Title

Resolution approving a Land Disposition Report and authorizing the sale of the City-owned tax deed properties at 4100-02 North 22nd Street and 2142 West Atkinson Avenue to Wisconsin Community Services, Inc., in the 1st Aldermanic District.

Analysis

This resolution authorizes the sale of City-owned Development Properties at 4100-02 North 22nd Street and 2142 West Atkinson Avenue according to the conditions in a Land Disposition Report, pursuant to Milwaukee Code of Ordinances Sections 304-49-5 and 304-49-8, to Wisconsin Community Services, Inc. to be developed as green space and to be combined with the Wisconsin Community Services, Inc. permanent supportive housing property at 4110 North 22nd Street.

Body

Whereas, The City of Milwaukee (“City”) acquired 4100-02 North 22nd Street and 2142 West Atkinson Avenue (the “Properties”) through property tax-foreclosure in 1979 and 1974 respectively; and

 

Whereas, Wisconsin Community Services, Inc. or its Department of City Development approved assignee (the “Buyer”) submitted an unsolicited proposal to purchase the Properties to create a greenspace with benches and trees for its residents and neighbors to enjoy as summarized in a Land Disposition Report and Due Diligence Checklist, copies of which are attached to this Common Council File; and

 

Whereas, Section 304-49-8 of the Milwaukee Code of Ordinances allows the City to accept unsolicited offers to purchase property when the City receives fair compensation, whether monetary or non-monetary; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Land Disposition Report is approved and the Department of City Development (“DCD”) is authorized to enter into a Purchase and Sale Agreement with the Buyer, or its assignee, materially consistent with the Land Disposition Report, and then convey the Property to the Buyer in accordance therewith; and, be it

 

Further Resolved, That the Commissioner of DCD, or designee, is authorized to sign a Purchase and Sale Agreement, deed and requisite closing documents and to close the transaction and to take such actions, as may be needed, to effectuate the terms of the Land Disposition Report and this resolution; and, be it

 

Further Resolved, That the sale proceeds, less sale and marketing expenses and a 30 percent disposition fee to the Redevelopment Authority of the City of Milwaukee, shall be credited to the Delinquent Tax Fund.
