Title

Resolution authorizing City entry into Green Infrastructure Conservation Easement with the Milwaukee Metropolitan Sewerage District and Riverworks City Center LLC at 450 East Townsend Avenue in the 6th Aldermanic District.

Analysis

This resolution authorizes the City of Milwaukee to enter into a Green Infrastructure Conservation Easement with the Milwaukee Metropolitan Sewerage District (MMSD) and Riverworks City Center LLC (Riverworks) for grant funded installation of green infrastructure at 450 East Townsend Avenue.

Body

Whereas, The City of Milwaukee is the owner of record of 450 East Townsend Avenue, a segment of the Beerline Trail, and Riverworks is owner of the adjacent 3334 North Holton Avenue; and

 

Whereas, The City and Riverworks previously entered in to a drainage easement agreement for the mutual benefit of the Riverworks parcel and the City parcel that was approved by the Common Council in Resolution File No. 210964; and

 

Whereas, Riverworks has constructed green infrastructure elements on said parcels; and

 

Whereas, The Metropolitan Milwaukee Sewerage District (MMSD) is willing to provide grant funding to Riverworks to reimburse Riverworks for green infrastructure improvements to said parcels; and

 

Whereas, Green infrastructure improvements through this funding source will help divert storm water from local sewerage systems; and

 

Whereas, MMSD requires Riverworks, and the City to enter into a conservation easement for the parcels; now therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Green Infrastructure Conservation Easement that was submitted to this file is hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter this conservation agreement document in the same form, or in substantially the same form and substance, as has been submitted to this file; and (ii) to take such further acts as may be contemplated or required to be taken by the City under that document so as to carry out the intent and purpose of this resolution and that document.
