Atty. Stephen Jamieson appeared on behalf of the applicant. Atty. Jamieson said that they have made great progress meeting with the police and Ald. Spiker. Sara Butler appeared on behalf of the applicant who said that she knows that the first citation was paid and that she will follow up for the second one which surprises her that it is in a warrant status now. She also mentioned that Walgreens has a strong presence in the community. Individuals also present: Ald. Borkowski said that he is very disappointed with Atty. Butler’s answer because the incidents happened within 2 weeks. Ald. Zamarripa said that she disagrees with Atty. Butler statement about Walgreens having a strong presence with the community because they are selling tobacco to minors, there are empty cardboard boxes and wood pallets piled up and that she does not see the same things happening on Brookfield or Bay View. She added that the neighbors are upset for this and the traffic. Sgt. Velasquez said that these citations were not given to this specific location. Mr. Cooney said that he will work offline with Sgt. Velasquez on this matter. Ald. Chambers asked what is the cleaning procedure at this location following up what Ald. Zamarripa just mentioned about the traffic and wooden pallets. Atty. Butler said that she does not know it but that it must be similar to other locations. Ald. Coggs said to Ald. Zamarripa that we could hold this application until Common Council so she can get what she is looking for. Ald. Zamarripa said that these are huge corporation businesses that make a lot of money from constituents, which is fine, but that she expects the same level of pride, as at other municipalities because the constituents deserve it. Ald. Borkowski said that it is disappointing to hear that Walgreens do not treat customers respectfully and equally and said to Atty. Butler that this committee will hold each store accountable. Ald. Brostoff said that Atty. Butler was not prepared with the basic information for the hearing and that Ald. Zamarripa only wants to build a better relationship. Ald. Mr. Moriah said that the applicant always help people when they are short of money and that for the item on the police report, they guy wanted free beer, the applicant denied the beer and the guy showed him a gun and that the applicant fought for his life. Ald. Borkowski asked what are the preventive measures to avoid pulling out a gun. Mr. Moriah said that nothing and that the applicant is good with the police too. Ald. Borkowski said that we have many issues involving firearms in the community and asked the applicant if he agrees. The applicant said that he agrees. Ald. Borkowski continued saying that this committee needs to know about proactive ways to avoid wild west situations and to help business owners and neighbors to be safe. He asked the applicant what proactive steps or measures has taken. The applicant said that nothing. Mr. Ellzey, LSA for Ald. Stamper said that this business is in a difficult location, that he understands that the applicant needs to protect his business with a gun on premises; that he has suggested to hire a security guard and that there has been no response. Ald. Coggs asked the applicant if he is willing to hire a security guard. The applicant said that he is willing to have one. Ald. Chambers moved to amend the plan of operations to have a security guard (licensed and bonded) on premises, seven days a week from 3pm to 9pm. There were no objections. Ald. He said that his people identified the person carrying the gun because someone bumped into him. He also said that this is reason why they started wanding all patrons. He also mentioned that he acquired the same system as Potawatomi Casino (EVOLV) and that they have not had any issues since then. 71. He said that they had no indication that the patron was intoxicated. 73. He said that customers were throwing drinks to each other’s face and that they were separated before escalation. 74. He said it happened outside the premises. 75. He said that this item is not related to them as they were not open that day and that it occurred at a different address. He summarized that they do not operate at full capacity and that the gun incident pushed them to invest just to keep the patrons safe. He added that his security staff are trained properly and that they are always cooperating with the police. Individuals also present: Ald. Borkowski said that it is easy to criticize but that the applicant is part of the solution and thanked him for being proactive. Ald. Bauman said that guns inside establishments are one his mayor concerns and that given the proactive behavior of the applicant, he said that he feels comfortable moving forward with a warning letter. (Expired 7/17/2023) The applicant was present along with Atty. Ajit Walia who said they have been in the area for 40 years and that the item on the police report belongs to the last license period. Mr. Cooney said that this item did not make it to the previous license’s period police report. Atty. Walia said that they have worked with