Title

Resolution authorizing City entry into Green Infrastructure Funding Agreements, and Conservation Easements, with MMSD and MPS for MPS properties, in the 2nd, 3rd, 5th, 8th, and 14th Aldermanic Districts.

Analysis

This resolution authorizes the City of Milwaukee to enter into Green Infrastructure Funding Agreements, and Conservation Easements, with MMSD and MPS for grant funding for installation of green infrastructure at various MPS properties.

Body

 

Whereas, The City of Milwaukee is the owner of record of the following Milwaukee Public Schools (MPS) sites concerning which the MPS Board has the duty of care, control and management under Wis. Stat. 119.16 (1m) and (3)(b) and Wis. Stat. 119.60 (2):

 

                     3778 North 82nd Street (German Immersion School)

                     1250 East Burleigh Street (Frederick J. Gaenslen School)

                     1728 South 23rd Street (Alexander Mitchell Integrated Arts School)

                     2424 South 4th Street (James Whitcomb Riley School)

                     5760 North 67th Street (Richard Kluge School)

 

Whereas, The Metropolitan Milwaukee Sewerage District (MMSD) has, in the past, provided grant funding to MPS to reimburse MPS for green infrastructure improvements to MPS school sites, including at some of the schools referenced above; and 

 

Whereas, MMSD is willing to use additional funds available to it to reimburse MPS for additional green infrastructure improvements at these MPS school sites; and

 

Whereas, Green infrastructure improvements through this funding source will help divert storm water from local sewerage systems; and

 

Whereas, MMSD requires MPS, and the City as the record title holder of the MPS sites: to enter into funding agreements for each parcel; and to enter, after the infrastructure has been installed at each of these school sites, a conservation easement for each parcel; and

Whereas, The Green Infrastructure Funding Agreements now needed for these particular MPS school sites have been submitted to this file; and

 

Whereas, The template conservation easement to be used post-installation, for each school site, will be in substantially the same form and substance as the template conservation easement that was approved by the Common Council in Resolution File No. 191139; now therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Green Infrastructure Funding Agreements that were submitted to this file are hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter those funding agreement documents in the same form, or in substantially the same form and substance, as have been submitted to this file; and (ii) to cause the City to enter, for each school site, post-installation of the green infrastructure improvements, the conservation easement in the same form, or in substantially the same form and substance, as was submitted to File No. 191139 and approved by that Resolution File; and (iii) to take such further acts as may be contemplated or required to be taken by the City under those documents so as to carry out the intent and purpose of this resolution and those documents.
