Analysis
This resolution amends the City’s contract with outside counsel, Halling & Cayo, in the amount of $25,000 in the matter of Andrade v. City of Milwaukee regarding discipline by the Fire and Police Commission.
Body
Whereas, Halling & Cayo served as outside counsel representing the City of Milwaukee in an action taken by the Fire and Police Commission to discipline and terminate former Police Officer Erik Andrade; and
Whereas, Outside counsel successfully prevailed at the circuit court and appellate courts in favor of and behalf of the City; and
Whereas, Mr. Andrade petitioned the Wisconsin Supreme Court, the Court accepted his Petition for Review, and the case is scheduled for hearing before the Court for oral argument on October 9, 2023; and
Whereas, Amending the existing contract for outside counsel to conclude litigation in this matter is recommended due to Halling & Cayo’s subject-matter expertise in the case; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are authorized and directed to amend the existing contract with Halling & Cayo to extend litigation through completion; and, be it
Further Resolved, That the contract is amended by increasing the dollar amount by an additional $25,000.