Mr. Kendall, that they have found common ground, and that he committed to come to the neighborhood meetings, to communicate more and to serve better to the people. He said that he is going to make sure that his staff treats everyone equally. Individuals also present: Ald. Bauman asked the applicant why the staff did not call the police. The applicant said that they provided the video to the police. Ald. Bauman clarified that the employee did not call the police. The applicant said that the staff did not hear the shots because he is behind a bulletproof glass. Individuals in opposition: Kendal Breunig – said that he lives across the street from the gas station, that he is member of the BID and also agent for some alcohol licenses over there. He also said that he met with the Walia brothers and that he has now their current telephone numbers. He added that he is not against the license but to the late hours that have become an issue for the neighbors. Ald. Bauman asked Mr. Kendall if he is in opposition of the extended hours licenses on the weekends. Mr. Breunig said that he is in opposition of the extended hours on the weekends. Sally – 313 N Plankinton Av 413 – said that she lives right above the gas station, that her windows face this business, that during the week is fine but the weekends are bad with the noise, the sound and the crowds. Ald. Bauman asked Ms. Sally if the disturbances are only during the weekends. Ms. Sally said that the disturbances happen only during the weekends. Lisa Back – Pritzlaff Lofts, Building Manager – said that she does not reside there but that she has received a lot of complaints from tenants about people dancing on top of the cars like if they were filming videos with loud music and noise. Ald. Bauman asked Ms. Back how many complaints she receives every week. Ms. Back said that she receives from 4 to 5 and that she has not shared the videos submitted by the tenants at all answering Ald. Borkowski question. Dale Christiansen – 313 N Plankinton Av 411- said that they have lived there since 2020 and that the business is good cleaning up inside and around the premises. He added that he has a video of the shooting from the police report. He added that his and wife’s sleep has deteriorated because of the loud weekends at the gas station and that they need a small adjustment. The applicant said that this is the first time that he is hearing about all these issues with neighbors and that he wants to work with the neighbors. Ald. Bauman said that 100% of the noise during the weekends comes from the gas station and that the congregation is evident during the weekends and that he does not have complaints during the week. He added that this is not acceptable, that he is not supporting the renewal of the extended hours for Fri and Sat because it will be clear if these congregations are trespassing if the business is closed. Teresa Buck – 1220 E Locust – she said that she lives across the store and that since 2015, she has been asking the store to clean it but that they prefer to pay a fine instead of compliance by placing the garbage dumpster on the shared right of way. She added that from her windows, she has witnessed drug deals, people urinating and even having sex. She added that this open and unlocked dumpster is inviting to dumpster divers at any time and that they are disturbing the neighborhood. Atty. Randall asked Ms. Buck if she has seen changes lately. Ms. Buck said that she has and that she is trying to trust the manager but that the dumpster still there open and that she hopes that they get the dumpster behind the gate and locked. Ald. Brostoff said that he wanted to thank the neighbors, that Atty. Randall is very respectable on what he does and that the district manager has been responsive. He also said that the store has taken steps forward but that he still hearing from neighbors. He added that he has seen significant changes on the last 15 days but asked what about with the other 350 days. Mr. Connelly – DNS – said that there are two open orders for this store: 1. The garbage 2. The dumpster is not locked and is not put away Ald. Brostoff said that he heard from dozens of residents about how the staff mistreated customers and that they do not feel that they respect the neighborhood. He added that even with the best of this client’s intentions, they submitted a presentation where on page 3 is clearly that they still on violation with the dumpster. He added that even after the big clean up, they still showing the same behaviors. He added that the organization has been disrespectful to the community that they are making money from and that even after the meeting, neighbors still contacting him with bad experiences at the store. Atty. Randall wanted to verify with Mr. Connelly if the dumpster is on private or public property. Mr. Conelly said that it is on private property according to the last inspection. Atty. Randall said that it is due a e-mail notice to vacate the alley from 2001 and asked Mr. Connelly if the property owner has been notified about the citations. Mr. Conelly said