Analysis

This resolution authorizes the Commissioner of Public Works to execute documents required for right-of-way acquisition, including easements on City-owned parcels, and approves the right-of-way exhibits associated with the rehabilitation of North 20th Street (STH 57) North Avenue to Hopkins Street. The total estimated cost of the right-of-way acquisition is $205,000. Federal/State grantor funds will cover 100% of the aforementioned costs; and

 

This resolution authorizes the Commissioner of Public Works to execute documents required for right-of-way acquisition, including easements on City-owned parcels, and approves the right-of-way exhibits associated with the safety improvements of North 76th Street (STH 181) and West Hampton Avenue. The total estimated cost of the right-of-way acquisition is $18,000. Federal/State grantor funds will cover 100% of the aforementioned costs; and

 

This resolution authorizes the Commissioner of Public Works to execute documents required for right-of-way acquisition, and approves the right-of-way exhibits associated with the reconstruction of East Wells Street (STH 32); N Broadway to N Van Buren Street. The total estimated cost of the right-of-way acquisition is $69,000. Federal/State grantor funds will cover $58,000 and local funds will cover $11,000; and

 

This resolution authorizes the Commissioner of Public Works to execute documents required for right-of-way acquisition, including easements on City-owned parcels, and approves the right-of-way exhibits associated with the replacement of the South 70th Street structure over the Canadian Pacific Railroad and Hank Aaron State Trail. The total estimated cost of the right-of-way acquisition is $45,000. Local funds will cover 100% of the aforementioned costs; and

 

Body

Whereas, Project agreements have been executed by the Wisconsin Department of Transportation and the City of Milwaukee for the rehabilitation of North 20th Street (STH 57) North Avenue to Hopkins Street using Federal and State aid under the State Highway Rehabilitation Program, in accordance with Common Council Resolution File Number 171655 adopted March 27, 2018; for the improvement of North 76th Street (STH 181) and West Hampton Avenue using Federal and State aid under the Highway Safety Improvement Program, in accordance with Common Council Resolution File Number 181690 adopted March 26, 2019; for the improvement of East Wells Street (STH 32); Broadway to Van Buren using Federal and State aid under the State Highway Rehabilitation Program, in accordance with Common Council Resolution File Number 191112 adopted November 15, 2019; and for the replacement of the South 70th Street structure over the Canadian Pacific Railroad and Hank Aaron State Trail using Local Bridge Program, in accordance with Common Council Resolution File Number 140427 adopted July, 22, 2014; and

 

Further Resolved, That the City Comptroller is hereby directed to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary accounts for the right-of-way acquisitions (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

Whereas, The various improvement projects require real estate acquisitions of portions of parcels that lie adjacent to the project’s right-of-way within the City of Milwaukee; and

 

Whereas, The City engaged consulting firms, as part of preliminary engineering, to undertake right-of-way exhibit preparation, appraisal, legal description, and real estate acquisition services; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the right-of-way exhibits required for the aforementioned projects, copies of which has been submitted to this file, is hereby approved and the City is authorized to acquire the necessary real estate interests shown on the right-of-way exhibits that are needed for the project; and be it

 

Further Resolved, That City officers, including the Commissioner of the Department of Public Works, are authorized to execute documents required for the real estate acquisition, including the right-of-way acquisition, and the right-of-way exhibits, the relocation order, and documents to acquire the real estate interests; and be it

 

Further Resolved, That minor revisions in the plat to meet altered and unforeseen conditions encountered during acquisition of right-of-way are hereby authorized and approved; and, be it

 

Further Resolved, That the City is hereby authorized to approve and make payments associated with real estate acquisition for the project.
