Title

Analysis

This resolution amends a lease agreement with New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the Milwaukee Fire Department facility located at 5600 W. Oklahoma Avenue which was authorized by Common Council Resolution File Number 000716 which has been amended three prior times most recently via Common Council Resolution File Number 180548.

Body

Whereas, The Common Council adopted Resolution File Number 000716 on September 22, 2000 approving a lease agreement with a predecessor in interest of New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the Milwaukee Fire Department facility located at 5600 W. Oklahoma Avenue (the “Lease”); and

 

Whereas, The Common Council has approved three prior amendments to the Lease to reflect equipment upgrades most recently via the adoption of Resolution File Number 180548 on July 31, 2018; and

 

Whereas, The Department of Administration, working with the City Attorney's Office, has negotiated a fourth amendment to the Lease; and

 

Whereas, This fourth amendment of the lease agreement between the City and New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the fire station located at 5600 W. Oklahoma Avenue, allows New Cingular Wireless PCS, LLC to further upgrade its facilities; and

 

Whereas, The Lease offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves and amends the lease agreement, identified as the "Fourth Amendment to Lease Agreement," between the City of Milwaukee and New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the fire station located at  5600 W. Oklahoma Avenue, a copy of which is attached to this file, and authorizes the proper City officials to enter into this lease amendment on behalf of the City of Milwaukee; and be it

 

Further Resolved, That the proper City officials, in consultation with the City Attorney's office, are authorized to make non-substantive changes to the lease amendment, without further Common Council action as necessary to achieve the intent of the City's action
