Minutes note: Kevin Kuschel - DCD - said that it is an actual street and will be vacated to continue to work as a loading deck and that will not affect the beer line trail. Ald. Brostoff asked Mr. Kuschel to explain the need for this change. Mr. Kuschel said that the loading deck is in need of repair. The requesting part said that it is more about a safety issue because it is a wooden deck that was built in 1930's and that there are no changes on the business operations. Ald. Brostoff asked to make it to the neighbors as smooth as possible and to be accessible to them. Mr. Rad said that Ald. Brostoff answered all the questions and that he has no objections to the project but that he wanted to know if there is a chance to make it a little bit less of the angle just to avoid that the garbage collection is not affected.

Title

Substitute resolution to vacate a portion of East Wright Street in the block bound by East Meinecke Avenue, North Gordon Place, East Wright Street and the Milwaukee River, in the 3rd Aldermanic District.

Analysis

This resolution vacates the above public right-of-way in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 62.73, Wisconsin Statutes, and Section 308-28, Milwaukee Code of Ordinances. This vacation was requested by Seidel Tanning Corporation to repair and replace their existing loading dock.

Body

Whereas, It is proposed that a portion of East Wright Street in the block bound by East Meinecke Avenue, North Gordon Place, East Wright Street and the Milwaukee River be vacated pursuant to the provisions of Section 62.73, Wisconsin Statutes; and

 

Whereas, The Department of Public Works has been directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and

 

Whereas, That as provided by Sections 62.73(1) and 840.11, Wisconsin Statutes, a lis pendens must be filed with the Milwaukee County Register of Deeds; and

 

Whereas, Said vacation has been reviewed in accordance with Section 308-28, Milwaukee Code of Ordinances; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that said portion of public right-of-way is vacated as indicated in Exhibit A and bound and described by:

 

That part of East Wright Street in the Subdivision Into City Lots of the West 6.609 Acres of Lot 20, Also the West 6.027 Acres and the East 0.71 Acres of Lot 19, a recorded subdivision, in the Southeast 1/4 of Section 16, Township 7 North, Range 22 East, described as follows: Beginning at the northwest corner of Block 71 in said subdivision; thence Northerly, along the northerly extension of the west line of said Block 71, to a point lying 15.50 feet north of, as measured perpendicular to, the north line of said Block 71; thence East, parallel to said north line, 100.00 feet; thence Southeasterly, to a point lying 107.00 feet east of the northwest corner of said Block and 9.00 feet north of, as measured perpendicular to, said north line; thence Southerly, to a point in said north line, said point lying 107.00 feet east of the northwest corner of said Block; thence Westerly, along said north line, 107.00 feet to the point of beginning; and, be it

 

Further Resolved, That a notice of pendency of said vacation has been recorded at the Milwaukee County Register of Deeds and the Commissioner of the Department of City Development may request a release of the lis pendens without Common Council action if said vacation is not approved; and, be it

 

Further Resolved, That the Commissioner of Public Works and/or the City Engineer are authorized to implement the actions listed in the coordinated report relating to said vacation and when a money deposit is required, it must be deposited prior to implementing said actions; and, be it

 

Further Resolved, That as provided by Sections 62.73(1) and 66.1005(2), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto held, acquired by or belonging to any county, school district, town, village or city, or to any utility or person that relate to any underground or overground structures, improvements or services, as enumerated or otherwise existing in said description of land above-described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said portion of right-of-way had not been vacated; and, be it

 

Further Resolved, That the proper City officials, including the Commissioner of Public Works, are authorized to sign any easements or other documents necessary to assert the City of Milwaukee’s rights under Section 66.1005(2), Wisconsin Statutes, and cause the same to be recorded in the Milwaukee County Register of Deeds Office.
