Analysis

Resolution authorizing City of Milwaukee entry into a Limited Term Conservation Easement Agreement with Milwaukee Metropolitan Sewerage District for Green Infrastructure at 1640 South 10th Street.

Body

Whereas, The City of Milwaukee (City) constructed Green Infrastructure in a City owned parking lot located at 1640 South 10th Street; and

 

Whereas, Said Green Infrastructure improvements include four bioswales and porous pavement that will help divert stormwater from local sewerage systems; and

 

Whereas, The City was awarded Green Solutions grant funding from the Milwaukee Metropolitan Sewerage District (MMSD) for said improvements; and

 

Whereas, The Common Council has adopted the File Number 190093 authorizing the acceptance of said funding from MMSD; and

 

Whereas, The agreement for said funding stipulated that the City shall execute a conservation easement in favor of MMSD; and

 

Whereas, MMSD has drafted said easement which shall be in effect for a period of ten years; and

 

Whereas, Said easement needed for these particular Green Infrastructure improvements have been submitted to this file; now therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials, including the Commissioner of Public Works, are hereby authorized: (i) to sign Limited Term Conservation Easement in the form and substance submitted to this file, or in substantially the same form and substance, as have been submitted to this file, and to effectuate the intent of this resolution; and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
