Title

An ordinance relating to various zoning application and plan-review fees.

Analysis

This ordinance:

 

1.  With respect to the fee for plan review in a development plan overlay zone or a site plan review overlay zone, which is currently $1,500, creates a 2-tier fee structure:

 

a.  The fee shall be $1,500 for plan review relating to new construction of a primary structure or to substantial improvements, including substantial alterations to an existing building or site.

 

b.  The fee shall be $500 for plan review relating to any site work that is not a substantial improvement to a primary structure in a development incentive overlay zone or a site plan review overlay zone, or relating to a use requiring city plan commission approval that does not include new construction or a substantial improvement in a development incentive overlay zone.

 

2.  Clarifies that the application fee for creation of a master sign program overlay zone or a neighborhood conservation overlay zone shall be $2,500.

 

3.  Increases the application fee for a deviation from a performance or design standard of an overlay zone from $150 to $500.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 200-33-69-b of the code is repealed and recreated to read:

 

200-33.  Fees.

 

69.  ZONING, PLAN COMMISSION/COMMON COUNCIL.

 

b.  Overlay Zone Plan Review.  b-1.  The fee for plan review relating to new construction of a primary structure or to substantial improvements, including substantial alterations to an existing building or site, in a development incentive overlay zone or a site plan review overlay zone shall be $1,500.

 

b-2.  The fee for plan review relating to any site work that is not a substantial improvement to a primary structure in a development incentive overlay zone or a site plan review overlay zone, or relating to a use requiring city plan commission approval that does not include new construction or a substantial improvement in a development incentive overlay zone, shall be $500.

 

Part 2.  Section 200-33-69-c-2 of the code is amended to read:

 

c.  Zoning Amendment.

 

c-2.  The fee for a zoning map amendment to create a development incentive overlay zone [[or a]] >>,<< site plan review overlay zone >>, master sign program overlay zone or neighborhood conservation overlay zone<< shall be $2,500. The fee for a zoning map amendment to amend an existing development incentive overlay zone or site plan review overlay zone shall be $1,500.

 

Part 3.  Section 200-33-69-e of the code is amended to read:

 

e.  Deviation from a Performance or Design Standard of an Overlay Zone.  The application fee for a deviation from a performance or design standard of an overlay zone shall be [[$150]] >>$500<<.
