Title

Resolution authorizing granting a Temporary Limited Easement to the Wisconsin Department of Transportation for a portion of the City-owned property at 1600 West Edgerton Avenue for the Interstate 41 Highway Safety Project, in the 13th Aldermanic District.

Analysis

This resolution permits the City of Milwaukee to grant a temporary limited easement for a highway safety project.

Body

Whereas, The Wisconsin Department of Transportation (“WisDOT”) is undertaking a highway improvement project to improve Interstate 41 and needs to acquire easement rights along the freeway; and

 

Whereas, Land needed for the improvements are part of 1600 West Edgerton Avenue (the “Property”) that is owned by the City of Milwaukee (“City”) and is managed as a park by the Department of Public Works (“DPW”); and

 

Whereas, WisDOT presented the City as the fee owner with an appraisal and offer to acquire property rights at the property consisting of acquisition of a temporary limited easement for use of 0.047 acres of the site for stormwater management; and

 

Whereas, The appraisal presented by WisDOT has been reviewed by the City Real Estate and DPW staff and a negotiated settlement has been reached between WisDOT and the City to acquire easement rights, in the total amount of $1,400; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of the Department of City Development, or designee, is authorized to execute the easement, and other documents necessary to grant the temporary limited easement to the State of Wisconsin, and to take such further acts as are or may be necessary to effectuate this resolution; and, be it

 

Further Resolved, The compensation for the temporary limited easement of $1,400 shall be deposited with the City’s DPW since they are the caretaker of the Property.
