald. Spiker made a reference of the PA33 last long sentence and said that it contradicts the internal investigation result because the police report says: “I observed that both people admitted and texts confirmed that SOLANO provided alcohol to the victim, drank with the victim on the premises during working hours, and allowed the victim to smoke marijuana on premises while working.” Ald. Spiker asked Sgt. Velasquez if the last reference on the PA-33 is related to the text messages. Sgt. Velasquez confirmed it. Ald. Spiker asked Sgt. Velasquez to include those references in the police report because it would help him and the committee. Mr. Zehr said that they have a number of mechanisms in place to ensure the quality of the hourly and salary employees, that they conduct background checks and even make employees surveys twice/yr. Ald. Brostoff asked Mr. Zehr if knows why this manager was fired. Mr. Zehr said that he does not know. Ald. Coggs said for the record and for Atty. Donner, that the lack of charges does not eliminate the committee’s ability to decide disciplinary actions for the license. Ald. Pratt asked if the internal investigation took place because of the incident on the police report or for other issues. Atty. Donner and Mr. Zehr said that they do not know why the internal investigation took place. Ald. Brostoff said that there are many questions that must be answered and moved to hold the application to the call of the chair. Ald. Coggs asked Sgt. Velasquez to provide a copy of the entire report/file. Ald. Brostoff moved to hold the application to the call of the chair. There were no objections. (Prevailed 5-0)

Minutes note: 13 PATEL, Alpa N, Agent for "Alpa Corporation", Hotel/Motel License Renewal Application with Removing Stockholder for "Suburban Motel" at 4600 S 27th St. (Expired 2/7/2023) The applicant was present and said that there has been many changes since she is in charge, that they opened on March 2022, that they have more staff on a rotating basis, that they have attended the community meeting with MPD and that they have contracts with companies like WE Energies for people who come here for work. Individuals also present: Ald. Borkowski said that there are seven items on the police report since she took over after her father’s passing, that everything what the applicant said it’s too defensive. He said that to have a business is a privilege even if she pays taxes and that tax money is being spent on answering these calls for service, He added that the applicant is not showing any responsibility and that he thinks that this establishment must be out of business. Ald. Spiker said that there are two issues here: that they have been operating without a license since February and that the police has been there seven times since the license expired which is a big use of police resources. He added that even the police advise them to renew the license. Ald. Spiker recommended the applicant get security and that a fifteen day suspension will allow her to get it because there is no way that she can operate the way she is doing it right now. Ald. Chambers asked how many long term residents they have. The applicant said that about 20%. Ald. Chambers said that he is also frustrated with the answers and that he does not see a plan to move forward. The applicant said that her father’s passing happened too soon and that they were not prepared in many ways but that she is trying to catch up. Ald. Chambers said that the applicant did not make it any better today and that he thinks that she should have hired security right after the first incident. He also said that the he does not agree with the 15 day suspension recommended by Ald. Spiker because the applicant needs some time to work on a plan of operations to correct all these issues. Ald. Chambers moved approval with a 30 day suspension based upon the preponderance of the evidence in the police report and the applicant testimony that demonstrates the operation results in a threat to the health, safety or welfare of the public. There were no objections. (Prevailed 5 0) Ald. Spiker asked Sgt. Velasquez to enforce this item since they have been operating without a license as stated by the own applicant.

Minutes note: 09 KAUR, Charnjit, Agent for "5132 STARK INC", Class A Malt & Class A Liquor, Food Dealer and Weights & Measures License Applications for "STARK FOODS" at 5132 W MILL Rd. The applicant was present along with Atty. Andrew Arena. The chair licenses called both applications together after polling the people present. They are all here for both applications. Individuals in opposition: Mrs. Perkins - Mother and Daughter Childcare Center – 5001 W Mill Rd - said that the traffic is already bad, that they needed to change the entrance to the rear for traffic and security reasons and that having people intoxicated around and/or buying alcohol will increase potential dangers. Ald. Coggs asked how far her daycare center from this location is. The applicant said that her daycare is open from 5 am to 10 pm and that it is 375 feet from the premises. She added that there are other daycares on the block and one across the street. Shirley Truman – 6466 N 52nd St – said that she is concerned about the garbage that is thrown at her yard, that she does not have a problem with the parents and children that attend the boxing club but with the people who hold private events (they are the ones that thrown bags with garbage around). She also said there are too many kids around to have a liquor store. Ald. Coggs asked the applicant and her attorney to explain what they are trying to do. Atty. Arena said that it won’t be a nightclub nor a liquor store. He added that the store will have 85% of food items (including fresh food options), with no alcohol advertisement and that they will offer only beer and wine. He added that the café will be a separate business entity with internet-wifi (cybercafé) that will offer coffee early in the morning and will serve alcohol after 11 am. He clarified that it won’t be a tavern, that it will close e at 7 pm and the grocery store will close at 9 pm. The applicant said that she has 12 cooler/freezer doors with fresh meats, fruits, vegetables, dairy products and that only 3 doors