Analysis

This ordinance revises various provisions of the code for purposes of correcting errors and updating provisions.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Sections 105-56-1 and 2-b of the code is amended to read:

 

105-56. Sales on Public Premises.

 

1. PURPOSE. It is determined and declared that the use of certain public premises for the specific public purposes to which such premises are intended is preeminent. It is further determined and declared that sales on the designated public premises interfere with their use for their intended purposes. It is further determined and declared that the use of the public sidewalk and streets outside of the entrance to the Wisconsin Center, the Auditorium, the Arena, the Milwaukee Public Museum, the Fiserv Forum, the Performing Arts Center, the Rave/Eagles Club, the Riverside Theater, Summerfest and [[Miller Park]] >>American Family Field<< parking facilities, for sales interferes with the orderly ingress and egress to and from those premises and therefore with their use for their intended purposes.

 

2. REGULATIONS.

 

b. It shall be unlawful for any person to sell, or offer to sell, any goods, merchandise, foodstuffs, tickets or any other article of any kind on any public street or public sidewalk within 500 feet of the premises of the Wisconsin Center, the Auditorium, the Arena, the Milwaukee Public Museum, the Fiserv Forum, the Performing Arts Center, the Rave/Eagles Club, the Riverside Theater, Summerfest or [[Miller Park]] >>American Family Field<< parking facilities, for the period of time beginning 2 hours immediately before the commencement of any scheduled event therein and ending one hour immediately after the conclusion of the event. This paragraph does not apply to any sales or offers to sell on the premises listed.

 

Part 2. Section 106-2.1-1.5-a of the code is amended to read:

 

106-2.1. Drinking Upon Public Parking Structures and Public Parking Surface Lots.

 

1.5. EXCEPTION.

 

a. [[Miller Park]] >>American Family Field<< parking surface lots during sporting events and concerts.

 

Part 3. Section 236-31-2-e of the code is amended to read:

 

236-31. Fireworks.

 

2. PYROTECHNIC DISPLAYS, BLANK CARTRIDGES, FLARES PERMITTED.

 

e. The use of fireworks for pyrotechnic displays held in conjunction with events at [[Miller Park]] >>American Family Field<<, under permit granted by the department, provided that no fireworks shall be discharged:

 

Part 4. Section 304-29-4-c-0 of the code is amended to read:

 

304-29. Tax Stabilization Fund.

 

4. FUND WITHDRAWALS.

 

c. Compliance. Notwithstanding the provisions of [[pars. b and c]] >>pars. a and b<<, the tax stabilization fund may be used to stabilize the common council controlled tax rate beyond the limits covered by pars. a and b but only when all of the following conditions are met:

 

Part 5. Section 305-32 of the code is amended to read:

 

305-32. Official Depository for City Documents. The [[legislative reference bureau]] >>municipal research library<< is the official depository of copies of city documents as identified in this section. The head of each city department, board and commission shall promptly submit the following to the [[bureau]] >>library<<:

 

1. [[Three copies]] >>One copy<< of each report. In this subsection >>,<< "reports" includes studies, bulletins, circulars, brochures, pamphlets or similar items issued by any city department, board and commission regardless of the medium on which it produced. "Reports" also includes consultants' reports, but excludes materials such as forms, general correspondence, interoffice and intraoffice memoranda or materials of a similar nature.

 

2. One copy of minutes and bylaws. In this subsection:

 

a. "Minutes" refers to the summaries or transcriptions of meetings held by city boards, committees, task forces and commissions.

 

b. "Bylaws" refers to the rules adopted by any board or commission for its governance and the conduct of meetings.

 

3. [[Three copies]] >>One copy<< of annual reports or any statement of its activities for the preceding year as soon as printed or otherwise available.

 

Part 6. Section 370-1-9 of the code is amended to read:

 

370-1. Definitions.

 

9. CONTRACTOR means a separate and distinguishable business entity participating or seeking to participate in the performance of a contract. [[d disadvantaged by the common council.]]
