Minutes note: 07 GARCIA, Jennifer, Agent for "ON THE GO BARTENDING LLC", Class B Tavern, Public Entertainment Premises and Food Dealer License Applications Requesting Disc Jockey, Jukebox, Bands, 5 Amusement Machines and 1 Pool Table for "RILLEY'S TAP II" at 4532 W BURLEIGH St. The applicant was present and said that she mentors teen girls in a home group and that she received the ticket for truancy. Individuals in opposition: Tameka Fullwood – 3145 N 40th St – said that the bar has been having live bands all summer and that she supports it but with a time limit because neighbors must go to work the next day. She added that 9PM would be a decent hour for the workdays. The applicant said that she does not have a problem adjusting the time on Sundays because she wants to be ok with the neighbors. Ald. Rainey asked what is the penalty for having live bands performing without a license. Mr. Cooney said that it would be citation. Ms. Martin said that the provisional license expired on May 19, 2023 and the regular license expired on March 2023. Ald. Rainey asked if the citation could be issued retroactively. Sgt. Velasquez said that the citation could be issued retroactive if the applicant provides the dates when the violation occurred. The applicant said that she has DJ only on Fridays from 6PM to 9PM, Bands only on the weekends until 10PM on Sat and until 9PM on Sun. Ald. Rainey asked that the record reflects what the applicant just mentioned. Ald. Pratt moved to amend the application to have DJ from 6PM to 9PM only on Fridays, Bands only on Fri & Sat until 10PM and until 9PM on Sun. There were no objections. Ald. Rainey asked if there is a noise permit for having the bands on the patio. Mr. Cooney said that DNS issues that permit. Sgt. Velasquez agreed with Mr. Cooney. Ald. (Expires 9/22/2023) The applicant was present and said that the cashiers and managers are always cooperative with MPD, that they make sure that the surveillance cameras are always working and that they have upgraded the lighting to avoid loitering around the premises. Individuals also present: Ald. Chambers said that this particular business is across the street from his district and asked what steps the applicant has been taking to avoid the aggressive panhandling that has been reported to his office often and the possible camping that they do on the car wash area. The applicant said that they have cut down the trees behind the carwash to have all the visibility and that they are building a fence along the large line so these people don’t have a place where to stay/hide. He added that they’ll have cashiers checking around the premises as well. Ald. Chambers asked the applicant how often they clean around the premises. The applicant said that as needed. Ald. Chambers said that it is not happening and that he hopes that the applicant keeps in mind that consistent cleanups are needed as well. The applicant said that he will do it. Ald. Borkowski moved to hold the application to the call of the chair at 9:52 am. Ald. Borkowski moved to reconsider the application 9:56 am. Mr. Schmidt said that Ald. Murphy has received a couple of calls in objection but that he needed to know if there was anybody here to testify. Ald. Coggs said that no one is present to testify at all. Mr. Schmidt said that Ald. Murphy has no objections since there are no neighbors present. Ald. Individuals in support: Kirk Lupton - 6160 S 6th St – said that the applicant has been trying to bring up the location with updates of every kind. He added that the applicant has no connection with the previous owner, that he has talked to some neighbors and that they have no issues with having this hotel back and up again. Individuals also present: Ald. Spiker asked what is the relation between Mr. Lupton and the applicant. Mr. Lupton said that he has advised the applicant on how to run another business (gas station) successfully with no remuneration. Mr. Kumar said that they are looking to open a local hotel for the neighborhood with clean and secured premises. Ald. Chambers asked how they are taking customers in order to avoid human trafficking. Mr. Kumar said that they will be requesting a credit card to hold the room. Ald. Coggs asked if they are planning to train the staff on human trafficking issues and drug overdose. Mr. Kumar said that they will do trainings. Ald. Borkowski asked the applicant if he is aware about the previous owners activities listed on the police report. Mr. Kumar said that he is not aware and that those issues would not happen again. Ald. Spiker said that he had the chance to talk to the applicant who is not the actual owner and that this is a challenged place to run. He also said that his understanding is that the current owner is the cousin of the previous one and, that he asked for a plan on how to address the issues that happened with the past operation and that so far, he has not received it yet. He added that the applicant owns a gas station right out of this location which is managed well but that running a hotel is a different scope and that he is not in support of this application. Ald. Borkowski said to the applicants that they have a significant homework to do if they are pursuing this application and suggested to work with Ald. Spiker as well. Ald. The meeting paused at 10:30 am due a fire alarm. The meeting reconvened at 10:37 am. The applicant said that she was not aware that she needed to contact to Ald. Bauman and that she has a set up to sell clothes, shoes, tobacco and beer. Ald. Chambers asked what kind of store is this. The applicant said that it is a variety store with clothes, shoes, chips and beer. Ald. Chambers said that the application is for hard alcohol too. He also asked what kind of research she made after the police’s visit back in April. The applicant said that she contacted Ald. Stamper’s office as she was told. Ald. Bauman said that he has not received any communications from Ms. Skeets. Individuals in opposition: Lindsey St. Arnold Bell – Director of Near West Side Partners – said that they already have 3 establishments in the Concordia neighborhood that sell beer and that as a matter of fact, there is one around the corner of this location. She added that neighbors want food stores that offer fresh and healthy food options and that there is nothing like those options on this application. She added for the record that the organization is against all alcohol licenses at this location due saturation. Laura Sue Mosier – 3209 W Wells St – said that their neighborhood has changed a lot since the other alcohol license was denied because there are no more congregations and no more first bad impressions for the other businesses and hers, which is a bed and breakfast. Sally Maddick- 735 N 34th St – said that she has lived there for more than 30 years and that neighbors have been working addressing the issues with the liquor licenses in the area. She said that she agrees with the significant change since the closing of the other location. She also said that she has problems accessing to her property due bad driving practices of customers at the other businesses and that they do not need to deal with any more issues. Andrew Parker - 3026 W Wells St – said that they have lived there for 35 years, that he also runs a bed and breakfast at the same address. He added that the neighborhood won’t benefit from this business proposal in any shape or form. He also said that the neighborhood is going on the right direction and that they won’t take a step back. He also mentioned that he has a daily routine of cleaning garbage and alcohol bottles down the street and at his own backyard. Individuals also present: Ald. Bauman said that about 3-4 years ago this committee denied the license for another location with a lot of neighbors and testimonies in opposition. He added that the neighborhood has become a better place/neighborhood, that the neighborhood won’t go back, and that they do not need another food license for snacks that becomes garbage on the streets. He asked the committee not to grant these applications. The applicant said that she understands Ald. Bauman’s concerns but that she is not there to do any harm to the neighborhood. Ald. Chambers said that the applicant would need to do more homework and to talk to neighbors prior moving forward. He said that he does not think that the applicant is ready to run a business. Ald. Chambers moved denial based upon the applicant, neighborhood and aldermanic testimony. There were no objections. (Prevailed 5-0)