will be for beer and wine. Ald. Borkowski moved to amend the plan of operation to specify that no more than 3 cooler doors can have alcohol. There were no objections. Ald. Chambers moved to amend the plan of operations to specify that no liquor advertisement will be displayed on windows and that the Class B will close at 7 pm. There were no objections. Robert Turtin - 4104 W. Keenan – said that he has lived there for 43 years, that he hears gunshots, that there are too many liquor stores in the area, that he received flyers for townhall meeting but could not attend. Thomas Tillman - 6446 N. 52nd St – said that he is concerned about parking, the lack of parking signs, the corner is dangerous with cars parked up to corner, the litter and to go cups from the store thrown on the ground by customers/patrons. He also said that he received town hall flyer but cannot attend meeting. He added that he would support a café. Santana Delarosa - 5217 W Mill Rd (residence and daycare), 5225 W Mill Rd (group home) – he said that he was told that the store was for food retail and not for liquor, that he has a childcare business across the street, that traffic is a concern with their daycare at the front of the home. Thomas Williams – 5506 N 52nd St – said that he objects to the liquor store and that he has no objection for the food store and that coffee shop. Individuals in support: Tracy Dent – 1725 N Prospect – said that he is here as a community partner. He added that the applicant is a business owner who hires people from the neighborhood to do the clean ups, that she is very professional, that she supports the community in different ways and that the internet café is an excellent idea. Ald. Chambers asked the applicant if she runs background checks. The applicant said that she does, that she has been running businesses for 35 years without any issues or citations for selling to minors. Kirby Lockett – owner of the current business – said that he bought & beautified the building and apologized to the neighbors who have experienced the trash issue. He added that on the last two years, he has had elderly/old neighbors walking to his establishment to buy beer to watch a game for example. He said that he approached Mrs. Kaur to ask what they could do in order to address the neighborhood needs due her business background and experience. He also said that he hasn’t had any incidents or issues with his business. Tenisha – 2155 N 52nd St - said that the applicant has a very good reputation running her businesses and that it is going to be great for the neighborhood. Mrs. Dillard - 4644 N 46th St – supports the applicant as employee and neighbor. Milton Scott – N 49th St – said that he works with the applicant and that he is part of the cleaning staff. For the record: a total of 16 residents were present in support of these applications. Individuals also present: Ald. Taylor said that she is trying to do things that are better for the community and by working together, they have come up with a plan that fits the community. She added that the people who came to the neighborhood meeting agreed with the proposed business plan for both applications and that she recommends moving forward. Ald. Chambers asked how many people attended the neighborhood meeting. Ald. Taylor said that they mailed out 270 letters and that 6 people showed up. Ald. Pratt moved to amend the plan of operation to clean up twice/day in consideration to the neighbors who came to testify in opposition. There were no objections. Ald. Chambers moved to amend the hours of operation of the store from 8AM to 9PM and for the coffee shop from 6AM to 7PM and to serve liquor staring at 11 am. There were no objections. Ald. Taylor asked to remove all types of entertainment except for poetry readings. Ald. Chambers moved to amend the types of entertainment to only poetry readings. There were no objections. Ald. Maistelman said that there is a pandemic of gun violence in the city, that there are certain things that they can do but also things that they cannot do like to stop someone trying to carjack someone’s car. The applicant said that they always advocate for safety and that since these incidents happened he and/or his father are there everyday, 3-4 hours from 6pm to midnight, that the incidents happened while his security went to grab some food (15-20 min). He added that they not condone any kind of disruptive behavior, that they are part of the community and they do what they can to keep a safe environment. Ald. Borkowski said that he heard the applicant saying that these incidences happened while the security guard was not there. The applicant said “yes”. Ald. Borkowski said that he has a hard time believing that. The applicant said that they used to have security after 4pm everyday and that the security is there after 2pm everyday after the incident happened. Amandeep Sandhar (father) - said that he is there everyday and that he is the property manager as well. Mr. Sandhar said that for the first incident, there was a car blocking the gas pump, that they approached them and that the guys from the vehicle told them that they were waiting for somebody to buy gas. He added that he was back in the store when somebody came in saying that his car was stolen. Mr. Sandhar said that they called the police and cooperated with the investigation. He continued saying that the second incident happened in between the shifts of the security guards, that one of them was late picking up food and while the customer was pumping gas on pump #5, a car driving on N 35th was shooting along the way and that is why got hit. He also said that he is at the store everyday twice/day, that it is a nice neighborhood and that he did not get any complaints before. Ald. Borkowski said that these incidences are major. Mr. Sandhar (father) said that they are major incidences and that their lives are also at risk and asked Ald. Borkowski how can they stop a guy driving on 35th and shooting from the car. Baker said that as unfortunate as it is, these are the issues that plague this type of premises in the city of Milwaukee and that unfortunate or fortunate for some applicants; these types of issues don’t come in the police report because they don’t call the