Resolution authorizing the Village of Menomonee Falls to provide water service to a property in the City of Milwaukee.

Analysis

This resolution authorizes the Commissioner of Public Works to enter into an agreement for the provision of water service to 9168 N. 124th St. in Milwaukee by the Village of Menomonee Falls Water Utility.

Body

Whereas, Zignego Company, Inc., the owner of the commercial property located at 9168 N. 124th St. in the City of Milwaukee has requested the Village of Menomonee Falls to furnish water at retail through the distribution system of the Village of Menomonee Falls; and

Whereas, The property located at 9168 N. 124th St. in the City of Milwaukee cannot practicably be served by the Milwaukee Water Works; and

Whereas, The Village of Menomonee Falls, being a wholesale water customer of the Milwaukee Water Works, is restricted by a water service contract with the City of Milwaukee from reselling water without the permission of the City of Milwaukee; and

Whereas, Pursuant to City of Milwaukee Resolution No. 890791 and Menomonee Falls Resolution No. 582-89, the City of Milwaukee and the Village of Menomonee Falls executed an Agreement for Water Service dated November 16, 1989 providing that Menomonee Falls would furnish water to 9168 N. 124th St., as a retail customer, but the previous property owner did not execute the agreement; and

Whereas, The Milwaukee Water Works will receive revenue at wholesale rates if the Village of Menomonee Falls Water Utility serves the customer; and

Whereas, Under the agreement, the City of Milwaukee shall have the right to require the customer to detach from the Menomonee Falls water supply system and re-connect to the Milwaukee Water Works water system at no expense to Milwaukee Water Works if it becomes economically feasible and convenient for Milwaukee Water Works to provide direct water service to th...
