A substitute ordinance relating to the retention of outside counsel by the office of the city attorney.

Analysis

This ordinance provides that office of the city attorney shall not retain any law firm or attorney who is not an employee of the city without prior authorization from the common council.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 304-23-0 of the code is repealed and recreated to read:

 

304-23. Outside Attorney or Law Firm. The office of the city attorney shall not retain any law firm or attorney who is not an employee of the city without authorization of the specific attorney or firm from the common council.  The name and qualifications of the firm or attorney proposed to be retained by the city attorney shall be provided to the common council with each request, along with information describing the purpose of the representation, the nature and scope of the tasks to be performed, and the terms of the retainer agreement. Each retainer shall be pursuant to a written agreement, including a covenant prohibiting the retained law firm or attorney from undertaking or continuing representation of any person or entity in connection with any claim, proceeding, lawsuit, or other matter against or adverse to the city during the period the law firm or attorney is retained. The provisions of this section may be suspended or modified by common council resolution.
