Analysis
This ordinance authorizes the City of Milwaukee Employes’ Retirement System to be the City’s agent for the Wisconsin Retirement System.
Body
Whereas, 2023 Wisconsin Act 12 was enacted on June 20, 2023; and
Whereas, 2023 Wisconsin Act 12 imposes changes upon the retirement systems of 1st class cities that adopt a sales and use tax ordinance under s. 77.701(1), Wis. Stats.; and
Whereas, The City of Milwaukee adopted a sales and use tax ordinance under s. 77.701(1), Wis. Stats., on July 11, 2023; and
Whereas, Chapter 36 of the Milwaukee City Charter must be amended to conform to the various requirements of 2023 Wisconsin Act 12, including closing the Employes’ Retirement System to new members after December 31, 2023; now, therefore
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 36-15-1-f of the charter is created to read:
36-15. Administration.
1. ANNUITY AND PENSION BOARD
f. The annuity and pension board is authorized to perform administrative work necessary to carry out the duties of the city’s designated Wisconsin retirement system employer agent, alternate employer agent, and retirement contact, and to conduct Wisconsin retirement system eligibility determinations and reporting, as appropriate, provided it is compensated by the city for the actual cost of the work performed.
Part 2. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed and provided in s. 66.0101(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
