Title

Resolution relating to an amendment to the contract between the City of Milwaukee (the “City”) and the law firm of Nathan & Kamionski, LLP (hereinafter LAW FIRM).

Whereas, the City and the LAW FIRM entered into a contract to provide legal services for the City in representing Milwaukee police department officers Matthew Goldberg, Timothy Heier, Gus Petropoulous, and Michael Braunreiter in the federal court action entitled Ladarius Marshall v. City of Milwaukee, et al., Case No: 22-cv-00525 (E.D. Wis), and

 

Whereas, the parties are desirous of an amendment to said contract to increase the amount of compensation as authorized in paragraph 8(e) of said contract. This matter was previously heard and approved of in closed session by the Judiciary and Legislative Committee.  We request that this matter be assigned for a hearing in closed session before the Finance and Personnel Committee to be followed by an open session in order to take action.

 

NOW, THEREFORE, in consideration of the mutual covenants hereinafter stated the parties do hereby agree to amend the contract as follows:

 

1.                     The parties agree that the not to exceed amount under sec. 8(e) of the contract shall be increased by an additional amount not to exceed $60,000.00.

 

2.                     The changes constitute the entire first amendment to the contract between the parties.

 

As this case has settled, and is awaiting finalization of settlement documents, the parties do not foresee additional requests for additional funds. All other covenants, provisions, terms and conditions of said contract shall remain in force unless further amended by mutual agreement of the parties.

 

IN WITNESS WHEREOF, the LAW FIRM and the CITY have caused this contract to be executed for an on their respective behalves as of the dates hereinafter set forth.
