Analysis

This resolution authorizes the City of Milwaukee entry into Green Infrastructure Ten-Year Maintenance Covenants with Milwaukee Metropolitan Sewerage District at various locations.

Body

Whereas, The City of Milwaukee (City) constructed the following Green Infrastructure at various locations:

•                     One green alley bounded by West Villard Avenue, North 51^st Street, West Fairmount Avenue, and North 53^rd Street, in the 1^st Aldermanic District

•                     Two green alleys bounded by West Burleigh Street, North 90^th Street, West Chambers Street, and North 91^st Street, in the 5^th Aldermanic District

•                     Nineteen bioswales along West Bradley Road between North 51^st Street and North 124^th Street, in the 5^th and 9^th Aldermanic Districts

•                     Six bioswales along West Brown Deer Road between North 95^th Street and North 124^th Street, in the 9^th Aldermanic District

•                     Three bioswales along West Keefe Avenue between North 60^th Street and West Appleton Avenue, in the 10^th Aldermanic District

•                     Eight permeable paver areas along West Dakota Street between South 11^th Street and South 13^th Street, in the 14^th Aldermanic District; and

Whereas, The Green Infrastructure improvements will help divert stormwater from local sewerage systems; and

Whereas, The City was awarded Green Solutions grant funding from the Milwaukee Metropolitan Sewerage District (MMSD) for said improvements; and 

Whereas, The Common Council has adopted the File Numbers 180393, 181694, 181695, and 181696, and 181697 authorizing the acceptance of said funding from MMSD; and

Whereas, The agreement for said funding stipulated that the City shall execute maintenance covenants in favor of MMSD; and

Whereas, MMSD has drafted said covenants which shall be in effect for a period of ten years; and

Whereas, Said covenants needed for these particular Green Infrastructure improvements have been submitted to this file; now therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Green Infrastructure Ten-Year Maintenance Covenants that were submitted to this file are hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter those maintenance covenant documents in the same form, or in substantially the same form and substance, as have been submitted to this file; and (ii) to take such further acts as may be contemplated or required to be taken by the City under those documents so as to carry out the intent and purpose of this resolution and those documents.