that he has. Atty. Randall shared a supplemental plan of operations and talked about it to the members. The manager store said that she cannot change the past but that she is committed to hire staff who cares about the customers, neighbors and their own jobs. He also said that staffing should be done based on the community needs and not on the amount of dollars that are sold. Atty. Individuals in opposition: Brian Smith – S. Delaware Av – he said that he lives in a residential block and that the hours have changed since Covid because before it was a restaurant and now it is more like a bar. He said that he is surprised that there is no police report because he has called and the last one happened about three weeks ago. Sgt. Velasquez said that there is call from September 10th and that MPD was not able to get there. Mr. Smith said that he talked to the police and even shared the video of the incident that he reported. He added that they are tired of picking up bottles, that there is people pre-gaming before they get in, that he has called the police, that he has called Ald. Dimitrijevic’s office and that she has not returned the calls. He also said that he took time off to be here today because it is an important matter to him. He said that he is against of the alcohol license. Micah Oge – 3023 S Delaware St - said that they have lived there for 7 year now and that this establishment shifted to bar operations after the pandemic. He added that patrons fail to stop and yield on the street, that there’s people arguing over parking spots, that patrons congregate on the street; that they are very loud and sometimes those arguments escalate and then they drive away upset. He also said that sometimes patrons sit at their yards and that they are tired of picking up garbage, empty bottles and the disruptive behaviors of the patrons. He added that he has been able to document all of these behaviors with videos and that he has reported some of the issues to the police. He said that he is also surprised that there no record nor police report. Ald. Dimitrijevic asked the neighbors if a reduction of the hours would be beneficial to them. Mr. Oge said that they observe the same behaviors from 9pm to midnight and during the day on Saturdays. Mr. Smith said for the record, that this location already has a disc jockey. Jinx Oge – 3023 S Delaware St – said that they welcomed this business in their community as a restaurant and that now they are promoting party behaviors instead. He added they go to sleep with a clean yard and that they wake up with litter and even drinks in the yard. He said that these behaviors happened at any time and that they did not sign up for this. He is also amazed that no record of the calls that they have made to the police report. Andrew Bunk - 3052 S Delaware St – said that he has talked to the applicant about two incidences and that he filed a police report as well. He said that one of the incidents was a death threat made by three patrons, that one of them is actually a regular of the establishment and that the applicant knows him. The other incident was about that someone placed 3 empty bottles by his yard so he went and put them back in front of the establishment’s door, when someone (who was not even an employee) came out and started to yell at him. He added that he has seen people vomiting in front of his house and then driving away. Ald. Dimitrijevic said that she was able to locate Mr. Oge’s email and that she will talk to the district captain’s because it is very hard to have a case without this information. Individuals also present: Ald. Brostoff asked Mr. Bunk if there was follow up with the applicant. Mr. Bunk said that there was a follow up and that he was called different words while he was there. Ald. Dimitrijevic asked the applicant if she has had disc jockey without a license. The applicant said that she has had DJ. Ald. Dimitrijevic said that it is very disrespectful to the neighbors and that she did not know that the neighbors were in communication with the applicant. She recommended the applicant to reconsider her business model and to add security guard. Ald. Dimitrijevic recommended renewal with a 10 day suspension. The applicant said that she has a lot of support from other community members who like the food, that she cleans up every day, that she cares about the neighborhood and that she does not want to have a bad reputation. Ald. Dimitrijevic asked the applicant to find balance and harmony and; that it does not seem that the applicant is taking serious these neighbors’ requests and that she hopes that the applicant does not take it personally and rather go into action. Ald. Brostoff said that he thinks that these testimonies are not been taking seriously by the applicant and that he all heard was only confrontation from the applicant. Ald. Brostoff moved renewal with 15 day suspension based upon the preponderance of the evidence in the neighbors, applicant and aldermanic testimony that demonstrates the operation results in a threat to health, safety or welfare of the public.
