Title

Resolution granting a request by the City of Glendale for storm sewer service to a property located partially within both the Cities of Glendale and Milwaukee, at 4189ADJ North Port Washington Road, in the 6th Aldermanic District.

 

Analysis

This resolution will grant the City of Glendale permission to connect a proposed development located at 4189ADJ North Port Washington Road, formerly known as 4205 North Port Washington Rd, to a City of Milwaukee storm sewer in North Port Washington Road between West Olive Street and West Estabrook Boulevard.

 

Body

Whereas, Said property is now Lot 1 of CSM Number 9249, recorded in the Milwaukee County Register of Deeds on August 13, 2020 as Document Nos. 11009543 and known as 4189ADJ North Port Washington Road; and

 

Whereas, Said parcel is located partially within both the Cities of Glendale and Milwaukee; and

 

Whereas, There is an existing 48 inch diameter storm sewer in North Port Washington Road; and

 

Whereas, The owners of said property have indicated that they intend to construct an industrial facility (Facility) at said location, and connect the building storm sewer of said Facility to said City of Milwaukee storm sewer; and

 

Whereas, A Stormwater Management Plan (SWMP) is required and has been submitted for said Facility; and

 

Whereas, Said SWMP proposes a water quality pond within the City of Milwaukee that discharges to said City of Milwaukee storm sewer; and

 

Whereas, On August 9, 2021, the Common Council of the City of Glendale, adopted a resolution requesting permission from the City of Milwaukee to connect the property at 4205 North Port Washington Road, to said City of Milwaukee storm sewer; now therefore, be it;

 

Resolved, By the Common Council of the City of Milwaukee that permission is hereby granted to the owner of the Facility to connect to said City of Milwaukee storm sewer in North Port Washington Road between West Olive Street and West Estabrook Boulevard subject to the following conditions:

 

1.                     That the owner shall obtain the necessary City of Milwaukee Building and Plumbing Permits.

 

2.                     That the City of Glendale shall reserve and delegate to the City of Milwaukee an irrevocable right to levy and collect the sewer user charges as computed by the City of Milwaukee.

 

3.                     That the City of Glendale shall grant to the Building Inspector of the City of Milwaukee full cooperation and privilege to inspect the plumbing facilities of the building.

 

4.                     That it is understood and agreed by both parties that nothing in this resolution shall be construed to mean or imply that the City of Milwaukee shall be held liable to serve any additional area in the City of Glendale.

 

5.                     That the City of Glendale shall require that all clear water, including storm water, be discharged into a storm sewer in accordance with the rules of the State Plumbing Code, Milwaukee Metropolitan Sewerage District and the Wisconsin Department of Natural Resources

 

6.                     That the City of Glendale will assist and cooperate with the City of Milwaukee in the event the City of Milwaukee finds it necessary to enforce the maintenance and recertification of said SWMP if and only if the property owner does not comply with the City of Milwaukee;

 

7.                     That the City of Glendale forfeits all claim to the benefits of the structural storm water quality amenities to the City of Milwaukee; and, be it

 

Further Resolved, That a certified copy of this resolution be forwarded to the City of Glendale upon its adoption.
