Analysis
This resolution approves and authorizes payment in the amount of up to $65,000 to Foley & Lardner LLP for legal services in its ongoing and previously authorized representation of the City of Milwaukee in the case entitled United States ex rel. Dieter v. City of Milwaukee, Case No. 22-CV-240 (E.D. Wis.).

Whereas, On or about September 26, 2022, the City Attorney entered into a Contract for Legal Services between the City of Milwaukee and Foley & Lardner LLP for representation of the City regarding the claims made against it in United States ex rel. Dieter v. City of Milwaukee, Case No. 22-CV-240 (E.D. Wis.); and
Whereas, The original certified resolution attached to the file authorized payment in an amount not to exceed $125,000; and
Whereas, The total cost of legal services is expected to exceed the prior agreed amounts in order to get the matter through a motion to dismiss the complaint and amendments thereto; and
Whereas, The City desires to pay Foley & Lardner LLP for the reasonable costs of its legal services that it has incurred and will incur in its representation of the City; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized to execute the First Amendment to Contract for Legal Services between City of Milwaukee, Wisconsin and Foley & Lardner LLP substantially in the form of Exhibit A attached to this file, for legal services relating to the ongoing representation of the City of Milwaukee in the case entitled United States ex rel. Dieter v. City of Milwaukee; and, be it
