Title

Resolution approving a Conduit Occupancy License Agreement between the City of Milwaukee and Messmer Catholic School, Inc. to occupy a portion of the City's communication conduit system.

 

Analysis

This resolution approves a Conduit Occupancy License Agreement (COLA) between the City of Milwaukee(“City”) and Messmer Catholic School, Inc. (“Messmer”) to occupy a portion of the City’s communications conduit system.

 

Body

Whereas, the City owns and operates a conduit system located in the City of  Milwaukee, County of Milwaukee, State of Wisconsin (“Conduit System”) ; and

 

Whereas, Messmer has requested permission to place and maintain telecommunications facilities (“Messmer’s Facilities”) in the portions of the City’s Conduit System described on Exhibit A to this Agreement; and

 

Whereas, Carroll does not provide telecommunications services for a fee directly to the public and is therefore not covered by Chapter 98 of the Milwaukee code of Ordinances; now, therefore be it

 

Resolved, That the Common Council of the City of Milwaukee grants approval of the Conduit Occupancy License Agreement (COLA) between the City of Milwaukee and Messmer Catholic School, Inc, a copy of which is attached and incorporated in this resolution by reference as though set forth therein in fill; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and approved to make minor revisions to the agreement that does not change the intent of the license agreement; and be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to execute the license agreement on behalf of the City.