police. She added that for this instance, a lot of these items are issues with loitering, theft and shop lifting and that this business has tried to take a proactive action by calling the police. She also said that they have trained the staff this way to ensure that they are the ones reporting the incidences with the fear that they failure to report will be seen as looking corroborative of the crime that is occurring. Atty. Baker continued saying that the station is well lit, that it has 32 security cameras working all the time and that the footage is provided to MPD when incidences occur. She added that it is not her client’s intention to have MPD acting as a sole entity policing these actions. Individuals also present: Ald. Pratt said that the committee is not holding the number of calls against the applicant but that there are 21 calls which means that instead of coming up with a strategy internally, the applicant is using MPD as private security. She asked what are the plans to stop these incidences. Atty. Baker said that it is hard to find security (insured & bonded) right now and that she knows that the committee is not happy with her response. She added that applicant is seeking for security at this time, that her client is training employees to mitigate these type of actions by trying to close the store if they are noticing an increase in individuals who are loitering or coming in to steal just to calm down tempers a little bit. Atty. Baker said that additionally, they are filing restraining orders against some individuals but she also pointed out that some of those persons are homeless and that they are unable to get served. Ald. Pratt said that there is no plan then. Atty. Baker said that there is a plan on training employees and closing the store when issues that arise and to secure security. Ald. Pratt asked when the training for employees started. Atty. Baker said that it started this summer. Ald. Pratt asked if the training addresses other strategies opposed to call MPD. Atty. Baker said that it is correct. She also mentioned that some of the issues are from the customers of the bar across the street after they leave and come to the store. Atty. Pratt said that she recalls an incident from the bar across the street that it occurred at the gas station and that she does not see it on this police report. Ald. Borkowski asked the applicant how he feels about the 21 incidents on the police report. The applicant said that there are minor issues like shoplifting. Ald. Borkowski asked the applicant if he thinks that he has ownership of his business and the surroundings of the property. The applicant said that he did not understand the question. Ald. Borkowski said that he does not know how this can be tolerated. The applicant said that it could have happened everywhere in the city. Ald. Borkowski said that 21 incidences in less than a year does not happen everywhere. Ald. Coggs said that we know that there are challenges across the city but that there has to be something that can be done at this property that would eliminate the need for so many calls for service. She added that the committee understands that they are not responsible for everything but saying that they are looking for a security guard is not enough at this point. She added that the committee did not hear as much as the applicant can do to avoid being here next year with 22 items on the police report. She said that the lack of a plan only adds another lay of frustration to the committee members. Ald. Pratt said that this neighborhood has a very active neighborhood group, that as a matter fact, there is a police officer who lives there and that they are very involved. Ald. Brostoff suggested talking to the neighborhood association since he does not live in the area because it is an opportunity to shift things for him and his business. He added that the applicant has many immediate assets to turn things around. The applicant said that he goes to the neighborhood meetings. Ald. Pratt said that she has not seen him there. Ald. Pratt said that from what they spoke before and given the nature of the calls, asked the applicant to close from to 2AM to 5AM to get rid of at least 10 of the calls that he made and as a means to avoid those late hours issues. She added that the community cannot stand these issues and recommended a 10 day suspension. Atty. Baker said that 23 calls is nothing to be proud of, that the applicant is not blaming the neighborhood, that he is trying to continue his efforts to correct those issues and that following Ald. Pratt’s recommendation of closing from 2AM to 5 AM will alleviate some of the issues as well. She also said that she agrees with Ald. Brostoff’s suggestion. Ald. The applicant was present and said that the violations on the police report are from a rental property that she purchased about two years ago and that since then, she has been receiving those types of citations. Individuals also present: Angela Zoll - 2410 E. Oklahoma Ave. – said that this is a residential area and she opposes to the bands, disc jockeys and instrumental music. She also said that she knows that it will end up with loud music and traffic, that it is not appropriate for this area. Jason Hill - 3115 N. Delaware Ave. – said they are using his alley/driveway to park their vehicles. Ald. Chambers said that the alley is a public way. Ald. Dimitrijevic said that they are requesting a consideration to the neighbors to not to have outdoor music and to close earlier during the week. She added that the applicant is a business owner and that she would like to hear about the use of the alley as well. Mr. Turner – Manager – said that the liquor store shares the alley as well and that they are willing to reconsider the PEP application. The applicant said she applied for the PEP just to have that option available if needed and that she is willing/wants to work with the neighborhood. Ald. Brostoff said that it seems that this business is going to be a good addition to the area and that the applicant is willing to compromise. Ald. Chambers moved to hold the Public Entertainment Premises application and to work on temporary permit events basis to show the neighbors that they can handle those types of events.
